        체육수업 안전사고 소송 이해와 활용을 위한 인권 감수성 중심의 판례평석

        The purpose of this study is to reinterpret the issues of accidents and lawsuits in physical education (PE) class safety accident precedents, focusing on the education subjects’ human rights sensitivity, and to understand and utilize knowledge of safety accident civil litigation in PE classes in the future. Studies established the QUOROM-type flowchart as a systematic reviews method, and reinterpreted the review of precedents in 4 stages. The findings are categorized into: i) The core of the PE class safety accident lawsuit is illegal acts and causality, and the PE teacher is responsible for guiding precautions and taking measures, and students and parents' cases are for proof, ii) PE teachers can use the Teacher Status Act and the National Compensation Act and students and parents' cases can use the information disclosure claim system and the School Safety Act, and iii) In the process of legal disputes over safety accidents in PE classes, it is required to establish a comprehensive educational human rights sensitivity to understand each educational subject. Drawing on the findings and discussion, The necessity of various types of case studies on safety accidents in PE classes and research on the human rights sensitivity of each educational subjects by school level is suggested. 본 연구의 목적은 체육수업 안전사고 판례에 나타난 사고와 소송의 쟁점 사안을 교육 주체의 인권 감수성 중심으로 재해석하여, 향후 체육수업 안전사고에 관한 민사소송 지식을 이해하고 활용하는 데 있다. 이를 위해체계적 문헌 분석 방법으로 연구물을 수집해 QUOROM형 흐름도를 구축하고, 판례평석 4단계(사안, 쟁점, 결정 요지, 분석)로 재해석했다. 연구결과는 첫째, 체육수업 안전사고 소송의 핵심은 불법행위와 인과성으로체육교사는 주의사항 안내와 조치, 학생과 학부모는 증명책임이었다. 둘째, 교육 주체별 소송의 이해와 활용에 필요한 법적 전문역량은 체육교사는 교원지위법과 국가배상법, 학생과 학부모는 정보공개청구제도, 학교안전법으로 나타났다. 셋째, 체육수업 안전사고의 법적 분쟁 과정에서 각 교육 주체를 이해하는 종합적인 교육적 인권 감수성의 확립이 요구된다. 연구결과 및 논의를 바탕으로 체육수업 안전사고에 관한 다양한 유형의판례 연구 및 학교급별 교육 주체의 인권 감수성에 관한 연구의 필요성을 제안했다.

        강원도 북부 지방 초가의 건축적 특성에 관한 연구 - 고성 왕곡마을을 중심으로 -

        우리나라 한옥은 지붕재료에 따라 크게 와가, 초가, 너와, 굴피집으로 구분할 수 있다. 초가는 지방 특색에 따라 재료, 경사, 모양, 잇기 방법이 다양하다. 그러나 산업화로 초가가 급속히 감소하여 이러한 특성을 보기 어려운 실정이다. 본 연구는 북부지방의 초가의 건축적 특성을 알고자 한다. 그래서 북부지방에 지정된 고성왕곡마을을 조사 대상으로 선정하 였다. 연구는 종합정비 및 지정 자료를 기반으로 현장조사, 전문가 및 주민 인터뷰를 통해 특성을 조사 분석하는 방법으로 하였다. 본 연구 결과 왕곡마을의 가옥의 지붕재료는 와가보다는 초가의 비율이 높았다. 그리고 평면은 좌우 돌출형과 겹집형이 다 수를 차지하고 있으며 정지와 마루 사이에 칸막이벽이 없었다. 또한 전면의 개구부는 출입을 위한 것이 아닌 채광과 통풍 기능을 담당하는 북부지방의 특성을 가지고 있었다. 이러한 고성왕곡마을 초가는 현지조사를 통해 원형특성을 회복할 수 있는 건물의 비율이 높게 나타났다. Korea’s traditional hanok houses are roughly divided into tiled-roofed, thatched-roofed, shingle-roofed, and oak bark-roofed houses according to their materials. In thatched-roof houses, there are various styles according to regional characteristics regarding building materials, slope, shape, and tying method. Unfortunately, as the number of thatched-roof houses have been rapidly decreasing since industrialization, it is difficult to find these characteristics of traditional houses. The study revealed that there was a roofing material a higher percentage of houses with thatched roofs than houses with tiled roofs. Furthermore, the plane occupies a large number of left and right protruding types and layered types, and there is no partition wall between Jeongji and maru. In addition, the opening in the front has characteristics of the Northern region that is responsible for lighting and ventilation, not for access. In the case of thatched-roof houses in Goseong Wanggok Village, the field survey suggests that a high percentage of buildings can recover their original characteristics.

        전기 낭만주의의 이념적 사유공간 : 독일이상주의와의 연관하에서

        In der deutschen ldeengeschrchte hat sich das Krisenbewusstsein als Selbstregulierungsfahigkeit ausgepra¨gt. Je intensiver eine Auseinandersetzung init dem jeweiligen Zettbewusstsein erfolgt, desto gro¨ßer wird die Wahrscheinlichkeit eines Aufschwungs zu einer neuen, beaseren Zeit sein, Dies ist im elgentlichen Sinne dcs Works 'Krise', d.h. im Sinnzusammenhang einer 'entscheidenden Wendung' besser zu verstchcn, Die entscheidende Wendung einer Zeit zur anderen ha¨ngt davon ab, wie intensiv man sich rnit den krrsenhaften Pha¨nomenen auseinandersetzt, In der vorliegenden Arbeit geht cs darum, aufgrund zweier grundlegender Typen solchen Krisenbewusstseins, d.h. des Hegelschen und des Ho¨lderlinschen, einen Denkraum hervortreten zu lassen, in dem die Fru¨hromantik und der deutqche ldealismus ineinander gehen. Der eine davon bezieht sich auf ein Denken des Werdens, das Hegel in einer Form der Erfahrung der selbstbereichernden Selbstenta¨ußerung des Begriffs ausfonnuliert hat, und der andere auf ein a¨sthetisches Denken, das bei Ho¨lderlin darauf abzielt, ein absolutes Prinzip der urspru¨nglichcn Harmonie zugrunde zu legen, die bereits in sich artikuliert ist. Diese zwei gedanklichen Hauptfa¨den entfalten sich je nach Problembewusstsein bei den Fru¨hromantikern und den deutschen Idealisten in verschiedener Form. Be1 Novalis steht die absolute Gegenwart im Vordergrund seines Denkens, die nicht als eine Harmonie oder eine Einheit, sondern als eine absolute Aufgespanntheit aufzufassen ist. Den so a¨hnlichen, aber originelfen Schluss zieht Schlegel, indem er wirkliches und lebendiges Ur-Ich zu konstruieren versucht, das "unendlich perfektibel" eneicht werden kann. Schließlich koha¨sicren all diese Versuche auf den Ho¨lderltns, der auf 'Nur Seyn' als etwas vorga¨ngig Einigcs gerichtet ist. Diese Formrn des gedanklichen Problembewusstseins der Romantiker stehen im gleichen Horizont niit denen der deutschen Idealisten. Diese Philosophen, zu denen Fr. H. Jacobi, Hegel und Schelling geho¨ren, teilen eine Grundidee miteinander, die darin besteht, dass vor deni Denken etwas Vorga¨ngigets angenoinnien werden soll, worunter man das Dasein oder die Substanz als das sehon Vorliegende versteht. Diese Formen des Problembewusstseins der Fru¨hromantiker kommen durch eine je eigene Methode in Gang, d.i. die Theorie der Lebenskraft bei Novalis, den Ideal-Realismus bei Schlegel und die Philosophie des Werdens bei Ho¨lderlin. Auch die deutschen Idealisten, die im a¨hnlichen Problenibewusstsein wie jenen stehen, entwickeln eine absolute Methode, mit der eine urspru¨ngliche All-Einheit konstituiert wird, indeni das Selbstentfalten der Reflexion und das Zuru¨ckgehen derselben auf sich selbst ineinander gehen. Aus der kritlschen Analyse des modernen Selbstbewusstseins bei den Fru¨hromantikern und den deutschen Idealisten konnte em typologischer Denkrahmen herausgearbeitet werden, mit dem man sich eines zeitgemaßen Krisenbewusstseins und darin der Selb5tidentlla¨t versichert. Der Kerngedanke dieses zeitlich auf eine bestimrnte Zeit nicht zu beschra¨nkenden Denkrahmens besteht darin, dass eine Meenrevoltition um so wahrscheinlicher wird, ko¨nnte auf das Problembewusstsein u¨ber die Gegenwart als ein Akkuniuliertes der Tradition je tiefer und konzentrierter einzugehen sein. ln diesem Sinne kann diese s.g. Ideenrevolutiun keineswegs eklekttztstisch verstanden werden. Denn die Versuche der Fru¨?hronrantiker und der deutschen Idealisten Find voni vorga¨ngigen Emhertsgrund des Wirklichen und des Ciedanklichcn ausgegangen und gelten im demselben Sinne fu¨r uns heute immer noch.

        민속마을 초가이엉 잇기에 필요한 볏짚 수급방안에 관한 연구

        There are 7 traditional folk villages that are designated as a cultural asset in Korea. There are many houses whose roof are covered with the rice straws. They have problems to manage their roofs of the houses, especially the supply of their materials. Because they are disposable and their height are mainly changed to short nowadays than before. So this study is carried out to find the way of supply their materials to manage their roofs and find what the proper breed of rice is. The subject of this study are the seven designated folk villages. The method of this study is investigated theoretically, surveyed in the field and interviewed to the related scholars, local residents, folk communities and local government officials. And they are analyzed and synthesized. The conclusion of this study are as followings: 1. The house covered with rice straw roof in the designated folk villages are nearly half. The materials of the roof – rice straw are supplied by the resident’s cultivation or contact cultivation now. But there are problems in supplying those materials owing to the improving of rice breed, mechanization in agriculture. 2. It is concluded that the proper length of the rice straw will be over 84cm. These kinds of the rice breed are investigated as Chujeong, Jungan, Samkwang, Samkwang 2, Dacheong, Joil and Hanareum 3. And Mokwoo, Cheongwoo and Mokyang are usable. 3. The supply of these rice straw will be offered by the cultivation of the residents in the village, the way of contact cultivation, that of government- furnishing and that of market economy principles. The cultivation site will be used to unused land and those of national owned lands. They will cultivated for the landscape scenery and will be cultivated as the production of tourism. And the study of the method of their storage, that of life extension and that of tourism production will be carried more.
