암호화폐로 대표되는 비트코인은 블록체인을 통한 분산원장기술을 이용한 디지털화폐를 말하는데, 여기서 블록체이란 거래정보가 기록된 블록이 암호화되어 다음 블록에 순차적으로 기록됨으로써 연결되는 데이터베이스 또는 그러한 기술이 집약된 데이터 구조라고 할 수 있다. 비트코인은 인터넷상에서 개인 대 개인(P2P; peer-to-peer) 간에 이용될 목적으로 암호체계에 기초해 금전적 가치가 전자적 형태로 저장되어 지급수단으로 사용될 목적으로 설계되었지만, 정부나 중앙기관에 의해 지급이 보장되지 않는다는 점에서 기존의 법정화폐와 차이가 있다. 비트코인 등의 암호화폐는 혁신적인 기술이고 이를 통해서 많은 사업기회가 창출되는 등의 장점 및 투기, 도박, 불법자금 형성, 탈세 등의 단점이 공존하는 것이 현실인데, 정부가 단점만을 부각하여 암호화폐에 대한 강력한 규제를 하는 것은 이제 막 세상에 나온 암호화폐 생태계의 붕괴를 촉진할 수 있다. 따라서 현 단계에서는 혁신을 장려하고 권장한다는 메시지를 시장에 제시하는 것이 우선되어야 하고, 법적. 경제적인 관점에서 암호화폐가 무엇인지에 대한 연구를 활발히 진행하여 관련 산업에 대한 이해를 바탕으로 규제 및 지원에 관한 사회적. 정책적 합의가 이루어져야 한다고 생각한다. 또한 암호화폐거래업자들은 투자와 투기 사이를 오가는 암호화폐 거래로 인한 여러 가지 사회적. 경제적 부작용을 줄이기 위한 자정노력을 하여야 할 것이다. 따라서 본 논문에서는 지금까지 경험해 보지 못했던 새로운 그 무엇인 암호화폐에 대한 성격은 무엇인지, 그 성격에서 도출되는 활용방안은 어떻게 되는지에 대해 고찰해 보고, 암호화폐를 투기 또는 위험한 시각으로만 바라보는 일부 편향된 시각과 우려를 바로 잡기 위해 마련되어야 할 관련 법률에 대해 연구해 보고자 한다. Bitcoin, a prominent example of cryptocurrency, refers to the digital currency that uses distributed ledger technology through the blockchain. Blockchain is a database that orderly charts encrypted transaction data via one block at a time or a data structure that encapsulates such technology. Bitcoin differs from conventional legal tenders distributed by the government or a central issuing authority as it was designed to store currencies in a digital form as peer-to-peer (P2P) transactions based on the cryptography system and not controlled by the government. Even though the technology of cryptocurrency, such as that of Bitcoin, is innovative and has so much potential with a lot of business prospects, it also contains many flaws such as speculation, gambling, illegal funding and tax evasion. However, if the government controls its nascent ecosystem through stringent regulations, considering only its flaws, it will simply be accelerating the demise of cryptocurrency that just came out to the world. Therefore, at this stage, setting a supportive and encouraging climate for innovation should come first. Hence, regulations and aids should be built on the understandings of relevant industries after conducting full studies in legal and economic perspectives. Likewise, social agreements and concerted policies should be followed, too. Moreover, cryptocurrency traders should also make efforts to lessen the side effects of investments or speculative investments that could lead to social and economic complications. In this way, this paper examines the characteristics of, cryptocurrency, and how to utilize them, and proposes laws needed to right some skewed perspectives and concerns that dismiss cryptocurrency as an object of speculation and precarious invention.
