사회관계가 변화하고, 사회의 구성이 다변화됨에 따라 신체적 조건에 구애 받지 않고 이용할 수 있는 시설들에 대한 요구가 점차 커지고 있다. 더욱이 우리나라를 비롯하여 전세계적으로 노령화는 공동체의 인프라 전체에 대한 변화를 요구하고 있다.
독일은 2002년부터 배리어프리라는 컨셉트와 이에 따른 일련의 정책들을 만들어 정보접근권과 함께 물리적 건축물에 대한 접근권을 보장하기 위한 제도들을 정비해가고 있다. 물론 이러한 정책은 상당히 늦은 시기에 개시되었으며, 상당히 더디게 발전하고 있지만, 정책의 지속가능성을 고려해본다면, 우리에게도 참고가 될 수 있는 부분들을 찾을 수 있다. 무엇보다 그들이 장애인의 접근권이라는 전문적인 영역에서 발휘하고 있는 제도화의 기술을 연구해본다면, 우리의 제도운영과 새로운 정책과 제도개발에 유용한 참고자료가 될 것이다.
본 논문에서는 독일 건축법상의 배리어프리(Barrierefreiheit) 컨셉트와 이를 구체화하는 여러 법령들을 살펴보고, 그것들이 어떠한 방법으로 실현되고 있는지에 대해 보도록 하겠다. 다만, 단지 조문분석을 통한 제도연구에 머물지 않도록 실천적인 측면에서 제기되는 여러 가지 비판들에 대해서도 보고, 독일에서 시행되고 있는 정책과 제도가 가지는 장점과 단점을 우리에게 주는 시사점을 중심으로 제시해보고자 한다.

다국어 초록 (Multilingual Abstract)

This Paper deals with the emergence of barrier-free concepts in Germany and their development aspect. With the ratification of the UN Convention on the Rights of Persons with Disabilities, Germany establishes “barrier-free” as a fundamental concept of accessibility. The concept has been included in diverse laws and regulations, and the concept is also used as a principle to ensure access to and use of buildings. However, the concept of barrier-free is quite abstract that it cannot be easily concretize, furthermore it is also difficult to implement it in the short term. Some states in Germany oblige the building owner to comply with the standards of the DIN Standards for barrier-free facilities. These are to overcome the rigidity of the legislative reactions and to make measures conform to social change and technological development.
In spite of these improvements, the concept cannot be highly evaluated from a practical standpoint. Some of the problems awaiting solution, for instance, is that the German administrative offices are not actively implementing the system into practice; it is also very difficult for individuals with disabilities or their representatives to file civil lawsuits against the owner. Therefore, it is required to take heed not only to the features of the German system, but the changes and adaptation.
