        보험사기죄 신설에 관한 고찰

        Insurance protects individuals from causing economic risks of future risk. It has a positive role and function that can maintain a stable life.         소멸시효에 관한 입법론적 제안

        자율주행자동차 보험사기에 관한 고찰

        현재 자동차보험사기는 매년 증가하고 있고, 자동차 보험사기의 유형은 여러 가지가 있다. 다가오는 2020-2040년에는 자율주행자동차 상용화 시대에 접어든다. 기존의 자동차와는 달리 자율주행자동차는 최첨단 IT기술인 소프트웨어가 운행을 직접·간접적으로 관여하여 스스로 자율적으로 주행한다. 따라서 자율주행자동차 시대에는 교통사고감소와 함께 보험사기가 사라질 것이라고 전망되고 있다. 그러나 자율주행자동차 보험사기가 사라질 것이라는 전망에 의문을 제기하고 싶다. 이른바 자율주행자동차의 소프트웨어 해킹을 통한 보험사기가 출현할 것이라고 예측한다. 여기에는 해커를 매개체로 하여 현재의 보험사기와는 다른 형태로 발생된다. 이러한 자율주행자동차 보험사기는 소프트웨어 해킹을 통하여 이루어지므로 전문·조직화된 조사·수사기관이 부재하면 보험사기를 입증하기에는 난해한 점이 있을 수 있다. 또한 관련 보고서에 따르면 자율주행자동차 1건의 보험사기는 기존 자동차 10건의 보험사기보다 보험회사의 재정을 상당히 악화시킬 우려가 높다고 예상하고 있다. 자율주행자동차 사고원인의 불분명으로 인하여 기존의 자동차사고보다 보험금이 지체될 수 있어 피해자 보호에 소홀히 할 수 있다는 문제점이 제기되고 있다. 이에 대하여 입법정책적 대안으로 자율주행자동차 사고로 인한 피해자 우선 보호를 위해 노폴트(No Fault) 보험제도를 도입하여야 한다는 견해가 제기되고 있다. 다수 선의의 피해자 보호를 위한 노폴트(No Fault) 보험제도가 자율주행자동차 보험사기범들에게 보험금을 쉽게 지급받을 수 있도록 악용되는 면도 있다. 그러므로 노폴트(No Fault) 보험제도 도입에 선행되어야 하는 것은 소프트웨어 해킹의 매개체인 해커를 조사·수사할 수 있는 인력과 제도이다. 마지막으로 미래의 자율주행자동차 보험사기를 입증하기 위해서는 전문·조직화된 첨단 전문가 등을 관련기관에서 양성할 필요가 있다고 생각한다. 향후 보험사와 제조물책임회사가 통합하여 자율주행자동차 보험사기에 대한 일원화·조직화·신속화·첨단화된 조사·수사체계를 갖추는 것이 보험사기 적발에 효율적이라고 생각한다. 또한 보험사기로 소모되는 사회적 비용에 대한 손실을 절감할 수 있다고 생각한다.         게임산업발전을 위한 셧다운제도의 법정책적 재고

        2011년 11월 20일부터 16세 미만의 청소년에게 심야시간의 인터넷 게임 제공을 제한하는 제도인 강제적 셧다운제가 시행되었고(청소년보호법 제26조 제1항), 2012년 7월부터는 만 18세 미만인 게임 이용자 부모나 법정대리인이 원할 경우 해당 이용자가 특정 시간에 게임에 접속하는 것을 게임사가 의무적으로 차단하는 제도인 선택적 셧다운제가 시행되었다(게임산업진흥에 관한 법률 제12조3). 이러한 셧다운제는 헌법상 권리 침해, 개인정보법의 침해, 게임산업법과의 중복 규제면에서 논란의 대상이 되었다. 2011년 10월에 셧다운제에 대하여 헌법소원이 제기되었고, 2014년 4월 헌법재판소는 16세 미만 청소년에게 오전 0시부터 오전 6시까지 인터넷게임의 제공을 금지하는 이른바 ‘강제적 셧다운제’를 규정한 청소년보호법의 헌법에 위배되지 않고, 인터넷게임 제공자의 직업수행의 자유, 16세 미만 청소년의 일반적 행동자유권, 부모의 자녀교육권을 침해하지 않고, 다른 게임과 달리 인터넷게임만 규제하고, 해외 게임업체와 달리 국내 게임업체만 규율함으로써 평등권을 침해하지 않는다고 합헌결정을 내렸다. 이처럼 헌법재판소의 합헌결정에도 불구하고 시민단체와 게임업체에서는 셧다운제를 폐지하자는 여론이 가시지를 않고 있으며, 여야의원들간에도 셧다운제에 대한 주장이 분분하여 셧다운제를 더욱 강화하자는 법안과 폐지하자는 법안이 국회에 계류 중인 상태이다. 헌법재판소의 결정과는 달리 셧다운제가 최상위 법률인 헌법에 위헌의 소지가 남아 있고, 현재 박근혜 정부의 전체적인 규제완화 정책과의 통일성과 균형성에 위배된다고 본다. 또한 해외 각국은 국가가 직접 나서서 게임을 제한하는 셧다운제를 시행하는 경우는 거의 없다. 이처럼 헌법의 정신에 위헌의 소지가 있고, 규제완화 정책과의 불균형을 이루어 게임산업 성장에 저해를 가져오므로 법률을 폐지하던가 폐지하는 것이 입법부에 상당한 부담이 된다면 개정하는 방향으로 나아가는게 바람직하다고 생각한다. 마지막으로 게임산업성장을 위해서는 셧다운제의 폐지만이 문제가 아니라 게임산업 관련 기업들도 기업 이미지 개선을 위해 인터넷게임의 중독에 대한 예방과 관리 · 보호 · 감독을 하여 사회적 책임을 다해야 한다고 생각한다. 더불어 게임도 한 국가의 문화이며 국가경쟁력이므로, 게임산업에 대한 전반적으로 총괄하는 컨트롤타워기관이 있었으면 한다. 따라서 게임활성화와 규제 등 관련된 모든 것을 총괄적으로 담당할 게임컨트롤타워기관을 두어 통합적인 법규와 제도로 게임활성화와 규제제한 등을 다시 논의할 필요가 있다고 제안한다.       • ‘낙태죄’ 헌법불합치 결정에 따른 입법적 개선에 관한 연구

        헌법재판소는 2019년 4월 11일 형법 제269조 제1항(자기낙태죄), 제270조 제1항(동의낙태죄) 규정과 관련한 헌법소원에서 헌법불합치의견 4인, 합헌의견 3인, 위헌의견 2인으로 헌법불합치결정을 선고하였으며, 이에 2020년 12월 31일까지 국회에 대하여 현행 ‘낙태죄’ 규정에 관한 입법적 개선할 필요가 있다고 주문하였다. 하지만 개선 입법이 마련되지 않은 상태에서 위 조항들은 2021년 1월 1일 해당 규정의 효력은 상실하였으며, 현재까지 후속입법의 미비로 인하여 입법적 공백이 지속되는 상태이다. 이러한 가운데 2022년 6월 24일 미국 연방대법원에서 Dobbs vs. Jacson 판결이 내려짐에 따라 2019년 헌법불합치결정의 판단의 근거의 자료로 활용된 미국 Roe v. Wade 판결이 폐기되는 전환점을 맞이하게 된다. 2019년 헌법불합치 결정 이후 입법적 공백이 지속되고 있는 상황에서 미국 판례의 변화는 낙태 관련 법제 정비에 일대 혼란을 가져다주고 있다. 이에 2019년 헌법재판소의 헌법불합치 결정의 기준이 된 미국 Roe v. Wade 판결의 폐기, 입법적 공백은 우리 사회 모든 구성원에 던져진 과제이기도 하다. 2019년 헌법재판소 헌법불합치 결정에서는 임신한 여성의 자기결정권과 태아의 생명권 양 보호법익을 대립적인 구도가 아닌 특수한 관계로 보았으며, 실제적인 조화와 균형적인 측면을 강조하였다. 또한 임신한 여성의 자기결정권 보장과 관련하여 낙태허용기간, 사회적·경제적 사유 등의 사항을 명시하였는데, 이는 동시대를 사는 사회구성원인 우리에게 많은 질문을 던져주고 있다. 본 논문에서는 현재 논의되고 있는 다양한 문제를 입법체계적 측면으로는 1. 형법상 낙태죄 규정의 존치에 관한 논의, 2. 형법·모자보건법 낙태 관련 규정 편입 체계에 관한 논의에 관한 쟁점사항을 살펴보고, 입법기술적 측면에서는 1. 낙태 허용기간에 관한 논의, 2. 낙태 허용사유에 관한 논의, 3. 낙태 시술 절차에 관한 논의, 4. 약물 낙태 허용에 관한 논의에 따른 쟁점사항을 살펴봄으로써 낙태 관련 법제를 정비하는 데 해법을 강구하고자 한다. Accordingly, the U.S. Roe v. The repeal of the Wade decision and the legislative vacuum are challenges faced by all members of our society. No one will be able to deny that the Constitutional Court’s decision in 2019 that it was unconstitutional was made after a long period of social discussion and pains. In the 2019 Constitutional Court decision on constitutional incompatibility, the legal interests of protecting both a pregnant woman’s right to self-determination and the fetus’s right to life were viewed as a special relationship rather than an antagonistic structure, and emphasized practical harmony and balanced aspects. In addition, in relation to guaranteeing a pregnant womans right to self-determination, matters such as the abortion period and social and economic reasons were specified, which raises many questions for us as members of society in our contemporary lives. In this paper, we look at various issues currently being discussed in terms of the legislative system: 1. Discussion on whether abortion provisions should remain in the Criminal Act; 2. Discussion on the system for incorporating abortion-related provisions into the Criminal Act and Maternal and Child Health Act; In terms of legislative technology, we are reorganizing the abortion-related laws by looking at issues related to 1. Discussion on the period for allowing abortions 2. Discussion on reasons for allowing abortions 3. Discussions on abortion procedures 4. Discussions on allowing medical abortions I would like to draw implications.
