망중립성에 있어서의 이익 조정에 관한 연구

The goals and results of this study are as follows.
First, this study makes clear that the issue of network neutrality is an issue of constitutional law through arranging problems in the issue of network neutrality in a perspective of constitutional law.
Second, this study deduces the principles and standards for balancing interests of the concerned subjects in the issue of network neutrality, Internet user, network provider, the government. And then this study makes these principles and standards contribute to solve the problems in the issue of network neutrality.
Third, this study presents policy proposals or drafts for legislation over network neutrality according to the principles and standards for balancing interests of the concerned subjects in the issue of network neutrality, Internet user, network provider, the government.

국문 초록 (Abstract)

본 연구의 연구목표와 연구결과는 다음과 같다.
첫째, 헌법적 관점에서 망중립성 문제의 기저에 놓여 있는 쟁점들을 정리함으로써, 망중립성의 문제가 헌법적 문제임을 밝힌다.
둘째, 망중립성에서의 관련 당사자인 이용자, 망 사업자, 정부간의 이익 조정을 위한 원칙과 기준 등을 도출하고, 이러한 원칙과 기준 등이 향후 망중립성 분쟁 해결에 기여할 수 있게 한다.
셋째, 망중립성에서의 관련 당사자인 이용자, 망 사업자, 정부간의 이익 조정을 위한 원칙과 기준 등에 따라 망중립성에 관한 구체적인 입법안 내지 정책안을 제시한다.
