국회의원 지역선거구 획정에 관한 헌법적 고찰 : 기준 · 주체 · 시기를 중심으로

2014년 10월 30일 헌법재판소의 결정으로 국회의원 지역선거구 획정에서 허용될 수 있 는 인구편차는 평균선거구인구수의 상하한(上下限) 33⅓%으로 되었다. 이에 따라 선거구 의 새로운 획정이 현안과제가 되면서 선거구 획정의 기준, 주체, 시기에 관하여 보다 구체 적인 논의가 필요하게 되었다. 첫째, 선거구획정의 기준으로 선거구 인구의 균등성과 이익 의 일치를 명시할 필요가 있다. 이와 관련하여 독일의 입법례가 좋은 시사점을 제공한다. 시·도별 지역구 의석수는 그 인구비율에 비례하여야 하며, 인구편차의 허용한도를 명문으 로 규정하여야 한다. 둘째, 새로운 기준에 따라 선거구를 획정하기 위해서는 선거구의 경 계변경 이상으로 선거구의 규모와 국회의 규모도 함께 변경하는 것을 고려할 필요가 있다. 셋째, 기존의 국회 소속 선거구획정위원회를 대신하여 중앙선관위 소속의 선거구획정위원 회를 설치하는 것이 바람직하다고 본다. 이를 위해 국회는 선거구획정위원회의 설치와 관 련한 법률을 제정하여 그 구성, 조직, 운영 등에 관하여 상세한 규정할 필요가 있다. 그리 고 중앙선관위 소속의 선거구획정위원회에 사실상 최종적인 결정권을 인정하여야 할 것이 다. 넷째, 선거구 획정 시기를 법률에서 명시할 필요가 있다. 현행 공선법의 체계상 최소한 선거일 6개월 전에 선거구를 획정하여야 할 것이다. 그러한 점에서 제20대 총선을 위한 새 로운 선거구획정위원회의 설치 및 구성을 서둘러야 할 것이다. According to the Constitutional Court’s decision of 30 October 2014, the population variation that can be tolerated in the boundary delimitation in the National Assemblyman election is under ±33⅓% of the average constituency population. The decision raises some questions as to the criteria, the authority and the timing of redistricting constituencies. First, it is necessary to establish expressive criteria―equality of population in the constituencies and community of interests. As an example of Germany suggests, district seats in the metropolitan cities and provinces will be in proportion to their populations, and the permissible limit of population deviation shall be specified. Secondly, according to the new criteria relating to the constituency delimitation, it is necessary to consider the change of the district magnitude and the size of the Parliament along with constituency boundary changes. Third, on behalf of the existing the Redistricting Commission belonging to the National Assembly, it is preferable to install the new one belonging to the National Election Commission. To this end, the Assembly shall enact a law relating to the installation of the Redistricting Commission which prescribes about its composition, organization, operation. Fourth, it is necessary to specify the time of redistricting in the legislation. Boundary delimitation shall be finished until at least six months before the general election day. Therefore, the Assembly should make haste for the installation and configuration of the new Redistricting Commission for the 20th general election.
