미국의 기독법학연구 동향에 대한 고찰 = A Study on the Current Status of Christian Legal Scholarship in the United States

국문 초록 (Abstract)

이 글에서는 미국 내에서의 법과 기독교간의 관계를 연구하는 ‘기독법학연구’(Christian Legal Scholarship)의 현황을 주체, 분야, 쟁점으로 나누어서 고찰하였다. 주체에서는 학교와 단체로 나누어서 기독법학연구를 수행하고 있는 인물들을 살펴보았고, 분야에서는 1) 자연법과 국제인권법, 2) 법실무와 법조윤리, 3) 종교의 자유와 교회-국가간의 관계, 4) 법사학 등 네 가지로 나누어서 검토하였고, 쟁점에서는 1) 신학에 대한 시각, 2) 사랑의 계명에 대한 시각, 3) 인권에 대한 시각 등 세 가지로 나누어서 살펴 보았다.
미국에는 다양한 기독교종파들이 존재하고 각기 다른 신학적인 배경을 바탕으로 한 다양한 법학연구가 이루어지고 있음을 볼 수 있다. 예를 들어 자연법 분야의 경우 가톨릭의 영향이 크며, 법실무나 법조윤리 분야의 경우 애나뱁티즘(Anabaptism)의 영향이 크다. 그러나 종파의 차이를 벗어나 공통점을 토대로 기독교법사상을 구축하려는 시도 역시 이루어지고 있다. 가톨릭의 자연법사상과 칼뱅주의의 일반은혜론, 가톨릭의 보충성의 원리와 칼뱅주의의 영역주권이론의 공통점을 찾으려는 시도가 그러한 것이라고 할 수 있다.
미국 내 기독법학연구의 현황은 우리나라에 다음과 같이 여러 시사점을 제공해준다. 첫째, 가톨릭과 개신교, 칼뱅주의, 루터주의, 애나뱁티즘 등 다양한 기독교 종파들의 법에 대한 접근을 종합적으로 볼 필요가 있다. 둘째, 성경의 법(biblical Law)을 중시하되, 이것의 해석, 그리고 현대사회에 적용을 하는 과정에서는 매우 신중할 필요가 있다. 셋째, 종교의 자유가 점차로 제한되고 있는 미국의 상황은 우리나라가 반면교사로 삼을 부분이라고 할 수 있다. 넷째, 낙태나 동성애 문제에 있어서 기독법학계내에서 다양한 목소리가 소개되고 토론될 필요가 있다. 다섯째, 자유주의, 공화주의, 입헌주의, 공동선 등 일반 정치철학에서 논의되는 개념들을 적절하게 활용하는 것도 필요하다. 여섯째, 기독법학연구는 기독신앙을 가지고 있는 법률실무가들에게도 의미를 부여할 수 있어야 한다. 일곱째, 기독법학연구는 교회분쟁이 적법절차에 의해 해결됨으로써 교회가 교회다워지는 데에 기여하는 것도 필요하다. 여덟째, 법이 갖는 근본적인 한계에 대해서 인식하면서 기독법학연구에 임할 필요가 있다.

다국어 초록 (Multilingual Abstract)

This paper reviews the current status of Christian Legal Scholarship (CLS) in the United States (US) in respect of subjects, fields, and issues. In subjects of CLS, this paper sees the scholars or legal practitioners in law school or legal organization. In fields of CLS, this paper reviews 1) natural law and international human rights law, 2) lawyering and legal ethic, 3) freedom of religion and Church-State relationship, and 4) legal history. In issues of CLS, this paper deals with Christian legal scholar’s different perspectives on 1) theology, 2) command of biblical love, and 3) human right.
There are many Christian denominations in US, and various legal researches are conducted based on various theological perspective. For instance, natural law area is heavily influenced by Catholic theology, Anabaptism is dominant in lawyering and legal ethic field. However, ecumenical approach to link various Christian traditions can be also found. Typical example of this approach connects 1) Catholic natural law theory and Calvinistic common law theology and 2) Catholic principle of subsidiarity and Calvinistic sphere sovereignty theory.
The current status of CLS in the US shows many implications to Korea. First, it is necessary to comprehensively see how the various denominations such as Catholic, Calvinism, Lutheran, and Anabaptism approaches law. Second, the importance of biblical law can not be exaggerated, but it should be very cautious in its interpretation and application to comtemporary world. Third, ongoing tendency of restricting freedom of religion in US should be critically evaluated. Fourth, various voices on abortion and same-sex issues should be more prudently discussed among Christian legal scholars in Korea. Fifth, it is meaningful to use common language such as liberalism, republicanism, constitutionalism and common good. Sixth, CLS should give meaning to Christian legal practitioners. Seventh, CLS should contribute to recover the true identity of church by resolving church disputes in due process. Eights, it is important to see the limitation of law in CLS.
