형사법정에서 프리젠테이션의 유형에 따른 법적 근거와 한계

With the new system of civil participation in criminal trials gets in place, it looks like legal presentations will see their rise as a method of nonverbal communication. Civil participation in criminal trials means a major shift in finder of facts. Prosecutors, now with the burden to persuade the lay people instead of professional judges, should pay attention to this shift. Lawyers also have to find better ways to persuade the juries themselves, since they cannot rely on the judge’s intervention forever. However those legal presentation should strictly play its role as audiovisual aids, since overextensive use of detailed presentation materials is likely to misled the juries. This thesis concerns how the legal presentations are used and regulated in the United States. Legal presentations are brought to attention by the 1975 case of Connecticut v. Skakel. In this case, it is held that the defendant’s right to fair trial was not compromised, when the prosecution used audiovisual materials in the closing argument. Presentations can be classified into three categories : 1) the most simplistic form which summarizes the facts or evidences, 2) more detailed form which provides extensive information and explanations, and 3) animations and simulations. The ones which fall into the first and the second categories can hardly raise problems. However for simulations, it is regarded as submitting a new evidence which will require examination process. These demonstrative evidences are regulated by two factors ; 1) exclusion of evidence on the grounds of prejudice, or confusion etc., 2) requirement of authenticating or identifying an item of evidence. Here in Korea, legal presentation is not a topic that is much discussed yet. However it is becoming more necessary to discuss about its regulation and limitation for the each stage of criminal procedure. Also a quick legislative action is required. 새로운 국민참여재판의 활성화를 앞두고 비언어적 표현 기법의 하나로서 파워포인트 등 가시적인 법정 프리젠테이션이 활성화 될 것으로 보인다. 국민참여재판은 사실인정 주체의 변화를 가져온다. 그동안 직업법관에 대한 설명책임에서 배심원을상대로 한 설득 책임을 갖게 된 검찰로서는 이러한 사실인정 주체의 변경에 주목하지 않을 수 없게 되었다. 변호인도 마찬가지다. 언제까지나 법관의 직권주의적 보충질문에 만족할 수는 없고, 직접 배심원에 대한 설득기법을 연구하지 않으면 안 된다. 이러한 프리젠테이션은 보조적 수단에 그쳐야 하며, 너무 상세하고, 과도한 사용은 오히려 배심원들로 하여금 초점을 흐리게 할 수 있다. 본 논문에서는 주로 미국 법정에서의 프리젠테이션 운영실무와 법적 규제에 대해서 살펴보았다. 미국에서 최초 화제가 된 사건은 1975년의 Connecticut v. Skakel 사건으로, 검사가 최후변론을 하는 동안오디오비쥬얼장치를 사용한 것은 공정한 재판에 대한 피고인의 권리를 침해했다는 피고인의 청구를 기각하였다. 프리젠테이션에 대해서는 크게 1)사건의 개요나 증거의 요지 등을 간단히 정리한 기초적인 형태에서,2)설명을 가하거나 상세화면을 제공하는 등 약간의 변형을 가한 형태, 3)애니메이션이나 시뮬레이션의형태까지 다양하다. 이에 대해서는 1) 2)유형과 3)유형 중 애니메이션에 관한한 큰 문제가 없을 것으로 보인다. 다만 3)유형 중 시뮬레이션의 형태는 새로운 증거의 제출로서 증거조사 절차를 거쳐야 한다. 전시증거에 대해서는 미국에서 1)부당한 영향을 줄 수 있는 증거의 배제와 2)증거사용의 정당성 요건에 의한 법적 규율을 요구하고 있다. 우리나라에서는 이에 대한 논의가 거의 없는 상태이다. 모두진술의 단계에서부터 증거조사, 최후변론에 이르기까지 단계별로 법적 규율과 허용한계에 대해서 논의가 활성화되기를 기대해 본다. 이에 대한법적 규율도 조속히 마련되어야 한다.
