일본의 사회복지법인은 1951년 사회복지사업법(2000년 사회복지법 개정)이 제정되어 행정조치 제도에서 복지서비스 공급 주체의 중심적인 역할을 수행해왔다. 복지서비스 지원제도인 행정기관의 수급자 결정조치제도로부터 개인 계약에 의한 제도로 바뀐 현재까지도 제1종 사회복지사업을 운영할 수 있는 등 특별한 지위를 부여받아 왔다. 그러나 복지서비스 공급 주체가 다양화된 이후에는 동등한 위치(Equal Footing) 에서의 사회복지법인 정체성에 대한 논의가 이루어져 왔다. 이러한 배경에서 2016년도부터 ①복지거버넌스 강화, ②투명성 제고, ③재정의 건전성 강화, ④지역에서의 공익적인 활동을 실시 할 책무, ⑤행정기관의 관여를 중심으로 하는 사회복지법인 제도의 개혁이 시작되었다. 법인개혁을 시작한 지 5년이 경과한 지금은 거버넌스 강화와 투명성 제고, 행정기관의 관여에 대해서는 어느 정도의 성과가 있었지만, 재무규칙 강화와 지역에서의 공익적인 활동 평가에 대해서는 불충분하다. 연구의 결론은 사회복지법인은 지역사회의 요구에 맞춰서 지역사회에 공헌을 강화하고 그것을 사회에 명확히 설명할 책임이 있다는 것이다. 또한, 소규모의 사회복지법인이 다수이기 때문에 법인합병을 추진하는 등 다각적인 법인의 자구책 노력이 필요하며, 새로 설립되는 사회복지법인연계 추진법인의 형식을 적용하여 법인본부의 기능을 강화하여 안정적인 법인의 경영기반을 확립할 필요가 있다. Japanese Social welfare corporations are juridical persons established were established in 1951 under the Social Welfare Service Act (amended to the Social Welfare Act in 2000) for the purpose of conducting the social welfare services. And they have played a major role in the provision of welfare services under the system of measures. Even today, when the supply of welfare services has changed from measures to contracts, they are still granted special status, such as the ability to manage Type 1 social welfare services. However, with the diversification of welfare service providers, debates have arisen regarding equal footing and the nature of social welfare corporations. From 2016, the reform of the social welfare corporation system began, focusing on (1) strengthening governance, (2) improving transparency, (3) strengthening financial discipline, (4) public-interest activities for the local community (5) government involvement. Five years have passed since the start of the reform, and while results have been achieved in terms of strengthening governance, improving transparency, and government involvement, but the strengthening of financial discipline and public-interest activities for the local community have not been sufficient. In the future, they should respond the local community s need and required fulfill accountability for society. fu addition, since there are many small-scale social welfare corporations, along with expanding the scale of their operations they need to expand the scale of their operations through mergers or business diversification, as well as to establish a stable management base by using the newly established mechanisms such as the Social Welfare Alliance Promotion Corporation. And to achieve this, it is necessary to strengthen the functions of the corporate headquarters. The contents and issues of Japan s social welfare corporation reform will also lead to suggestions for the management of social welfare corporations in Korea.
