As the administrative function has been enlarged in quantity and upgraded in quality today, in order to execute that function that takes partial charge of the task, the need for the vertical division of labor between the central government and the local government has been increasing while the administrative function needs to be united and adjusted in the nation-wide and synthetic viewpoint. In this point, there is the need of the harmony of the centralization of power and the decentralization of power and ideal assignment between the central government and the local government is very important.
The administrative function of the nation is executed by the division of the task and cooperation of the central government and the local government. As the problems of the task division in the central and local government place limit upon not only the scope of the autonomous rights which contains the legal meaning but also the contents of the autonomous rights, the setting up the relation among the central and local, and a wide and basic self-government bodies is very important. The problems of the task division in the central and local government are decided by the practical aspects between the central and local governments and the task division is the necessary task for the efficient operation in the local self-government period in the base of reasonal principles and standards. Therefore the general principles and standards among the central and local government and the local self-government bodies are synthesized in the main subject and by examining the problems and realities of the task division in the central and local government, the need of the task division is presented. And the reason that administrative function and tasks don't be transferred to the local government is suggested and especially what the principles and standards in Korean reality are and policy substitute measures for the reasonal task division and policy propulsion system for the local transfer is present.
As the problems of the central administrative authority to the local transfer is connected with the original problems, the problems of the task division is very important. In the concrete problems of the function distribution among agencies, first, the principles of convenience, second, of efficiency, third, of equality should be the basic principles, and when the constitution entrusts the local self-administration to the laws, the limitation of laws that entrust in order not to infringe the essence of the local self-administration is required, and the 'statute' provision in the eighth chapter of the constitution should be reformed the laws. Finally, owing to the authoritarianism culture of the centralized authoritarian rule, the recognition on the local self-administration in the legal circles is very lack.
In order to understand and fix the local division rightly, public officials should establish the ground which promotes the true 'division from the below' through the acquisition of the information and the study, and suitable human power and financial measures should be inevitably accompanied by the practical authority transfer for the fixing of the local self-administration. Up to now, there is no great development because of the absence of the concrete methodology although the need is recognized. Accordingly, the concrete, plural methodology should be suggested and the financial resources and the method of human power computation that everyone could be accepted should be produced through the continual criticism and discussion in the academic world and government agencies. Ultimately, through the improvement the system, there is a kind of expectation to the high society that the prediction is possible. Without the transparent systematic procedure and concretely consulted methodology and with the arbitrary distribution of resources in the vested right levels or practical authority groups, there is a sort of possibility which agencies can not perform their goals to the open society. In short, our local self-administration needs the improvement and policy support that accord to the global standard, keeping pace with the division of work, the self-regulation, the democratization. Especially the social sharing of the sympathy that converted measures to the local self-administration in the finances and human power should be executed is required, and the cost computation principles and methodology should be established in order to support this system in the government and we will have the greatest task that fixs and organizes the local self-administration.
