The Article 21 of the constitution of Republic of Korea regulates that the rally or protest are not an absolute liberty guaranteed unrestrictedly in any circumstances but is a restricted relative liberty that guarantees the fundamental rights of the people for the national security, maintain order and the public welfare, if necessary. In spite of that, various kinds of interested parties claim that, since rally or protest are absolute liberty and have the right to do them when there is a right object, any violent measures can be justified. They also treat the public power lightly, the so called collective pestering, with continuance of social chaos and violence. Even though, legitimacy of violent rallies have been vanished since past military dictatorship period, some of the protest parties are keeping on with habitual illegal protest and they have huge responsibility of the loss in society by the action that they have taken. Also, the government is focusing on having regard for demonstrator's countenance, rather than taking stern legal action against them, the authority of public power start to forfeit, and unyielding of manifestant's illegal protest leads to continuance vicious cycle in real. Following the basic rule is essential for establishment of the legal order. Falling of public power should not be a blamed only to the police, and need to get rid of public order populism, which politically caters to popularity of the public and gives a tacit consent to the violation of the law. When the public power of the nation starts to fall by losing justified authority and prestige, the damage leads to the people. It is necessary that the government should guarantee the legal rallies and protest, but about an illegal act such as violence should be enforced with the law in principle. First, the police and also the government and the people should make an effort to make an upright social-climate of the country from collective pestering, which the public believes that making clamor of their claim is effective way to inform to the public, and also, make the society admits orthography. As violent protest and an indiscreet demonstration in downtown infringes on the fundamental rights such as the peoples life and property rights of the body, peaceful and legal rallies should be guaranteed aggressively and illegal violent protest should be dealt with promoting a revision of the Law on Assembly and Demonstration and should take strong actions against malfeasants by dealing with them in strict fairness. However, an abuse of public power that hurt the human rights will not have the support of the people, and consequently this will only diminish the public power. Therefore, the execution of the power should be constituted based on guaranteed human rights and its extensions. In the future, by reforming the social environment, repletion of the law and aggressive call to account civilly, public power of the nation should be established and political care for alienated class should be accomplished, which will settle down the legitimate and peaceful rallies or protest culture. Through the settlement, it is very important to make best use of mobilizing police force at illegal violent demonstration fields to prevent crimes, to arrest criminals and to contribute their duty in safety of public welfare. 우리 헌법 제21조에서 집회시위를 국민의 기본권으로 보장하고 있지만 그 성격상 다수가 참여하여 행동 또는 언어를 통하여 의견·주장을 표현하므로 공공의 질서, 타인의 권리·자유와 충돌할 가능성이 다분하기 때문에 어떤 상황에서도 무제한 보장되는 절대적 자유가 아니라 국가안전보장, 질서유지, 공공복리를 위하여 필요한 경우에 제한 할 수 있는 상대적 자유이다. 그럼에도 불구하고 각종 이해단체들은 집회시위가 절대적 자유와 권리이므로 목적만 옳으면 어떤 폭력적 수단도 정당화될 수 있다는 주장을 펴며 공권력을 경시한 채 이른바 떼법을 쓰면서 무질서, 폭력사태를 지속하고 있다. 과거 군사독재 시절과 달리 과격시위의 정당성이 사라졌는데도 불법과격 시위로 사회적 손실을 키운데는 상습 불법시위단체의 책임이 크지만 정부도 시위대의 불법을 엄단하기보다는 과잉진압 책임자 문책 방지에 중점을 두는 경우도 있어 집회 현장 근무경찰이 임무를 제대로 수행하기보다는 부상자 발생 등 마찰을 피하는데 급급하고 불법행위로 연행되면서도 인권위에 제소하겠다며 기세 등등한 시위대의 눈치를 보게 됨에 따라 공권력의 권위는 실추되고 시위대 불법은 더욱 기승을 부리는 악순환이 반복되어 온 실정이다. 인권과 자유를 중시하는 선진국들은 불법행위에 대해서는 단호한데 비해 우리나라의 공권력과 사법부는 불법시위에 지나치게 관대하고 온정적이라는 지적을 받고 있다. 법질서 확립을 위해서는 기본에 충실해야 한다. 공권력의 추락을 경찰만의 문제로 봐서는 안되며 정치적으로 대중의 인기에 영합해 법 위반을 묵인하는 치안포퓰리즘을 버려야 할 것이다. 국가공권력이 정당한 권위와 위신을 잃고 무너져 내린다면 그 피해는 국민에게 고스란히 돌아간다. 2007년 한해동안 경찰은 연인원 311만명 이상이 동원돼 시위현장에서 근무해야 했으며 불법시위로 중상자 15명을 포함해 부상한 경찰관도 202명이나 된다. 그 많은 인원이 범인검거와 범죄예방 활동을 했다면 하는 아쉬움이 남을 뿐만 아니라 국가적으로도 큰 손실이다. 정부는 합법적인 집회와 시위는 보장하면서도 폭력 등 불법행위에 대해서는 원칙적으로 법을 집행해야 한다. 일단 시끄럽게 해야 자신들의 주장을 효과적으로 알릴 수 있다는 떼법, 정서법이 용인되는 사회풍토를 올바르게 고쳐 나갈 수 있도록 경찰은 물론 정부와 시민이 함께 나서 노력해야한다. 세계적인 국가위험 분석기관인 폴리티컬 리스크 서비스 그룹의 2005년 조사에서 우리나라의 법질서 준수 정도는 OECD 30개국중 27위로 나타났으며 KDI 차문중 경제개발연구실장은 우리나라가 OECD 국가들의 평균법질서 준수수준을 유지했다면 1990년대에 매년 1% 내외의 추가 성장이 가능했을 것이라고 밝힌바 있다. 최근 경찰에서는 개인적 자유와 권리는 철저히 보장하되 불법에 대해서는 강력하게 대처하는 무관용 원칙에 따라 폴리스라인 침범자에 대해 전원 검거키로 한데 이어 불법폭력시위 가담자를 훈방하는 대신 즉결심판에 회부하는 등 경미한 행위도 법 집행을 엄정히 함으로써 불법의식 확산을 막겠다는 결연한 의지를 보인바 있어 이 원칙을 일관되고 엄정하게 적용한다면 불법시위는 획기적으로 감소할 것으로 기대된다. 국내에서 과격행위를 일삼던 시위대가 2006년 미국 원정시위에서는 불법에 가차없이 철퇴를 가하는 미국경찰을 의식하여 적법하게 행동한 것은 공권력이 바로 서면 법질서가 유지된다는 평범한 진리를 여실히 보여준 사례라 하겠다. 폭력시위와 무분별한 도심시위로 국민의 생명, 신체 재산권 등 기본권이 침해되고 있으므로 평화적이고 합법적인 집회는 적극적으로 보장하고 불법폭력시위는 강력히 대응하는 방향으로 집시법 개정을 추진하고 불법행위자에 대하여는 엄정하게 조치해야 하겠다. 본 연구는 시대적 여건 변화에도 불구하고 지속되고 있는 불법폭력시위를 감소시킬 수 있는 경찰의 효율적인 대응방안에 관하여 연구를 진행하였다. 먼저 합법적이고 평화적인 집회의 철저한 보호·보장을 전제하면서 불법폭력시위를 방지하기 위해서는 범정부적인 평화시위 문화 정착활동 전개와 대국민 홍보강화로 사회·정치적 환경을 개선하고 집회시위를 단계별·유형별로 관리하는 한편, 변모하는 집회시위에 대응하기 위해 경찰 장비와 경력을 시위상황에 맞게 적절히 활용하고, 실질적 소음규제 방안 등을 포함한 집회시위 개선방안을 살펴보았다. 무엇보다 불법폭력시위 방지를 위한 가장 중요한 대책은 일관성 있고 엄정한 법집행과 불법행위자에 대한 형사처벌 강화는 물론이고 경찰관에게 신체적 피해를 입히거나 공용물 손괴시에는 손해배상소송도 적극 청구하는 등 철저한 민사책임도 제기하여 재산상 불이익을 주는 방안을 적극 제시하였다. 그러나 공권력 확립이 인권침해까지 용인한다는 뜻은 결코 아니다. 사회일각에서는 한국사회가 사법정의나 경제정의가 부족하여 항상 정의를 지키는 사람이 손해를 보며 소외계층이나 사회적 약자에 대한 배려나 목소리를 낼 수 있는 기회가 미흡하기 때문에 시위가 발생하
