        Traditional, the marine(ocean) bill of lading(B/L) was made a major evidence documents of goods transport, under the contract of carriage by oversea. But, historically it has been many problem because of the Unknown Clause of Bill of Lading(B/L) under container carriage by rapid development of modern transport contrivance. According to, the purpose of this study is to survey the practical and legal characteristics of the Unknown Clause of bill of lading as traditional marine transport document. Especially, The important thing in this study is that the author put the stress on research and analyzes of the various problems which come to the Unknown Clause, which has been troubled in container marine transport between parties, particularly carrier and shipper under traditional B/L

      • 중국 전자서명법의 주요내용 및 평가와 전망

        China has recently (28 August 2004) adopted a new act legalizing the electronic signature. This new act provides electronic signatures with the same legal status as handwritten signatures, and states that on-line certification providers will have to be created in order to ensure the security of on-line operations made using said signatures. This new act is intended to increase Chinese electronic business, and thus to raise the revenue China can expect from said business. And the law grants electronic signatures the same legal effect as handwritten signatures and seals in business transactions, and sets up the market access system for online certification providers to ensure the security of e-commerce. As Internet trade requires a reliable third party to identify the signers, the credibility of online certifying organizations is significant for the transaction security. So, considering the weakness of China's social credibility system, the law regulates that the online signatures certification providers should be approved and administered by governments.

        The purpose of this paper is to study the current situations of trade financial EDI based on The BOLERO system, New BOLERO system, The NACCS system in Japan and The EDEN(Electronic DElivery Negotiable document) system and problems in application of marine insurance contracts. Entwined with the contracts of carriage in international sale transactions is a contract of marine insurance by which the goods are insured against maritime perils. In the thesis I tried to explain the problems of paperless marine insurance contracts based on problems in relating to formation of the transit insurance contract and replication the functions of the marine insurance policy electronically.

      • 최근 중국의 세관행정과 통관제도의 변화에 따른 중국내 한국기업의 대응방안

        In this study, I presented measures for Korean companies in China to respond to changes in customs administration and import and export customs clearance system recently introduced by Chinese customs. I believe this study will help Korean companies in China understand the recent changes in China's customs administration and customs clearance system. Korean companies in China have pointed out the problems of China's clearance system and import and export processes as lack of uniformity, transparency, and predictability, inconvenience, and inefficiency of import and export customs clearance. Under these circumstances, Chinese customs recently introduced an Advance Ruling System, The Corporate Credit Rating Management System of Chinese Customs, The Voluntary Disclosure System, and a Nationwide Customs Clearance System. The introduction of these systems will provide Korean companies in China with greater law enforcement uniformity, greater transparency in customs management, greater predictability of customs administration, simplification and efficiency of procedures and prevention of fraud. However, as the Chinese customs' post-examination and corporate investigation will be strengthened, Korean companies in China should try to avoid massive post-collection, reduce punishment and prevent a credit rating decline.         This paper will look into the Main Substance and Some Problems of 24 hours Advance Cargo Manifest Declaration Rule, focuses on the Policy implication of Korea's and counter measures of our parties concerned about 24-hour advance vessel manifest rule. The 24-hour rule requires cargo owners to submit cargo manifest information to U.S. Customs 24 hours before vessel sailing from the final foreign port to a U.S. port. Cargo manifest information must be complete, accurate, and timely. As of February 2, 2003 manifest information can be submitted by paper or electronically. Cargo descriptions must be at a level of detail consistent with Harmonized Tariff Schedule (HTS) codes used by U.S. Customs. HTS codes are 10 digits. Electronic submissions are made via the Automated Manifest System (AMS) run by U.S. Customs.

      • Situations and its Prospect of Single Window System for Customs One-Stop Service in Japan

        The purpose of the paper is to analyze situations and its prospect of Single Window System for custom's one-stop service in Japan and to suggest effective application was to improve of in Korea's Customs systems. In response to the growing demand for lower trading costs and shorter and more predictable lead times with the advancement of the international trade supply chain, the Single Window System for import/export and port-related procedures was launched on 23 July 2003 in Japan. The concept of the Single Window System is to establish a comprehensive computer interface system that enables users to complete all import/export and port-related procedures required under different laws and regulations in a single input and single transmission. To realize the concept, the data elements and submission times of the various systems were harmonized, and manual procedures, such as quarantine and immigration, were computerized. Then, all the necessary systems, such as NACCS, Port EDI System, and Crew Landing Permit Support System, were interconnected as a Single Window System. Close cooperation among other governmental organizations and the private sector was a key factor in the successful development and smooth utilization of the System so that it fully met all parties' needs. It is anticipated that operating costs will be greatly reduced and trade facilitation will be enhanced as a result of the simplification of procedures. Korea Customs advocates the Single Window System as a best practice at ASEAN and WCO to contribute to the development of regional and international capacity building.

      • 전자무역지원을 위한 개정 대외무역법회 내용과 문제점

        Years in preparation, the revised law on Foreign Trade Law of Korea came into effect on March 1, 2001, adopted at the Congress on June 17, 2000. The purpose of this Act is to contribute to the growth of the national economy by means of contriving to maintain the balance of international payments and to expand commerce, and through promoting foreign trade and establishing fair trade system. Particular, revised Foreign Trade Law of Korea shall be based on the general provisions on transactions of exports or imports and measures for promotion of electronic Trade. Because electronic trade is not bound by physical geography provides a fundamentally new way of conducting commercial transactions, therefore Korea importers and exporters need to be aware of the character and problems that may occure from what was above-mentioned revised Foreign Trade Law of Korea. In the thesis, i tried to explain and survey the character and evaluation of revised Foreign Trade Law in Korea with particular attention to revised frameworks for electronic commerce on focus legal and commercial problems.

        What may be a problem, however, is determining the application to electronic methods of the various rules which the courts have developed for dealing with the consequence of different methods of communicating offers and acceptances. However, it was doubtful that in the law electronic documents may make part of the traditional documents based on paper. The purpose of this thesis, thus is to examine the effectiveness of electronic methods as a means of forming contracts and the some legal problems. Accordingly, The thesis is basically divided into two part. Part one considers a contract for trade is made how, when and where through compare with traditional contracts law and electronic methods. Part two considers and explores the efficiency on the formation of electronic contracts for the sale of goods by On-line.

        병원 내 화장실의 방사성 표면오염도 측정

        This study measured radioactive surface contamination in general public restrooms in hospitals and in dedicated toilets for nuclear medicine. The measurement method was measured using Berthold (LB 124, Germany) at the entrance to the restroom, inside the restroom, around the restroom, in the urinal, and around the urinal. As a result of the use of the restroom, there was no dedicated place waiting for patients who received radioisotopes in one of the three hospitals. As a result of measuring the restroom for exclusive use of radioisotopes, all measurement sites in the radioiodine therapy room were the highest, and the results of measuring the public restrooms showed background level contamination at all hospitals except hospital B. However, it was measured as 8.073 Bq/cm2 and 6.426 Bq/cm2 in the urinals in the public restroom on the first floor of the B hospital. Therefore, it is recommended to explain the dangers of radiation exposure to patients and provide a place for patients to wait. In addition, a plan should be sought to prevent patients from receiving radioisotopes from using unnecessary movements and general public restrooms. 본 연구는 병원 내 일반 공용화장실과 핵의학 전용화장실내의 방사성 표면오염도를 측정하였다. 측정방법은 Berthold(LB 124, Germany)을 이용하여 화장실 입구, 대변기 안, 대변기 주위바닥, 소변기 안, 소변기 주위바닥에서 측정하였다. 화장실 사용실태 결과 3곳의 병원 중 1곳의 병원에서 방사성동위원소를 투여 받은 환자가 대기하는 전용장소가 없었다. 방사성동위원소 전용 화장실을 측정한 결과 방사성옥소 치료병실에서 모든 측정 장소가 가장 높게 측정되었고, 공용화장실을 측정한 결과는 B병원을 제외한 모든 병원의 측정 장소에서 백그라운드 수준의 오염도를 나타냈다. 하지만 B병원의 1층 공용화장실 소변기 안, 소변기 주위바닥에서 8.073 Bq/㎠, 6.426 Bq/㎠으로 측정되었다. 따라서 환자들에게 방사선피폭의 위험성을 설명하고, 환자가 대기할 수 있는 장소를 마련할 것을 권고 한다. 그리고 방사성동위원소를 투여 받은 환자는 불필요한 이동과 일반 공용화장실을 사용하지 못하도록 하는 방안이 모색되어야 할 것이다.
