법률의 합헌성을 향상하기 위한 방법 : 프랑스의 입법절차와 통제를 중심으로

‘법률의 질(la qualité de la loi)’이 무엇인가에 대하여 정의를 내리기는 쉽지 않지만, 기본권의 해석 및 기본권을 제한하는 법률의 합헌성 심사에 있어 하나의 해석기준으로 작용하는 헌법의 기본원리가 보장된 규범은 그 품질이 보장된 법률이라고 할 수 있다. 특히 헌법의 기본원리 중 하나인 법치주의는 위헌법률심판을 통해 구현될 수 있지만, 우리나라에서의 위헌법률심판은 이미 제정된 법률에 대하여 그 법률이 재판의 전제성이 있는 경우에 청구할 수 있기 때문에 법률의 위헌성을 사전에 파악하고 치유할 수 없다는 한계가 있다. 띠라서 실질적 법치주의를 보장하여 질 높은 법률을 제정하기 위해서는 입법절차에 서부터 헌법상 기본원리가 보장되어야 한다. 헌법 제40조는 “입법권은 국회에 속한다.”고 하여 입법권을 국회의 권한으로 부여하고 있고 또한 헌법 제 52조 제 l항은 “국회의원과 정부는 법률안을 제출할 수 있다.”라고 규정 함으로써 정부에게도 법률안 제출권을 부여하고 있다. 이외에도 헌법상 대통령의 법률안 공포권(제53조 제1항)이라든지 대통령의 법률안거부권(제53조 제2항) 등을 규정하고 있는데 이러한 규정틀을 통하여 다른 국가기관, 특히 집행부도 입법과정에 참여하게 하고 있다. 이처럼 입법과정에서 국회 이외의 다른 국가기관의 입법과정에의 참여를 보장하는 것은 국회와 다른 국가기관 간의 상호 견제를 통하여 권력분립의 원칙을 실현하는 것일 수도 있고, 다른 국가기관이 국회의 입법권을 통제하도록 하는 것일 수도 있고, 국회와 다른 국가기관 간의 유대관계를 강화하기 위한 것일 수도 있다. 한편 프랑스 제5공화국 헌법은 제24조 제1항에서“의회는 법률을 표결한다. 의회는 정부를 통제한다. 의회는 공공정책을 평가한다.”라고 함으로써 의회의 입법권을 규정하고 있다. 그러나 입법권이 의회에 부여되어 있다고 하지만 헌법 제34조에 의하여 의회가 제정할 수 있는 법률에는 일정한 제한이 있다. 또한 프랑스 제5공회국 헌법은 입법권은 의회에 부여하고 있지만 입법과정에서 정부에 법률안제출권을 부여하고 있고, 대통령에게 법률안거부권을 부여한다든지, 정부와 대통령 에게 법률안에 대한 불수리권을 부여함으로써 입법과정에서 의회에 영향력을 행사할 수있도록 하고 있다. 나아가 헌법재판소의 사전적 규범통제를 통하여 입법절지에 상당히 많은 개입을 할 수 있도록 헌법상 보장하고 있다. 이처럼 프랑스의 입법절차에서 집행부가 상당부분 개입할 수 있고 특히 법률안의 빠른 처리를 위한 통제, 그리고 내용적 정당성을 넘어 절차적 정당성도 따져볼 수 있는 절차가 헌법상 보장되어 있는 점은 우리에게 시사하는 바가 크다고 할 수 있다. Le problemé de la qualité de la loi est lié de manière actuelle à la justice constitutionnelle par plusieurs biais. Certaines conceptions assurent qu’il ne s agirait pas seulement de contrôler les prémisses formelles du vote, mais également les procédures de délibération, afin de garantir au mieux l’exercice démocratique. Cette position peut conduire à des tensions avec la doctrine traditionnelle de la séparation des pouvoirs. la procédure législative signifie une procédure sériel clans laquelle des propositions des lois sont soumises par le gouvernement ou le parlement, et des exarmens, des votes sont organisés par le parlement. L’article 40 de la Constitution Coréenne garantit le pouvoir législtatif en spécifiant que “le pouvoir réislatif appartient au Parlement”, en suite elle le garantit aussi au gouvernement en satuant l a iticle 52 alinéa 1. En outre, le gouvernement peut participer à la procédur législative avec “la promulgation de loi”, et “la demande de nouvelle délibération”, En utilisant ces articles, le gouvernement peut participer à la procédure légslative. La garantie de participation l’organisation hors les Assembléés clans le domaine de la procédure législative fait la réalisation de la séparation et le contrôle du pouvoir ou le renforcement des relations mutuelles entre l’Assemblée et d’autre organisation par rapport au gouvernement. D une part, la Connstitution de la Ve République franÇaise, en revanche, dispose à l’ainéa 1 de l’article 24 que ”Le Parlement vote la loi. Il contrôle l’action du Gouvernement. Il évalue les politiques publiques.” Cependant, bien que le Parlement ait un pouvoir légslaif, le Parlement peut établir certaines restricions en vertu de l’article 34 de la Constitution. De plus, même si la Constitution de la Ve République française donne le pouvoir législatif au Parlement, elle donne au gouvemement le droit de soumettre des projets de loi au cours de la procédure législative, et le droit du irrecevabilité et puis elle garantit au président de la République le droit pour demander de nouvelle délibération sur la loi. En outre, la Constitution garantit aussi le controle du constitutionnalité par le Conseil Constitutionnel. La Constitution lui permet de faire l’intervention clans la procédure législative. Ils sont trés impressionnant car le gouvernement peut intervenir ou participer la procédure législative, ensuite la Constitution permet des processus pour faire le contrôle du constitutionnalité.

Clozapine is an atypical antipsychotic agent that is more effective than the typical neuroleptics in the treatment of refractory schizophrenia. Recently, there has been an increased recognition of the association of clozapine with myocarditis and cardiomyopathy. Commonly used diagnostic tests have limited sensitivity in diagnosing this potentially life-threatening complication. Here we report a case of 36-year-old male patient who developed fever, tachycardia, and dyspnea after introduction of clozapine. By clinical evaluation and laboratory test we diagnosed the patient with myocarditis and treated him successfully. To our knowledge this is the first case report of clozapine-induced myocarditis in Korea.

Treatment of schizophrenia is one of the most challenging areas in the field of psychiatry. There has been much improvement in psycho-pharmacotherapy, and at present, psycho-pharmacotherapy along with milieu therapy and social rehabilitation is the standard first-line treatment for schizophrenia. Healing environment, a concept which has arisen from the architectural field, has similarities in meaning to milieu therapy in psychiatry. In other words, healing environment may be an encountering point between psychiatry and architecture. In this encountering, each field can understand each other and expand its concept to aid the treatment of schizophrenia and to plan the build-up of the entire environment considering its social and psychological effects. In this paper, we aim to establish the basic concept of healing environment to alleviate the psychopathologies in schizophrenic patients. We worked under the premise that physical setting affects human behavior and mind, and that physical setting should play a role as a medium with therapeutic potential for patients with medical problems. The aims of this paper are as follows. First, theoretical discussion of the concept and the constructs of healing environment : second, understanding of the schizophrenic symptoms that may be affected by supporting environment : and third, discussion of supporting environment that may alleviate the symptoms of schizophrenia.

소방공무원에서 탄력성이 외상후스트레스 증상과 해리에 미치는 영향 : 우울의 매개 효과

연구목적 본 연구는 소방공무원에서 탄력성이 외상후스트레스 증상 및 해리에 미치는 영향과 함께, 탄력성과 각 외상후스트레스 증상 및 해리의 관계에서 우울의 매개효과에 대해서 알아보고자 하였다. 방 법 총 115명의 소방공무원을 대상으로, 생활사건 체크리스트, 사건충격척도-개정판, 해리경험척도, 벡 우울척도, 코너-데이비슨 탄력성 척도를 시행하였다. 탄력성이 외상후스트레스 증상과 해리에 미치는 영향 및 우울의 매개효과를 확인하기 위해 구조방정식모형(Structural equation modeling)과 경로분석(path analysis)을 실시하였다. 결 과 탄력성이 높을수록 낮은 외상후스트레스 증상과 낮은 해리를 보였으며, 각 탄력성과 외상후스트레스 증상 및 해리의 관계는 우울이 완전 매개를 하는 것으로 나타났다. 즉, 탄력성이 외상후스트레스 증상 및 해리에 대해 직접적인 영향이 아닌 우울을 통해 간접적으로 각 증상을 감소시킴을 보여주었다. 결 론 본 연구는 소방공무원에서 외상후스트레스 증상 및 해리의 예방과 치료에 있어 탄력성 강화와 우울 증상 감소를 목표로 한 임상적 개입이 중요함을 시사한다. Objectives : This study aimed to investigate the effects of resilience on posttraumatic stress symptoms and dissociation and whether depression mediates the relationships between resilience and posttraumatic stress symptoms and dissociation. Methods : A total of 115 firefighters participated in the study. Data were collected via the Life Events Checklist, Impact of Event Scale-Revised, Dissociative Experience Scale, Beck Depression Inventory, and Connor-Davidson Resilience Scale. Structural equation modeling and path analysis were applied to estimate the relationships between resilience, depression, posttraumatic stress symptoms, and dissociation. Results : Greater resilience was associated with lower posttraumatic stress symptoms and dissociation, and the relationship between them was fully mediated by depression. Conclusions : Specific aspects of depression may help explain the relationships between resilience and posttraumatic stress symptoms and dissociation. Tailored prevention programs and treatments based on resilience and depression may prevent posttraumatic stress symptoms and dissociation in firefighters and improve treatments outcomes among firefighters with posttraumatic stress symptoms and/or dissociation.

종합병원 외래진료부문 정신건강의학과의 공간구성 및 이용현황에 관한 연구

Purpose : This study examined the social and environmental change in the outpatient department of psychiatry, were analyzed disease characteristics and using characteristics of the mental illness. Thus, this aims to provide a material that can be used for efficient spatial composition of psychiatry. Methods : This study was conducted through a literature review, observation surveys, interviews. Results : Psychiatry is aware of the need to respond to the current needs of ambulatory space, there are concerns that the spatial configuration for your needs. In accordance with the results of studies conducted are as follows: 1) Specialty care programs and space needs based on segmentation and specialization of the disease 2) Considered in conjunction with the layout of essential space and other departments 3) Spatial composition and furnishings for characteristic of psychiatry 4) Spatial configuration taking into account the patient``s characteristic. Implications : This study looked at the change of social change and the environment related to psychiatry. Grasp the present state of spatial composition in psychiatry. And the use characteristics of patients and guardians were investigated. Meanwhile, studies of psychiatric outpatient department is still lacking. As a result, its significance is to analyze the spatial composition requirements.
