낙태와 헌법상의 근본가치 : 여성의 자기결정권과 태아의 생명권 = Abortion and Fundamental Value in the Constitutional Law

국문 초록 (Abstract)

우리나라 현행 법률상 낙태금지는 낙태와 여성의 현실에 지극히 무관심했고, 이런 태도는 낙태를 방치하는데 일조해 왔다고 본다. 이런 견지에서 우선 모자보건법상 낙태의 허용사유를 현실화하여 낙태 허용사유에 사회경제적 사유를 포함해야 하고, 미혼여성과 10대 여성들의 재생산활동을 지원하는 정책 수립 및 규범적 마련이 시급하다. 궁극적으로 형법은 여성의 자기 낙태를 처벌하지 않아야 할 것이다. 이 경우에도 여성이 동의하지 않은 부동의 낙태가 규제되어야 하고, 기준을 충족치 않는 낙태시술에 대한 처벌규정이 필요하다.
여성의 낙태는 단지 낙태 금지 혹은 허용 원칙의 선택문제로 인식해서는 안 된다. 낙태를 허용한다고 해도 여성의 몸과 성에 대한 쾌락, 혹은 재생산의 도구화 등이 반복될 수도 있다. 낙태를 예방할 수있는 것은 단지 허용과 금지 원칙에 있지 않고 현실을 외면한 형식적 생명 존중에 있지도 않다. 낙태가 만연하는 이유는 생명존중사상의 부족이 아니라, 재생산활동을 하여 온 여성의 존엄과 가치에 대한 인식이 부족했기 때문일 것이다.

다국어 초록 (Multilingual Abstract)

Abortion is a highly controversial subject. Abortion in today's society has become a very political issue. Society is too quick to judge these poor women who have no choice but to resort to abortion as murderers. Abortion can also be harmful for the mother who gets the abortion.
Most people think, for example, that abortion is always morally problematic, and must never be undertaken except for good reason, but that it is nevertheless from time to time justified. Some think it justified only to save the life of the mother. Other overlapping but nonidentical groups think it justified in other circumstances as well: to protect the mother from non-life-threatening physical impairment, for example, or in cases of rape and incest, or in cases of serious fatal deformity.
I am pro choice and I believe people have the right to chose. Once she decides to get an abortion, her choice must be respected. There are some groups who do not agree with abortion, but do accept that it happens or is sometimes the lesser of two evils, whether as the result of something like rape, the endangering of the woman's life, or sometimes because of a belief that the soul can be reborn into another body.
Most religions disagree with abortion because they argue that it is killing an unborn child and that life is created and ended by God. However, many people feel that abortion should be available to women who choose to have it and their right to choose shouldn't be restricted by religious beliefs.
