한·중·일 과학기술법 교류사 연구

국문 초록 (Abstract)

본 연구는 한중일간의 교류관계를 중심으로 하면서 한중일 과학기술법의 전개과정을 기술한 것이다. 한중일 과학기술법을 각 분야별로 나누어 살펴보고, 서로의 교류관계를 분석검토한 결과, 한일간의 과학기술법의 교류에 있어서는 한국의 일방적 수용의 흔적은 명백하지만, 그 내용이나 수용의 폭은 지속적으로 변화해 왔으며, 특히 1990년대 이후로는 한국법이 일본법을 수용하는 단계를 넘어서, 자주적인 입법이 증가하고 있으며, 심지어 한국법이 일본법에 영향을 미치는 경우도 나타난다. 최근의 경우 일본법을 무비판적으로 모방한 입법은 실제로 그 수적인 면에서 극히 미미하다.
중국은 여러 측면에서 적극적으로 한국과 일본의 과학기술법을 참고하고 있는데, 특히 중국법이 일본법보다는 한국법을 더 많이 참조하고 있다는 점은 매우 흥미롭다. 이 점을 고려하면서 한․중․일 과학기술법 교류관계를 전체적으로 본다면, 한국은 일본법을 상당부분 수용 내지 모방하였는데, 중국법은 일본법을 직접 참고하기보다는 한국법을 더욱 긴밀하게 참고하여 형성되고 있음을 알 수 있다.

다국어 초록 (Multilingual Abstract)

This study describes the development of laws of Korea, China and Japan related to technology with emphasis on the interchanges among Korea, China and Japan. After examination of each categories of laws of Korea, China and Japan related to technology, results are as follows: as to the interchanges between Korea and Japan, it is clear that Korean laws have referred the Japanese Laws. However, the extent of the reference is gradually changed. After the 1990's, especially, Korean laws have not been affected by Japanese laws. Rather, with a increasing number of independent laws in Korea, Korean laws sometimes affected Japanese laws. In recent, there are few laws referring Japanese without any evaluation.
Chinese laws have referred both Korean laws and Japanese laws; furthermore, it is notable that Chinese laws have referred Korean laws more than Japanese laws. In summary of the interchanges among Korea, China and Japan, Chinese laws have been referring from Korean laws rather than directly from Japanese laws while Korean laws have referred from Japanese laws.
