최근 행정소송법 개정과 관련하여 의무이행소송의 도입여부가 논의되고 있다. 의무이행소송의 도입은 권리구제를 위한 절차법으로서의 현행 행정소송법의 불완전성을 극복하는 한편 실효적인 권리구제를 실현하는 첩경이 될 것이다. 의무이행소송은 종래 많은 오해를 받아온 것처럼 결코 권력분립의 원칙과 충돌을 일으키지 않는다. ‘사건의 성숙성’이라는 도구를 통하여 의무이행판결을 할 수 있는 경우와 지침판결을 할 수 있는 경우가 구분됨으로써 법원이 행정청의 재량권행사를 갈음하는 것이 회피된다. 나아가 의무이행판결은 취소소송과 같은 형성력을 갖지 않으며, 강제집행의 수단으로 직접강제가 인정되지 아니한다. 이로써 권력분립의 원칙을 훼손할 가능성을 제거할 뿐만 아니라 오히려 행정에 대한 적절한 배려까지를 한다. 의무이행소송이 도입될 경우 신속하고도 발본적인 권리구제, 판단기준시점의 변화와 심판범위의 확대에 따른 판결의 적정성 및 실효성 확보, 심판범위명료화에 따른 처분의무 내용의 명확성 강화, 가처분 제도의 도입이 가능하게 됨으로써 생겨나는 가구제의 강화 등의 실익이 있게 된다. 또한 의무이행소송의 도입은 거부처분취소소송과 부작위위법확인소송을 갈음하는 새로운 소송유형의 창출이라는 범위를 넘어서 직권주의로의 심리원칙의 확실한 전환, 가처분 제도의 도입, 다른 소송유형 및 소송물 개념의 재구성의 필요성, 행정처분 개념의 새로운 정의의 필요성 등 행정소송법의 골격을 형성하는 부분들에 대하여 직접적이고도 결정적인 영향력을 미친다. 따라서 행정소송법 개정 논의 역시 각 주제별로 분리되어 논의될 수 없고, 전체가 유기적인 관계에서 검토되어야 할 것이다.

중학교 체육교사의 진성리더십이 교사신뢰 및 수업만족에 미치는 영향

Purpose: This study tried to identify the effects of middle school physical education teacher’s authentic leadership on teacher trust and class satisfaction. Method: To achieve this research purpose, 628 samples were selected for middle school students in Busan Metropolitan City using the convenience sampling method, and 562 of them were finally used for analysis, excluding 66 copies, which were deemed unfaithful. The questionnaire used in this study consisted of a total of 38 questions, including 16 questions on authentic leadership, 15 questions on teacher trust, 4 questions on class satisfaction, and 3 questions on personal characteristics, all using the Likert 5-point scale to maintain consistency in response results. Using the IBM SPSS Statistic 25 program, the reliability and validity of the survey were verified through frequency analysis, exploratory factor analysis, Cronbach’s α coefficient and correlation analysis. Results: First, it was found that the authentic leadership of physical education teachers had a positive effect on teacher trust. Second, it was found that physical education teacher’s authentic leadership had a positive effect on class satisfaction in part. Third, it was found that middle school student’s trust on teachers had a positive effect on class satisfaction. Conclusion: The results of this study indicate the importance of sincere behavior shown by physical education teachers. If the physical education teacher builds a trusting relationship with the students through genuine leadership and has a positive perception of the class, the effectiveness of the physical education class can be increased.

This paper deals with the development method of finite element analysis for fatigue lifetime prediction of a braided wire under banding load condition. Recently, the proportion of importance about NVH is increasing in the automotive. To meet these needs, normal wire used for ground of engine and transmission was changed to braided wire that has excellent flexibility and durability. In case of used ground wire at engine or transmission is influenced banding load by repeated engine rolling. braided wire may be broken by these banding load. Therefore, To improve problem of design beforehand, developed fatigue simulation method for prediction of fatigue lifetime of braided wire under banding load condition.

본 연구는 인공지능(AI)를 초등학교 저학년 한글 교육에 활용하고자 개발된 프로그램이다. 초등학교 저학년 학생이지만 간단하게 직접 코딩을 하여 인공지능을 만들 수 있는 경험을 하도록 개발하였다. 이러한 경험을 통해 학생들의 자존감을 향상시키고, 인공지능을 더 쉽게 이해하고 인식할 수 있을 것이다. 나아가 학생들이 코딩한 프로그램을 한글 교육에 활용하여 학생들이 스스로 한글 공부를 할 수 있도록 하기 위하여 프로그램을 개발하였다. This study was developed to use artificial intelligence (AI) for lower grade korean language education in elementary schools. Although he is an elementary school lower grade student, he developed the experience to create artificial intelligence by simply coding himself. This experience will improve students" self-esteem and make it easier to understand and recognize artificial intelligence. Furthermore, the program was developed to allow students to study korean language on their own by using coded programs for korean languege education

T'he electrical insulative life of cross-linked polyethylene used as an insulating material in power cable is predicted in this paper. The experiment is progressed velocity theoretically. In this experiment, supplied experimental voltage under the condition of equivalent temperature, and then Arrhenius equation is applied. To get the span of life vs. temperature characteristics, the relation between the logarithm value of life and the reciporical of temperature are extended as a straight line, after that the span of life is predicted. In case of raising the temperature of sample linear type, to get the breakdown temperature vs. raising velocity of temperature characteristics, after developed the Arrhenius equation a little more, Predcted the span of life about cross-linked polyethylene semi-theoreticalliy. The results of this experiment are as follows: 1) The experimental values for the prediction of the span of life between at the case of equivalent tamperature and variable temperature are a little different. 2) The phenomenon of insulation breakdown which is based upon Tree breakdown can get by ineans of the velocity theory. 3) To get the life characteristics, the velocity theory is applied, The theoretical values and experimental values are aimost equal. Therefore, the propriety ut above method is confirmed
