eUCP 11조의 잠재적 하자의 규명과 합리적 개정방안의 모색

  This study analyzes some important implications for the forthcoming revision of eUCP through the methodology of expected utility maximization theory. The overall results are as follows. First, beneficiary with an initial wealth has a risk-averse utility in traditional letter of credit transaction, and he would be more risk-averse in eUCP transaction. Secondly, the beneficiary who has risk-averse utility will pay for the risk premium to reduce the risk of corruption of an electronic record by means of cost of loss reduction activities. Thirdly, the cost of loss reduction activities is represented by a convex cost function, Fourthly, a risk averse beneficiary pursues loss reducing activities to the point where the expected marginal product of loss reduction is less than its marginal cost. Fifthly, a more risk-averse eUCP beneficiary will always select a higher level of loss reduction as long as the effectiveness of loss reduction is certain. Sixthly, when the effectiveness of loss reduction is uncertain, the more risk-averse eUCP beneficiary does not necessarily choose a higher level of loss reducing activities. Finally, it would be more reasonable that eUCP Article 11 should protect eUCP beneficiary who pursues a higher level of loss reducing activities.

The purpose of the introduction of this article is as follows. It was frequent to put a condition on the letter of credit without stating corresponding document. But these attempts are very dangerous to the letter of credit operation. That is, if these types of conditions would be permitted in letter of credit, the independence principle must be collapsed. So these conditions must be disregarded in order to safeguard the independence principle. It is why UCP600 article 14(h) writes that if a Credit contains a condition without stating the document(s) to be presented in compliance therewith, banks will deem such conditions as not stated and will disregard it. But scope of this article 14 should not be limited by the conditions which do not state the document to be presented in compliance therewith. That is, the purpose of this article is to preserve the independence principle, so, if it is impossible to ascertain satisfaction with a condition, it should be disregarded as the non-documentary condition, even if the condition is included in the letter of credit together with document to be presented. Conclusively, whether or not a condition would be regarded as the non documentary condition depends on whether compliance of such condition is ascertained by presented documents stipulated in the letter of credit.

진공흡착공정을 이용한 자동차 내장부품의 표피재 접착기술에 관한 연구

본 연구는 자동차 내장 부품에서 표피재에 열을 가하여 금형내에서 엠보싱을 생성하는 새로운 압착방법을 제안한다. 엠보싱 무늬가 없는 표피재를 상부 금형에서 진공으로 흡입시켜 흡입력에 의하여 무늬를 성형한 후 금형 을 닫아 사출물에 압착시키는 가열 압착 공법으로 엠보싱 무늬의 손상을 방지할 수 있다. 이 검증실험을 위하여 금 형과 시험장치를 개발하여 시작품을 제작한 후 실험을 통하여 성능을 분석 평가하였다. This study proposed the new pressing method under heat for the plastic automotive interior part in order to make embossing on the skin of the raw material of the part. The raw material is laid on the lower mold and it is pressed by the upper one with embossing shape. The air is suctioned from the inside of both molds for producing tension and making embossing shapes on the skin of the part without its breakage. The corresponding molds and test machines are made and the proposed manufacturing process is validated.

This article focuses on the analysis of Sundays Children (Sonntagskinder) by Gerlind Reinshagen, the only women playwright of the seventies and eighties to be successful on the German stage which was hostile to the female playwrights and directors. By focusing on the everyday life of ordinary people in the Third Reich, the drama reveals the structure of ideological background and identity of fascistic German society. Reinshagen brings the role of housewives into focus, who were regarded as innocent of a crime during the Nazi era. She depicts the housewives of this era as one who functions consequently as an active supporter of the system by internalizing the slogans and ideology of the Third Reich without any critics, and by influencing the children through their socialization with the fascistic ideology. The children are forced to obtain the identity the system requires, and their languages and emotions are controlled, their dreams and fantasies are forbidden as abnormity. Reinshagen`s critics concentrate most of all on the opportunistic and pragmatic attitude of the people, who supported the NZ regime as a result of their political unconsciousness and opportunism. She criticizes that the smooth transition between Third Reich and the Postwar German society implies the outlook for the same materialism and the same pragmatic attitude of the people without any reflections or critics on their past.

신용장거래관습 최적편성방안의 모색

UCP 600 Article 14(b), providing rules for the period of the examination of documents, is a radical reorganization of UCP Article 13(b). The provision changes the period of time to a maximum of five banking days instead of reasonable time. One of the critical problems giving rise to the difficulty in interpretation and application is the question of fact that there may be two possible conflicting options in determining the time of checking documents presented. The one doctrine is fixed time(safe harbor) standard, and the other is hidden reasonableness standard. This study analyzes which option should be adopted for the optimal application standard by welfare effect methodology using consumer surplus approach and suggests that safe harbor standard should be optimal solution to the determination of period of examination of documents presented in letter of credit regime.

도로 배수용 그레이팅 구조의 개선에 관한 연구

그레이팅은 아스팔트 도로에 설치하여 배수를 할 수 있는 구조물이다. 본 논문에서는 그레이팅의 구조를 개 선하여 토사의 쌓임을 방지 할 수 있는 신제품을 제안한다. 기존 제품은 프레임에 오물이 쌓여 있어 평상시 해충이나 악취가 발생하며 우천 시 배수가 원활하지 못해 물이 고이는 현상도 빈번할 뿐 아니라 역류하는 현상이 발생한다. 또 한 기존 그레이팅이 프레임과 본체를 일체형으로 설치하여 파손 시 전체를 교체하여야 하는 단점이 있다. 본 연구는 그레이팅 본체와 프레임을 분리시킨 구조로 프레임을 멘 홀에 시멘트와 함께 기초공사 하여 고정한 후 그레이팅 본체는 장착탈이 가능한 구조로 개발하였다. 또한 분실 방지용 지그도 설치하여 이를 개선하였다. Grating is an installed structure on the road for drain. This paper proposes a new product which can prevent the accumulation of earth and sand through the improvement of Grating structure. There were usually harmful insects and bad smell because of accumulated garbage in the frame of previous product. The product had a reverse-flowing sewage due to the bad draining in case of rain. The whole thing of the existing Grating installed with the one set of frame and main body should be changed when it was damaged. This study is to develop a structure which can separate grating main body from frame and grating main body can equip and separate after fixing frame to the manhole with cement. also install jig for the loss prevention and change for the better.

지역사회에서 사회공헌활동이 기업 브랜드 이미지에 미치는 영향

본 연구는 지역사회에서 사회공헌활동이 기업 브랜드 이미지에 어떠한 영향을 미치는가를 알아보기 위해 삼성전자가 위치한 수원 지역 주민을 대상으로 한 설문을 분석한 것이다. 분석내용은 지역사회에서 삼성의 사회공헌활동에 대한 지역주민의 인지, 평가, 삼성에 대한 호감도, 삼성제품에 대한 행동 의도의 요인들이며, 이를 위해 수원 삼성전자 지역주민을 대상으로 2014년 3월15일~3월30일까지 15일간 300부의 설문을 배포하고 신뢰성이 떨어진다고 판단되는 경우를 제외한 총 268부를 바탕으로 분석하였다. 그 결과 지역사회의 사회공헌활동에 대한 인지는 해당 사회공헌활동에 대한 평가에 긍정적인 영향을 미치는 것으로 확인되었으며 이러한 사회공헌활동에 대한 긍정적인 평가는 기업에 대한 호감도로 이어지고, 호감도는 제품의 구매의도와 추천의도에 긍정적인 영향을 미치는 것으로 나타났다. 한편 호감도에 의한 구매의도와 추천의도의 경우 구매의도보다는 추천의도에 더 강한 영향을 미치는 것으로 나타났다. 이러한 연구 결과는 지역사회에서 사회공헌활동이 기업 브랜드 이미지와 제품에 까지 영향을 미친다는 점을 시사한다. 이번 연구결과는 지역사회에서 사회공헌활동이 기업 브랜드 이미지에 미치는 영향 정도를 이해하는데 기초자료로 사용될 수 있을 것이다. The purpose of this study was to examine which influence the social responsibility activities in community has upon corporate brand image. Questionnaire was analyzed targeting local residents in Suwon where Samsung Electronics is located. The analytical contents include factors for local residents" cognition & evaluation on social responsibility activities, preference for Samsung, and behavioral intention of Samsung products. To do this, 300 copies of questionnaire were widely distributed from March 15, 2014 to March 30 for 15 days targeting local residents in Suwon Samsung Electronics. Analysis was made on the basis of totally 268 copies except a case of being judged to be dropped reliability. As a result, the cognition on social responsibility activities in community was confirmed to have positive influence upon evaluation on social responsibility activities. In addition, it was indicated that this positive evaluation on social responsibility activities leads to preference for enterprise and that this preference has positive impact on purchase intention and recommendation intention of products. Meanwhile, in case of purchase intention and recommendation intention according to preference, it was shown to have stronger influence upon recommendation intention than purchase intention. This finding suggests that the social responsibility activities in community has influence even upon corporate brand image and product. These findings will be able to be used as basic data in understanding influential level of the social responsibility activities in community upon corporate brand image.
