국제사회가 발전하면서 대외문제, 특히 국제적 합의의 중요성이 증가하고 있다. 세계초강대국인 미국의 경우 연방정부 내에서 국제적 합의가 차지하는 비중은 상당하며, 국제적 합의에 관한 많은 연구가 이루어져 왔다. 국제적 합의는 크게 조약과 조약 이외의 국제적 합의로 분류되고, 조약은 자기집행적 조약과 비자기집행적조약으로 분류되며, 조약이외의 국제적 합의는 대통령협정과 입법부-행정협정으로 분류된다. 대통령협정은 대통령이 자신이 보유한 집행권에 근거하여 혼자서 독립적으로 체결하는 행정협정을 말하고, 입법부-행정협정은 상원의 동의가 아니라 상원, 하원 모두 불포함한 전체로서의 의회의 단순다수결에 의한 동의를 필요로 하는 행정협정을 말한다. 행정협정은 미국헌법이 제정된 이래 계속하여 활용되어 왔으며, 다양한 유형의 행정협정들이 출현하고 있다. 입법부-행정협정은 미리 의회의 권한부여에 의하여 체결되는 것과 사전의 권한부여가 없는 것이 있으며, 조약의 집행을 위한 행정협정도 있다.
조약과 조약 이외의 국제적 합의를 포함하여 국제적 합의의 종류를 유형화하는 방식으로는 4가지를 고려해 볼 수 있다. 이러한 유형화 방식들은 미국헌법상의 국제적 합의를 이해하는데 큰 도움을 줄 것이다. 하지만 국제적 합의, 특히 행정협정이 발전하면서 계속적인 분화를 시도하기 때문에 유형화의 방식은 계속적인 보완을 필요로 한다. 조약의 경우 자기집행적 조약은 의회의 법률 없이 직접 미국법원에서 적용될 수 있는 조약을 말하며, 비자기집행적 조약은 의회의 별도의 법률이 있어야만 미국법원에서 적용될 수 있는 조약을 말한다.
자기집행적 조약과 비자기집행적 조약의 구분의 기준으로는 조약 당사국의 의도가 가장 중요하다. 하지만 조약당사국의 의도가 그리 명백한 것은 아니기 때문에 다론 기준에 의한 보완이 필요하다. 행정협정의 경우 대통령과 전체로서의 의회가 체결과정에 참여하게 되는데, 의회는 대통령의 행정협정 체결에 대하여 통제하려는 강한 욕구를 가진다. 상호무역협정의 경우 입법부-행정협정의 형식을 취하는데, 의회는 동의에 의한 참여뿐만 아니라 협상과정 자체에도 자신의 대표를 참여시키려고 하며, 협상단으로부터 보고를 받기를 요구한다. 입법부-행정협정의 경우 미국헌법의 명문의 규정은 없기 때문에 헌법상의 권한에 관한 여러 규정들로부터 그 근거를 도출하고 있다. 물론 입법부-행정협정의 근거에 의문을 제기하는 견해들이 계속하여 나타나고 있다. 이러한 의문들에도 불구하고 행정협정의 활용비율은 조약에 비하여 훨씬 높다. 행정협정에 관한 연구는 그 주제영역, 의회와 대통령의 권한관계, 효력, 새로운 절차의 도입 등 광범위한 영역에 걸쳐있다. 미국과 긴밀한 대외관계를 맺고 있는 우리나라의 경우 미국헌법상외 국제적 합의에 대한 깊은 이해가 필요하다.

International agreements in the United States Constitution consist of treaties and international agreements other than treaties. There is no express provision on executive agreements in the Constitution, but the need to use international agreements other than treaties has been acknowledged broadly in history. As a result, various forms of executive agreements have evolved. Executive agreements become sometimes a substitute for treaties, and now it increases although there are some doubts about the consititutionality of executive agreements, especially congressional-executive agreements.
The interchangeability of executive agreements for treaties is disputed between legal students, and the disputes are going on. Senate and Congress have tried to control over treaty making and executive agreement making power of the President. So the President has choices of tension or cooperation between two political branches. Senators have insist their prerogative in treaty making process, and Representatives have insist their participation in international agreements making process. Who is more appropriate for international agreements making, and for democracy? What is more appropriate for international agreements making, and for democracy? Who and What?
This article has sought to help us to understand the meaning of study on international agreements in the United States. So we can use their results and prepare for the future.
