The development of Weapons of Mass Destruction such as biologic and chemical weapons have the potential to create mass casualty and public panic. They represent an existing and growing security and safety risk for all the citizens of the world. Biologic agents are more deadly on a compound-per-weight basis than chemical agents. Biological agent attacks have a slower course, but have the greatest potential impact for casualties by weapon size and cost. This research to reflect these situations try to show the direction of establishing the legislative system which set up the management system of infectious substances such as biologic agents. We made an effort to establish some guidelines regarding possession, use and transfer of viruses,bacteria, and toxin, and we tried to show the direction of establishing the legal system which is designed to protect public health and to support biosafety and biosecurity. First, for purposes of this part we have determined the definition of infectious substance capable of causing death, diseases or other biological malfunction in a human. Infectious substance means any pathogenic organism(including to viruses, bacteria and toxins) or any naturally occurring, bioengineered or synthesized component of any such microorganism. Second, we made the draft bill of National Management System of Infectious Substance as following items; (1) requirements of registration or reporting to the authorities. (2) security risk assessments of infectious substance, (3) biosafety plan and security plan, (4) providing information and training on biosafety and security, (5) maintaining complete records of possession, use and transfer, (6) developing and implementing a incident response plan, and (7) the dual use infectious substance and encouraging for development of the microorganism study. It was expected that the draft bill to be suitable to national management system of infectious substance should be shaped toward decreasing the hazard of infectious substance and bioterrorism and increasing the promotion of the microorganism study.
