유럽연합 특허시스템의 대대적 변혁과 그 교훈 = Recast of the EU patent law system and its Lessons

In 2013 a new era for EU patent law system was launched. The creation of the EU patent with unitary effect and the establishment of the Unified Patent Court established a new legal framework on substantive patent protection and patent litigation in Europe. This year the EU Patent Package would become a reality. It includes a regulation on a unitary patent, a regulation on the translation regime and an international Agreement on the Unitary Patent Court. In contrast to the classical European patent, the post-grant life of unitary patent will be governed by the newly created unified patent court and it will have unitary effect. In this article, I highlight the effect of the unitary patent and the jurisdiction of the unified patent court over unitary patents (and ‘traditional’ patents granted under the EPC that are not opted-out) for actions in relation to patent infringement or to revocation of a European patent and to licences of right. This article explores on the one hand the relation between national patent, the classical European patent and EU patent with unitary effect and on the other hand the relation of unified patent court to the Brussels Ibis Regulation. Particular attention is paid to the institutional changes created by the unitary patent package abd the new supplementary forum that enables the UPC to hear disputes involving defendants from third States that relate to an infringement of a European patent and give rise to damage inside as well as outside the Union. Furthermore on the perspective North-east Asia this essay examines the lessons from the experiences of EU patent package.

국문 초록 (Abstract)

최근 유럽특허제도가 대대적으로 개편됨으로써, 이제 유럽연합은 하나의 특허와 하나의 통합특허법원 시대로 접어들고 있다. 2013년 유럽 특허법은 새 시대를 열었다. 유럽연합 차원에서 단일한 효력을 갖는 특허를만들고 단일특허는 물론 종래의 특허도 보호하는 통합특허법원을 설립함으로써 유럽에서 특허의 실체적 보호와 특허소송에 관한 새로운 법적 체제가 갖추어졌다. 단일특허(unitary patent)는 유럽연합법에 기초하여 만들어졌으며, 통합특허법원(unified patent court)은 유럽연합 차원의 협정에 의하여 탄생된다. 통합특허법원에 관한 협정이 올해 안에 발효되어 통합특허법원이 작동하면 새로운 유럽 특허법 체제가 마무리된다. 이에 따라2018년은 유럽 차원의 단일특허와 통합특허법원 시대를 개막하는 첫 해로 기록될 것으로 전망된다.
이 논문은 단일특허의 효력 범위와 단일특허 및 전통적 의미의 유럽특허와 관련한 침해소송, 유무효확인소송, 권리의 라이선스 등에 관한 통합특허법원의 관할 범위를 조망한다. 종래의 유럽특허와는 달리 일단 단일특허로 취득된 경우에는 통합특허법원에 의하여 규율되고 유럽연합 전역에서 동일한 효력이 주어진다. 이와 관련하여 한편으로는, 국내특허, 전통적 의미의 유럽특허, 그리고 단일효력이 주어지는 유럽연합 특허의 상호간 효력 범위를 검토하고, 통합특허법원과 개정 브뤼셀규정과의 상관관계를 밝혔다. 특히 유럽연합 내외에서 손해를 발생시킨 유럽특허 침해 사건에 제3국인이 피고로 등장하는 경우에도 통합특허법원의 관할을 발생시키는 보충적 재판적을 면밀히 분석하였다.
발명을 적극 보호하여 국가경쟁력을 높이기 위해서는 새로운 지식재산제도를 벤치마킹하는 일은 매우 중요하고 시급하다. 이 논문은 최근 급격한 발전을 거듭하고 있는 유럽특허법 체제를 분석하여 우리에게 주는 시사점과 교훈을 도출하고, 이를 기초로 우리나라 특허법 체제가 나아가야할 방향을 위한 법리의 개발과 실무의 운영방향을 제시하였다. 이를 위해2018년 시행이 전망되는 유럽 차원의 단일특허와 통합특허법원을 집중분석하여, 2017년 초부터 시행되고 있는 우리나라의 관할집중 제도에서 수용가능한 부분과 개선해 나가야 할 방향을 탐구하였다. 무엇보다 우리 나라 개정법(민사소송법)이 추구한 관할집중의 노력에도 불구하고, 관할 집중에서 빠뜨린 가처분제도로 인하여 서울중앙지방법원과 서울고등법원으로 본안인 침해사건이 범람하는 현상을 타개 내지는 완화시킬 수 있는 방안을 제시하였다. 이를 위해 서울중앙지방법원의 중복관할을 당사자가 합의한 경우로 제한하고, 가처분항고 관할을 특허법원으로 이관시키는 내용의 법개정을 제안하였다. 나아가 유럽연합 제도에 대한 비교법적 고찰을 통하여 한국과 중국, 그리고 일본을 포함한 3국간 지식재산제도의 협력적 제도 방안으로 절차법적 통일을 넘어 실체법적 통일로 나아갈 수 있는 가능성을 검토하였다.
