일본의 아동학대사망검증에 대한 고찰과 함의 = Considerations and Implications for the Child Abusive Death Review in Japan

국문 초록 (Abstract)

일본과 우리나라는 같은 해인 2000년에 각각 「아동학대방지 등에 관한 법률」과 「아동복지법」에서 아동학대의 정의를 규정하며 아동학대를 사회문제로 인식하기 시작하였다. 그러나 그 간 20여년간 아동학대 대처에 대한 사회적 합의와 정책의도는 매우 상이해 왔다고 평가할 수 있다. 특히, 아동학대의 심각한 결과인 아동학대사망과 관련하여, 우리나라는 아동학대사망검증 제도가 마련되어 있지 않은 반면, 일본은 2004년부터 후생노동성에 아동학대 등 요보호사례검증에 관한 전문위원회를 두고 아동학대사망사건의 재발을 방지하기 위한 사회의 책무를 다하고 있다. 또한, 숨겨진 아동학대사를 밝히기 위해 모든 아동 사망 사례를 검증하는 Child Death Review를 제도화하기 위한 노력에 박차를 가하고 있다. 이에, 본 연구에서는 일본의 아동학대관련 현황과 법률의 변화와 함께 아동학대사망사례검증 제도 고찰을 통해, 아동사망사례 조사를 위한 법제화, 국가와 지방자치단체의 검증 협력, 적극적인 검증, 모든 아동 사망에 대한 검증을 함의로 도출하였다.

Japan and Korea have simultaneously recognized child abuse as a social problem, stipulating the definition of child abuse in the「Child Abuse Prevention Act」and「Child Welfare Act」since 2000. However, the social consensus and policy intentions on coping with child abuse are regarded as having been highly differently dealt with over the past 20 years. In particular, in terms of child abuse mortality which seriously results in child abuse, Korea does not have a system for reviewing the child abusive death. In contrast, Japan has had the committee in regard to the child abusive death review in the Ministry of Health, Labor and Welfare since 2004, which implies that Japan fulfilled its obligation, preventing recurrence of the child abusive death. In addition, Japan is accelerating by endeavoring to institutionalize the system for the child death review allowing death in all children to be verified in order to uncover hidden child abuse fatalities. Accordingly, through examining the current status and laws of child abuse and the system for the child abusive death review in Japan, this study drew following implications: legislation for child death review, verification of cooperation between the state and local governments, active verification, and the verification of death in all children.
