국제스포츠중재재판소(CAS)에 비추어 본 한국스포츠중재위원회(KSAC)의역할과 과제 = Roles and Problems of the Korea Sports Arbitration Committee (KSAC) comparing with the International Court of Arbitration for Sport (CAS)

다국어 초록 (Multilingual Abstract)

In this paper, I want to watch an establishment background and activities of the International Court of Arbitration for Sport (CAS) and am going to show activation plan of Korea Sports Arbitration Committee (KSAC), which was established in 2006.
A dispute solution system came to do recognition to be important while experiencing a disadvantage by international sports dispute case, and several kinds people in charge of Korea sports get up for last ten years. The sports disputes are various, It can be settled in legal suit by laws and ordinances not to mention a dispute for the qualification of the player, judgment call, the doping, but economic burden is terrible, and the loss time equivalency is big.
In addition, I raised the phase of the Korea sports arbitration committee and emphasized a point that it was necessary to prescribe legal grounds for the activation of the sports dispute solution definitely. I think that it is desirable most to prescribe the setting grounds of the appliance for sports dispute solution while 'Basic Law for National Sports' is established as soon as possible. This Law will provide for the basic sports rights, duties of the government and the local government, guidelines of the promotion for sports industry, international sports cooperation and sports dispute resolution system.
The introduction plan of the 'Med-Arbitration' system that could be worse by a procedure of arbitration at the same time was reflected, and I did that it revised the associated law so that international Court of Arbitration for Sport (CAS) had exclusive belonging jurisdiction in a model, and the reform of such a system consisted of 1990's. The reason is because it prescribes it when "Olympics game or all disputes must propose the solution to CAS by sports arbitration rule" to Olympic Charter Article 59 of International Olympic Committee, and it recognizes exclusive belonging monopoly jurisdiction on CAS. It has to be careful to accept jurisdiction under contract to the CAS in most International Sports Federation rules at time of the dispute outbreak.
On the other hand, I would like to raise the phase of the Korea sports arbitration committee, and clearer legal backgrounds come to emphasize a point that it is necessary for the activation of the sports dispute resolution.

국문 초록 (Abstract)

이 글에서는 국제스포츠중재재판소(CAS)의 설립배경과 활동내용을 살펴보고, 한국스포츠중재위원회(KSAC)의 활성화방안을 제시하여 보고자 한다. 지난 10년간 한국스포츠계는 몇 가지 국제스포츠분쟁사건에서 불이익을 경험하면서 분쟁해결기구가 중요하다는 인식을 하게 되었다. 스포츠분쟁은 다양하게 일어난다. 국제경기대회의 출전정지 등의 처분에 불복하는 경우도 있다. 선수의 자격, 심판의 판정, 도핑 등에 대한 분쟁은 물론 법령에 의한 법률상의 쟁송으로 해결할 수 있지만, 시간적 상당한 손실이 따르고 경제적인 부담도 대단히 크다.스포츠분야의 분쟁해결은 다른 분야보다도 신속성과 전문성이 요구된다. 한국스포츠중재위원회가 출범한지 불과 2년도 채 되지 못했기 때문에 아직 활동이 미흡한 실정이다. 이 분야의 특수성을 감안하여 일반적인 당사자 합의에 의한 중재제도의 한계를 극복할 수 있는 제도적인 보완이 시급히 요청되고 있다. 이글에서는 특히, 조정(Mediation)제도를 적극적으로 활용하여 당사자의 중재합의의 어려움을 극복하는 방안, 대한체육회의 정관과 산하 단체 및 가맹경기단체의 규정을 수정·보완하여 중재합의가 없어도 분쟁해결을 위한 신청을 할 수 있는 방안, 조정(Mediation)·중재(Arbitration)의 절차를 동시에 진행할 수 있는 'Med-Arbitration'제도의 도입방안 등을 제시하였다. 또한 한국스포츠중재위원회의 위상을 높이고, 스포츠분쟁해결의 활성화를 위해서는 법적인 근거를 명확히 규정할 필요가 있다는 점을 강조하였다. <국민체육기본법>이 하루속히 제정되어 이 법 속에 스포츠기본권에 관한 사항, 정부와 지방자치단체의 책무, 스포츠산업진흥과 스포츠육성을 위한 기본지침, 스포츠와 국제협력 등을 규율하면서 스포츠분쟁해결을 위한 기구의 설치근거를 규정하는 것이 가장 바람직하다고 생각한다.
