지방화 시대의 issue : 지방자치단체간 공공분쟁의 발생원인 : 평택항 공유수면 매립에 따른 분쟁 사례를 중심으로 = The Reasons for a Public Dispute between Local Self-governments: A Case in Pyeongtaek Port

국문 초록 (Abstract)

본 연구는 '평택항 공유수면 매립에 따른 분쟁 사례'를 중심으로 지방자치단체간 공공분쟁의 발생 원인이 무엇인가를 분석함으로써 향후 유사한 분쟁이 발생하는 것을 예방하고 분쟁이 발생했을 경우 이를 관리하고 합리적으로 해결하는 데 있어 유용한 시사점을 제공하는 것을 목적으로 하고 있다. 본 사례를 분석한 결과 분쟁이 발생하게 된 원인으로는 첫째, 지자체간 상호의존성 증대, 둘째, 지역이기주의, 셋째, 지자체간 관계에 관한 법령과 규정, 특히 공유수면 매립과 매립지, 그리고 해상경계선에 관한 법령과 규정의 미비라고 할 수 있다. 공유수면 매립지의 귀속과 관할권 문제를 포함하여 해상경계선과 관련된 공공분쟁을 예방하기 위해서는 지자체의 해역관할 범위를 명확히 하는 등 법과 제도를 정비하는 것이 시급한 과제라고 할 수 있다. 특히 지자체간 경계획정 관련 분쟁해결 절차를 1차적으로 행정적 수단에 의해서 해결할 수 있도록 절차를 간소화하는 등의 법률 개정 및 제도적 보완이 이루어져야 할 것이다.

다국어 초록 (Multilingual Abstract)

This paper is to gain an insight into any similar local disputes by analyzing the causes of dispute between local self-government that is symbolized in the dispute case of the public waters reclaimed land in Pyongtaek Port. The case analysis allows the researcher to specify possible causes of the disputes; increased mutual dependence between local self-governments, localism, loopholes in rules and regulations on the relationship between local governments about particularly public waters reclamation and public waters reclaimed land, and maritime border. Due to geographical conditions, Korean government keep carrying out public waters reclamation in order to ensure social overhead capital such as ports and industry and agricultural complex. Therefore, it is an urgent task to prepare laws and regulations that clarify the jurisdictions of local self-government in order to prevent public dispute concerning the public waters reclaimed land. It is necessary to prepare a dispute resolution mechanism for demarcation between local governments that rely on an administrative approach with a plain procedure instead of a lawsuit.
