형법에 의한 여성보호의 가능성과 한계

국문 초록 (Abstract)

우리사회에서 여성주의운동이 급성장하면서 형사법영역에서도 그 성과물을 쟁취하였다. 성폭력특별법, 성매매특별법의 제정이 그 대표적 예라고 할 수 있다. 하지만 형사법영역에서는 이러한 형사특별법의 제정과 폭행협박이 아닌 단순 비동의강간을 범죄화할 경우 이 국가형벌권의 과잉을 초래하여 민주적 형사사법의 근간을 와해할 우려가 높다는 부정적 시각이 유력하다. 이 연구는 그동안 여성주의운동의 성과와 한계를 살펴보고 법을 통한 사회개혁의 가능성과 한계를 조망하여 보고자 기획되었다. 그 내용으로서는 형사법영역에 존재하는 남성편향적 법개념과 일반인들의 의식가운데 뿌리깊게 박혀있는 강간죄에 관한 사회적 통념의 허구성과 강간죄의 사회적 기능을 분석하는 작업, 그리고 우리보다 선구적으로 강간죄개혁을 수행한 미국 미시간주의 강간죄개혁경과와 그 효과에 대한 분석 등이 포함되었다.
그 결과 법을 통한 사회개혁은 사회의식의 변화와 구체적 법실행기관종사자들의 의식변화를 동반할 때 가장 효과적일 수 있으며, 사회의식의 변화없이 형벌의 상향조정 만으로는 한계를 가질 수 밖에 없음을 증명하고자 하였다. 따라서 향후 여성운동도 여성보호를 위한 제반 법개정작업과 함께 사회 및 법실무가들의 인식변화를 동시에 추진하여야 할 것이다.

다국어 초록 (Multilingual Abstract)

The feminist movement in Korea has achived a important legal outcome such as Act on sexual violence and Act on prostitution.
But many criminal literature criticize this acts will have negative impact on the entire legal system because they will disturb the hierachy of laws and the excessive use of criminal sanction will have . The aims of this study are to examine the legal provisions about rape in the viewpoint of feminism and the limit of the feminist movement in the legal area.
As results of this study we present following points. The social reform through the laws can not be pushed effectively without the supprort of the general public and the actors in the legal system. The exprience in Michigan in 1970s indicates that the reform brought about changes in procedure but not in the basic attitudes or definitions of crime. So Increasing public support for reform puts an important pressure on many of male legislators, this means the noeed for both community education and legislative reform efforts to go hand in hand.
Generally, there should be three conditions for necessary for successful social change throuth the law. First, a law with supportive judicial interpretation for the change. Second, the law must be implemented and enforced by an administrative structure sympathetic to the intent of the law. And finally, the beneficiaries of the change must organize to take full advantage of the change and to exert pressure on the administrative structure to improve implementation efforts. The reciprocal influence of the law, of the administrative organization, and of the reform group is very important to successful change of the society.
