교통사고 조사와 자동차용 영상 사고기록 장치 장착 의무화에 관한 법적 고찰

2010년 교통사고 통계분석에 의하면 전체 교통사고 발생건수는 226,878건으로 이중에서 사망자수는 5,505명이며, 부상자수는 356,458명에 달하고 있다. 이러한 교통사고 피해결과를 금액으로 환산한 교통사고비용이 14조 원을 넘어설 만큼 심각성이 커짐에 따라 이러한 심각성을 해결하기 위한 제도개선과 법률개정 및 정책마련을 위한 다양한 연구 활동이 진행되고 있으나 뚜렷한 대안은 마련되지 못하고 있다. 교통사고의 원인 규명 과정에서는 사고를 재구성하기 위한 프로그램들을 활용하여 사고에 대한 정확한 분석 및 재현하는 방법으로 교통사고 조사가 계속되어 왔다. 하지만 이러한 교통사고 원인조사와 재구성에 많은 어려움이 있다. 이러한 어려움을 극복할수 있는 대안으로 등장한 장치로 블랙박스가 거론되고 있다. 블랙박스는 교통사고 전후의 사고발생 영상, 발생 위치, 차량운행 기록, 음성 등을 자동으로 기록하는 장치를 의미한다. 차량 운행정보 생성방식, 카메라에 의한 동영상 촬영 등 특성에 따라 ‘디지털운행기록장치’와 ‘영상기록장치’로 구분된다. 블랙박스의 장착은 운전자에게 사고발생시 가해 및 피해차량이 정확히 구분된다는 생각이 들게 함으로써 보다 신중히 운전하는 분위기를 조성할 것이다. 이는 결국 교통사고의 감소로 이어져 교통사고로 발생하는 사회적 비용을 대폭 줄이는 획기적인 결과를 가져올 것으로 기대될 뿐 아니라, 이제 막 형성되기 시작하고 있는 차량용 블랙박스세계시장에서 IT 강국인 우리나라의 여건상 우리의 세계시장을 한층 더 넓히는 계기가 마련되어 경제 파급 효과도 크게 상승할 것이다. 이에 2011년 4월 13일 기술표준원에서는 블랙박스의 표준화를 고시하였으며, 현행 교통안전법에서 시행되고 있는 사업용 차량에만 한정되어 있던 것을 모든 차량으로 확대하고자 하는 교통안전법 개정법률안이 2011년 7월 26일 국회에 제출되었다. 하지만 블랙박스의 장점이 있음에도 불구하고 문제점으로 지적되고 있는 것으로는 블랙박스에 의해서 기록된 정보의 소유권과 개인정보의 유출의 문제 등이 있다. 이와 관련하여 국토해양부는 블랙박스에 기록된 정보가 다른 범죄의 수단으로 사용되는 것을 막아야 할 것이며, 경찰의 경우에도 행정관청과 긴밀하게 협조하여야 할 것이다. According to the statistical analysis into traffic accidents in 2010, the total number was 226,878, in which 5,505 victims were dead and as many as 356,458 were injured. It is getting more serious with the cost of traffic accidents over 14 trillion won when the damage by them is converted to money. Then, various researches have been conducted on the improvement of a system, the amendment of laws and the establishment of policies to alleviate this gravity, but definite alternatives have not been made yet. With regard to the process to identify the reasons for a traffic accident, investigations have been conducted by applying programs to reconstruct, exactly analyze and reenact an accident. However, this kind of investigation of causes and reconstruction of a traffic accident implies many problems. As for the alternative equipment to overcome these difficulties, a black box is discussed these days. A black box is the device that automatically records the accident images before and after it, the location of occurrence, the running of a car, voices etc. It is classified into “a digital running recorder” and “a video recorder” according to its characteristics: the creation method of the running information of a car, the shooting of a video with a camera. The installation of a black box will establish the atmosphere where drivers drive more cautiously by making them think that it will help identify clearly the assailant and the victim cars when an accident happens. This will lead to the decrease of traffic accidents after all, which is expected to bring an epoch-making result of radically dropping the social cost by traffic accidents. Moreover, it will create the great increasing impact on economy by making the opportunity to expand the share of Korea in the world market of the black box for cars which has just begun to be formed, when the conditions of Korea as the leading IT country is considered. Accordingly, Korean Agency for Technology and Standards announced the standardization of black boxes in April 13th, 2011, and the revised bill of the Traffic Safety Act was submitted to National Assembly in July 26th, 2011 in order to expand what was limited only to the cars for business under the current Traffic Safety Act to all cars. Yet, despite the merits of a black box, the problems of the ownership of the information recorded by a black box and the data spill of personal information have been pointed out. With regard to this, The Ministry of Land, Transport and Maritime Affairs will have to prevent the information recorded by a black box from being misused as the means of crime, and also, the police should closely cooperate with administrative offices.
