이익충돌 규제의 비교론적 분석

국문 초록 (Abstract)

이 연구는 한국‧미국‧일본 3국의 이익충돌 규제를 비교론적 관점에서 분석하고 이를 정부 과정에 제도화하는데 필요한 정책적 함의를 모색한다. 이 연구는 연구 목적의 달성을 위하여 이익충돌 규제의 규범적 근거와 제도상의 핵심 요소를 규명하고, 이를 준거로 3국의 이익충돌 규제 실태를 분석하며, 실효성 있는 이익충돌 규제를 제도화하기 위한 실천적 대안을 탐색한다. 이익충돌 규제의 제도적 성격을 감안하여, 이 연구는 이익충돌 규제의 가장 핵심적 대상인 공직을 통한 사익 추구와 뇌물‧약인‧선물(증여)에 초점을 두고, 제척, 블라인드 신탁 등 재정권 박탈과 이러한 수단의 실효성 확보를 위한 윤리강령, 윤리위원회 등의 규제 장치를 분석한다. 이 연구는 이익충돌 규제에서의 국가 간 변이가 일국의 문화나 정치체제의 특성, 그리고 정부조직의 제도적 관행의 산물임을 확인하고, 향후 이익충돌 규제 시 문화적 적실성과 실효성을 적절히 조화하는 제도적 대안의 개발과 적용을 강조한다.

This study examines from a comparative perspective conflict-of-interest regulation in Korea, the United States and Japan, and gropes for some policy implications for its institutionalization in governmental processes. To reach its goal, this study clarifies normative grounds and key legal components of conflict of interest regulation, analyzes the practice of conflict-of-regulation in the three countries, and searches for practical alternatives for enhancing their effectiveness. Based on the institutional characteristics of conflict-of-interest regulation, this study focuses on quid pro quo and private gain from public office, and analyzes recusal, divestiture (blind trust), and ethics committee for ensuring its control effects. It identifies that differences in conflict-of-interest regulation in the three countries are the result of culture, political system and institutional norms of government organizations, and consequently emphasizes the development and application of practical alternatives, which harmonize cultural relevance and feasibility.
