현대 한국은 빠르게 다문화사회로 이행되는 과정을 겪고 있다. 이러한 전환의 긍정적인 현상에도 불구하고 그 진행과정에서 불가피하게 나타날 수밖에 없는 서로 다른 문화 사이의 이질감에 따른 갈등은 심각한 사회 문제로 대두되기 마련이다. 이에 대한 대응책의 하나로 법제도의 구비를 들 수 있다. 우리나라는 사회통합이라는 바람직한 ``다문화`` 사회를 구현하기 위해「다문화가족지원법」을 비롯한 다양한 법률을 두고 있다. 사실, 다문화법제에 대한 전반적인 이해와 다문화사회를 바라보는 보편적인 시각의 확보를 위해서는 다양한 학문 영역의 도움을 필요로 한다. 이 글에서는 그 하나의 틀로 인권과 그 법사상을 빌리고자 한다. 인권의 개념을 결과로서 찾아내려는 법적인 의미의 권리와는 다르게 과정을 중시하는 생각은 현재 다문화사회를 바라보는 하나의 시사점을 제공해 준다. 권리를 얻은 다음의 ``관계``에서 다시 시작하는 계기를 우리에게 제공해 줄 수도 있기 때문이다. 한국문화라는 말의 표현이 내포하듯이 베트남문화, 인도네시아문화, 필리핀문화 등이 성립할 수 있고, 라틴문화, 유럽문화라는 말도 얼마든지 가능하다. 문제는 이를 대하고 만나는 동안에 빚어지는 부작용이다. 중요한 것은 사회의 범주 속으로 들어 온 다문화의 이해와 소통이다. 인권 논의가 그렇듯이 ``인권``이라는 어의 속에 들어 있는 관념을 드러내려는 시도는 바로 이를 위함이다. 문화적 속성 탓이기는 하지만 유달리 우리는 이민족과 그 문화에 대한 배타성이 강하다. 여기서 인권사상의 보편적 성격을 찾아야 하는 이유가 발견된다. 급속한 경제 성장의 토대 위에서 있는 우리의 경우 자발적 이주노동자와 결혼이민자들에 대한 유입이 왜 사회문제로 대두되는지에 대한 진지한 숙고도 결국 이로부터 비롯되어야 한다. 근대 인권사상의 전개에서 핵심적 역할을 했던 자유주의의 가치는 관용과 자유, 평등이었다. 여기서 인권사상의 자리가 발견된다. 이것이 현대에 이르러 정치적 이념과 국경을 초월해 보호 받아야 할 하나의 가치로 인정받기 위해서도 다문화사회를 이해하는 준거로서 기능해야 하는 것이다. If the culture of Korea will establish a variety of possible formation of different cultures are possible. As a result of the exposure to the multiculture, we will utilize new culture. Sometimes due to the sensitive nature of the culture, it will be necessary to implement social development. Several of the multicultural contents deal with diversity and how to appropriately handle problems. Therefore, the multicultural understanding and communication is needed. Here is a good companion to the human rights thoughts. And such ideas of society based on human rights law is wholesome nourishing. Tolerance, liberty and equality of the value of human rights thoughts transcends racial and national borders, Hopefully, these social thoughts will process the cultural information of their contemporary, and construct meaning pertinent to their lives, We know that it is only through human rights thoughts, understanding, and finally acceptance, that one can begin to break down the walls of racism, bigotry, and prejudice, and aspire to co-exist effectively and harmoniously.
