(형사)공공변호인 제도의 바람직한 운영 방안에 대한 소고 = A brief study on the desirable management method of public defender system in Korea (criminal)

다국어 초록 (Multilingual Abstract)

The legal structure system that is most necessary, efficient, and suitable in Korea is to integrate the existing legal system, which is divided into several branches. In other words, it is desirable that the lawyer’s association of the criminal public defender and the local lawyer’s council act as the subject and operate the criminal public defender system, and the court and the Ministry of Justice should properly participate and monitor it. Specifically, a special corporation should be created by joint investment of lawyer groups, administrations and the judiciary, and should be integrated to handle all kinds of civil defense, (public) defense affairs, including criminal public defenders discussed at present. In addition, the actual subject of the operation is entrusted to the lawyers’ organizations such as the Korean War, and it is very important for the court and the Justice Ministry personnel to be appointed as directors and committee members to take appropriate management and supervision. In the form of operation, they have a dedicated lawyer as a representative attorney and full-time employee of a resident corporation in connection with the local lawyers of each level, while the percentage of cases they handle is less than 30% of the total counseling service (50% In the case of the rest of the cases, it would be appropriate to have a “Public defender Lawyer Selection Committee” within the legal entity, to select a general lawyer as a counsel for the court and to operate them harmoniously. Also, in the early stage of establishing and operating a corporation (3 to 5 years), until the organization and operation are institutionally stabilized, all the funds necessary for its operation should be borne by the government in principle.

국문 초록 (Abstract)

지금 우리나라에서 가장 필요하고 효율적이면서도 적합한 법률구조시스템은 현행 여러 갈래로 분산되어 있는 법률구조제도를 한군데로 통합 운영하는 것이라고 하겠다. 즉, 형사공공변호인의 운영주체로 대한변호사협회나 각 지방변호사회가 주체가 되어 형사공공 변호인제도를 운영하되, 여기에 법원과 법무부가 적절히 균형 있게 참여와 감시를 하는 것이 바람직하다. 구체적으로는 변호사단체와 행정부, 사법부의 공동 금액출자에 의한 특수법인을 설립하여, 현재 논의되는 형사공공변호인을 비롯한 상존하는 모든 종류의 국선(공공) 변호업무를 전담하도록 통합하여야 한다. 그리고, 그 운영의 실질적 주체는 대한변협 등 변호사단체에게 맡기되 법원과 법무부 측 인사도 이사나 위원 등으로 선임하여 적절한 관리와 감독을 담당하도록 함이 상당하다. 운영 형식은 각급 지방변호사와 연계하여 구조법인 소속 대표변호사와 상근 직원으로서 전담변호사를 두는 한편, 그들이 처리하는 사건의 비율은 전체 국선변호 업무의 약 30% 이하(시행 후 상황에 따라 점진적으로 50% 이상 확대될 수도 있을 것이다)선에서 일단 맡도록 하고, 나머지 사건의 경우 구조법인 내 가칭 ‘국선변호사선정위원회’를 두어 그 위원회에서 일반 개업변호사를 국선변호인으로 선정하여 상호 조화롭게 운용하는 방안이 타당하다. 또한 법인의 설립과 운영초기(3년에서 5년 정도)에는 조직과 운영이 제도적으로 안정될 때까지는 그 운영에 필요한 자금을 원칙적으로 모두 국가의 부담으로 해야 할 것이다.
