심리상담의 법･제도화를 위한 사전 입법영향분석 - 심리상담 인력의 자격기준 규정을 중심으로 - = An ex-ante assessment on legislation of national qualification certificate for psychological counselors

국문 초록 (Abstract)

최근 국민의 정신건강 증진을 위한 비의료 심리상담 서비스에 대한 수요가 증대되고 있으나 자격에 대한 공적 관리･감독 체제의 부재로 인해 성범죄 등 각종 사회문제가 발생하고 있다. 이에 대응하기 위해 제21대 국회에 제출된 심리상담 국가 자격화 관련 5개 법률안에 대한 사전 입법영향분석을 통해 최적의 입법대안을 도출하고자 하였다.
사전 입법영향분석으로, 입법의 필요성과 입법목적의 정책적 실현 가능성을 검토하는 ‘연관성’, 입법안의 내적 정합성 및 타법과의 접합성을 살펴보는 ‘일관성’, 입법의 수용가 능성을 검토하는 ‘지속가능성’ 등 3가지 기준을 적용하였다.
분석 결과, 자격증 등급(1급, 2급) 구분, 자격 영역 세분화, 전문성 요건 명시, 자격심의 관련 협의체 설치(이상 연관성 분석), 국가직무능력표준(NCS) 기반 업무 범위 정의, 심리상담으로 명칭 통합(이상 일관성 분석), 자격기준 범위 확대 및 서비스 내용과의 명확한 연계, 자격부여 특례(이상 지속가능성 분석) 등을 통합 입법대안으로 제시하였다.
결국, 입법을 통한 심리상담의 전문직화는 국민의 정신건강 증진 등 공익을 최우선시하고 서비스의 공백을 최소화하며 전문성과 역량을 갖춘 심리상담사만이 심리상담 서비스를 제공할 수 있는 방식으로 진행되어야 할 것이다.

다국어 초록 (Multilingual Abstract)

Despite that the public's need for non-medical psychological counseling services has been increasing, various social problems are occurring due to the absence of a public management and supervision system for psychological counselor qualifications. To tackle this problem, we attempted to derive the optimal legislative alternative through an ex-ante assessment of five bills related to the national qualification of psycholo-gical counseling submitted to the 21st National Assembly.
An ex-ante assessment is conducted based on its definition and main procedures, involving three criteria: (1) ‘relevance’, which examines the necessity of legislation and the possibility of achieving the legislative purpose, (2) ‘consistency’, which examines the internal consistency of the legislation and its adhesion with other laws, and (3) ‘sustainability’, which examines acceptability of the legislation.
Our study derived an optimal integrated legislative plan for a stable and sustainable system for qualified psychological counselors. We suggested that the professionalization of psychological counseling through legislation should be carried out in a way that prioritizes public interest, such as improving the mental health of the people, minimizing service gaps, and granting exclusive rights to psychological counselors with expertise and capabilities.
