대학 인권센터 규정의 편파 적용 방지를 위한 개정 제안 : 7개 선도 대학을 중심으로 = Amendment Proposal to University Human Rights Center Regulations : A Case Study from Seven Leading Universities

국문 초록 (Abstract)

본 연구는 교육부 선정 7개 선도 모델 개발 시범대학의 인권센터 규정 중에서 사건 심의 결과에 지대한 영향을 미치는 인권센터장과 인권위원회 위원 및 구성 관련 규정을 검토한다. 그 결과 관련 규정이 교수 가해자의 위력에 의한 성희롱･성폭력 등 인권침해 사건을 다루는 데 있어 많은 경우 가해자 교수에 편파적인 절차와 결정을 용인할 수 있는 결함이 있음을 지적한다. 인권센터의 심의 결과는 다른 비사법적 구제를 대체하기 때문에 매우 중요하고, 위력에 의한 인권침해가 빈번하게 일어나는 대학에서 인권센터가 위력을 지닌 가해자를 비호하는 것은 피해자에게 2차 피해로 작용할 수 있다. 이에 본고는 인권센터 규정에 인권센터장 및 인권위원들의 임명 조건에 인권 및 성인지 감수성을 담보할 수 있는 자격 요건 또는 인권교육을 추가하고, 한쪽 성의 위원과 내부위원의 수가 의결정족수를 넘지 못하도록 하고, 위원의 회피･제척･기피 조항의 실효성을 개선할 것을 제안한다.

다국어 초록 (Multilingual Abstract)

This study examines head and committee norms of human rights center at seven leading universities in Korea. These members of the human rights center have a profound impact on rulings on on-campus human rights violations including sexual harassment and sexual assault. It will be shown that relevant regulations are not fully prepared to meet the demand of having the appropriate head and committee of the human rights center, which may not prevent them from leading to biased procedures and decisions in favor of powerful perpetrators. At the universities where professor-on-student harassments often occur, the human rights center's protection of authoritative faculty harassers would cause secondary damage to victims. Accordingly, this study proposes an amendment to the regulations to require university human rights centers to function objectively as follows; (i) the qualification of the head and committee members must be clearly stated in the regulation to ensure that those who are expert in and sensitive to human rights and gender-based violence are appointed; (ii) the number of the members of the same gender and internal committee members cannot exceed the number of members required to make decisions; and (iii) clauses have to be revised so that inappropriate committee members can successfully be avoided, excluded and rejected.
