[논단] 헌재 2010.5.27. 선고, 2005헌마346 전원재판부 결정내의 인간배아 발생의 자연과학적 인식에 대한 비판적 고찰 = A Critical Analysis of the Natural Scientific Perception of Human Embryo Development in a Constitutional Court Decision on May 27, 2010: Case no. 2005 heonma 346

다국어 초록 (Multilingual Abstract)

A constitutional court decision on May 27, 2010, case no. 2005 heonma 346 (hereafter, 2005heonma346), defined that the human embryo is not entitled to fundamental rights, and thus cannot have the right to life. There are a number of questions on the reasons presented in 2005heonma346 that deny the human embryo's subjectivity to fundamental rights. Among these reasons, the present paper analyzes the various arguments and perspectives implied in the natural scientific perception level related to the status of the human embryo. From the scientific perspective, the beginning of life represents the beginning of the individual. However, the reason for “individual continuity” in 2005heonma346 places a greater weight on the viewpoint of the object, which has a relative value that can be used to achieve a certain purpose, rather than a scientific perspective of the human embryo that exists as a human organism. Thus, it appears that 2005heonma346 resulted in a distorted decision on the status of the human embryo.

국문 초록 (Abstract)

헌법재판소 2010. 5. 27. 2005헌마346 전원재판부 결정(이하 헌재 2005헌마346 결정)은 배아의 기본권 주체성을 부정하였다. 이 결정에서 배아의 기본권 주체성을 부정하기 위해 제시된 논거에는 여러 가지 의문점이 제기된다. 그 가운데 본 논문은 헌재 2005헌마346 결정에서 배아의 지위와 관련된 자연과학적 인식 수준에 함의된 여러 논의와 관점을 분석한다. 과학적 관점에서 생명의 시작과 개체의 시작은 분리되지 않는다. 그러나 헌재 2005헌마346 결정의 ‘개체적 연속성’의 논거는 인간 생명체로서 존재하는 배아에 대한 자연과학적 관점이라기보다는, 배아의 존재를 어떤 특정 목적을 달성을 위해 사용될 수 있는 상대적 가치를 가진 대상적 관점에 더 큰 무게를 둔다. 따라서 헌재 2005헌마346 결정은 인간 배아의 지위에 대한 왜곡된 결론에 도달한 것으로 보인다.
