보이스피싱에 대한 경찰의 대응 방안 = Countermeasures of the Police to Voice Phishing

국문 초록 (Abstract)

경찰은 보이스피싱에 강력하게 대응하고 있으나 보이스피싱은 계속 발생하고 있다. 따라서 다음과같은 경찰의 대응 방안이 요구된다. 첫째, 악성앱 분석을 담당하는 경찰관을 추가로 확보하고 전국경찰관을 대상으로 악성앱 차단원리와 효과를 알려야 한다. 둘째, 보이스피싱을 방지하기 위한 컨트롤타워가 필요하고, 현금 인출 시 출금 이유를 확인하는데 피해자가 거부하면 경찰관직무집행법 제6조를적극 활용하여 제지해야 한다. 셋째, 보이스피싱 담당 인력보강과 대응 매뉴얼을 개선하고, 보이스피싱공익신고를 법제화하여야 한다. 넷째, 현금인출기 주변에 해상도가 높은 CCTV의 의무적인 설치와지능형 CCTV의 확대가 요구된다. 다섯째, 외국경찰에 대한 포상금 제도를 실시하고 코리안데스크와같은 사무소를 신설하거나 수사관 상호파견 제도를 도입하여야 한다. 여섯째, 국제공조체계를 강화하여보이스피싱 총책을 검거하는 일에 중점을 두고 보이스피싱에 대한 구체적인 정보교류와 현장수사협조체계를 구축해야 한다. 일곱째, 선제적으로 대포통장과 대포폰 단속을 강화하고 온라인 구직광고를수시로 파악하여 보이스피싱 발생을 예방하여야 한다. 여덟째, 웹스크래핑 기술을 통해 온라인 상에공개되어 있는 금융회사의 지점정보를 자동 수집하고, 해당 지점들의 중심지를 파악하여 인출책의근거지 추정에 사용될 수 있는 정보를 제공할 수 있다. 아홉째, 보이스피싱을 통신비밀보호법 상의감청대상 범죄로 지정해야 하고 보이스피싱 피해신고 접수 시 영장 없이 은행계좌 추적이 가능하도록하고 즉시 사후에 영장을 청구하여 발부 받는 제도적 보완이 필요하다.

The police is responding strongly to voice phishing, but voice phishing continues to occur. Countermeasures of the police to voice phishing are as follows. First, are is necessary to secure a police officer in charge of analyzing malicious apps. Second, when withdrawing cash, if the reason for withdrawal is refused, it must be stopped through Article 6 of the Police Officer Duty Execution Act. Third, the voice phishing response manual should be improved and the voice phishing public interest report should be legislated.
Fourth, the mandatory installation of high-resolution CCTVs around ATMs and the expansion of intelligent CCTVs are required. Fifth, a reward system for foreign police should be implemented and a system for mutual dispatch of investigators should be introduced. Sixth, the international investigation cooperation system should be strengthened and a specific information exchange on voice phishing as well as a cooperative system should be established. Seventh, enforcement of cannon bankbooks, cannon phones and online job search advertisements should be checked frequently. Eighth, Through web scraping technology, it is possible to automatically collect branch information of financial companies and to estimate the base of withdrawal books by identifying the centers of the branches. Ninth, Voice phishing should be designated as a crime subject to wiretapping, and institutional supplementation is needed to enable tracking of bank accounts without a warrant when a voice phishing damage report is received.
