This study compared and analyzed assistant systems in other professional qualifications based on the reality of Korea's real estate brokerage assistant system, and sought ways to improve system operation by conducting an empirical analysis of licensed real estate agents who hired brokerage assistants.
As a result of the empirical analysis, this study drew the following problems by dividing the current real estate brokerage assistant system into reporting process, work performance process, and supervision process, respectively.
First, in the reporting process of intermediary assistants, the job training that must be completed for reporting is limited to very limited time and limited content, and is not equipped with even the minimum expertise as it is done in the form of formal Internet video lectures. Under such poor basic conditions, licensed brokers indiscriminately hire brokerage assistants under the perception that they are working part-time, resulting in harming the stability of the real estate brokerage market.
Second, in the process of performing the duties of brokerage assistants, since the scope of the ‘simple duties’ they perform is not clear, in addition to on-site guidance and general office work, the services of certified brokers are conducted in the form of proxy. Since it is difficult for the brokerage client to accurately confirm the identity of the brokerage assistant, serious brokerage accidents and incidents may occur surrounding the work in which the brokerage assistant was directly involved.
Third, in the process of guiding and supervising brokerage assistants, there is no on-site control by the registration authority on the activities of brokerage assistants after employment, and it is difficult for licensed brokers in practice to build on-site practical assistance capabilities in the process of controlling and managing brokerage assistants. There is a lack of institutional arrangements that can.
Regarding these problems, this study suggested the following improvement directions.
First, in the reporting process for brokerage assistants, the current 3 to 4 hours of job training is expanded to 6 to 9 hours, and real estate brokerage-related laws and real estate brokerage practices are added to the training content, and indirect education is also provided for the training method. It is necessary to strengthen the minimum level of expertise by converting to a direct education method rather than a direct education method. In addition, although the number of brokerage assistants cannot be legally enforced, it is necessary to control and manage the number of people reflecting the overall conditions of the brokerage office size and workload, etc.
Second, in the process of performing the duties of the brokerage assistant, in addition to the provisions defined in Article 2, subparagraph 5 of the Licensed Realtor Act, Article 15 enumerates the type of brokerage assistant However, it is necessary to prepare regulations to impose penalties on employees in case of violation. In addition, it is also necessary to make brokerage assistants obliged to wear an identification card that can inform their identity to the outside, and to impose a fine for negligence in case of violation.
Third, in the process of guiding and supervising brokerage assistants, it is necessary to stipulate periodic management obligations of registration authorities to crack down on illegal activities of brokerage assistants, and stricter management obligations are also enforced on associations and employees in relation to brokerage assistants' business activities. Needs to be. In addition, it is necessary to continuously strengthen the ethics and professionalism of brokerage assistants by conducting general education once a year and training once every three years.
