중국 노동통제의 정치학: 실업의 관리 방식 및 효과

This essay aims at understanding on the characteristics of Chinese state's labor control. To observe it shared the control with ideological, organizational and legal control under the changed political condition with reform policy.
First of all, it searches the legitimacy of the Party-State from economic growth, it solves a political problem with economic means, the reform ideology emphasizes the inevitable characteristic of reform and the sacrifice of the work for an economic development with the fact that it is inevitable and it leads it is going out. This process is not the democracy process which becomes accomplished in agreement of state-society, it's rather than the one sided accommodating of the reform ideology. The trade union as ever is not a possibility of escaping from the manual location only it will not be able to recognize governing of efficient discussion, the subordination with the political power of existing shows against a market power cannot be free cannot easily.
The State's organizational control against the labor will be able to understand with reorganization process of labor relationship as political cognitive process. Specially the legitimate position of market reform and private right of property is recognized, the State has the necessity which will intervene to the relationship of labor with new system reorganization is augmented. It has two branch objective. One is the State has effect with the reproduction of economic structure simultaneously and with to create a market reconciliation condition. Also one aim gives a power in the trade union, which maintains a political stability and to prevent the appearance of alternative political power. Also it encourages the appearance of the intermediate organization which can absorb various social demand to maintain the organizational control. Consequently the organizational activity has the depolitical and declassical characteristics, the Chinese trade union give oneself it was confined in position history task to solve the problem as social stratum harmony or market economy.
Also under the proposition of development, Chinese State solve the political problem through a 'legal developmental' perspectives. That is, only the legal construction is the precondition which is bring the development for China. In this side, the institutionization of China is aiming the stable social integration for a national construction, it attains the aim of development. But institution is frequently the cause of development, but not the result. The reorganization intention of the state control which leads the institution is containing a teleology sense of value.
The growth and activity of social territory is not confront against the State, it embedded with the State in China. Specially the State rears a social organization and system and it controls the relationship structure of the state and the society. In China, the place where the systems of the form which is various connects the state and the society exist, it means but simultaneously it strengthens the flexibility of the state, it provides the expansion of social movement. In other words, the variety of Chinese social organization simultaneously means magnifies of the state flexibility. In this process, Chinese state put the political effect which disperses the social resistance with a reform.

국문 초록 (Abstract)

이 글에서는 개혁정책으로 변화된 정치적 조건하에서의 국가의 노동에 대한 통제를 이데올로기적 통제, 조직적 통제, 법적 통제로 나누어 살펴보았다.
우선 당-국가의 합법성을 경제적 성장에서 찾고, 경제적 수단으로 정치적 문제를 해결하고자 하면서 등장한 개혁이데올로기는 개혁의 필연성을 강조하면서 경제발전을 위한 노동의 희생을 불가피한 것으로 이끌어나가고 있다. 이러한 과정은 국가-사회 간의 합의로 이루어진 민주적 과정이라기보다는 국제적 규범과 경제우선논리를 앞세운 개혁이데올로기의 일방적 수용을 강요하고 있다. 이 때문에 국유기업에 대한 구조조정으로 노조간부가 국가간부라는 신분적 제약에서 벗어나 기존의 통제의 틀을 깨고 완벽한 노동자의 조직으로 변신할 수 있는 기회가 주어졌음에도 불구하고, 노조는 여전히 효율담론의 지배를 인정할 수 밖에 없는 수동적 위치에서 벗어날 수 없었으며, 이는 기존의 국가권력에 대한 종속이 시장권력에 대해서도 쉽게 자유롭지 못함을 보여준다.
국가의 노동에 대한 조직적 통제는 정치적인 과정으로서의 노동관계의 재편성과정으로 이해할 수 있다. 특히 시장화개혁과 사적 재산권의 합법적 지위가 인정되고 생산의 영역이 탈국가화 됨에 따라 국가는 새로운 조직재편으로 노동관계에 개입할 필요성이 증대하게 된다. 이는 두 가지 목적을 갖는다. 하나는 시장화되는 새로운 조건에서 여전히 경제를 국가의 통제하에 두고자 함과 동시에 국가가 경제구조의 재생산에 영향을 미침으로써 시장화의 조건을 창출해가는 것을 목표로 한다. 또 하나의 목표는 기존의 군중조직인 노조에게 일정한 기능을 부여함으로써 노동계급의 이탈을 막아 정치적 안정을 유지하고 새로운 대안 정치세력으로서의 노동조직의 출현을 방지하는 것이다. 또한 사회에 대한 관리에 유리한 다양한 중간조직의 등장을 독려하여 시장경제발전과 다양해진 사회적 요구를 흡수할 수 있는 조직적 통제를 유지하는 것이다. 따라서 발전과 부강이라는 뚜렷한 근대적 목표를 가진 국가에 의해 규정되는 조직의 활동은 탈정치적이고 탈계급적인 성격을 띠면서, 중국 노조는 사회 계층간의 조화나 혹은 시장경제의 문제를 해결하기 위한 주어진 ‘역사적’ 임무에 스스로 갇히게 되었다.
또한 발전이라는 명제 하에 중국에서는 정치적인 문제를 ‘제도발전’이라는 시각에서 풀어나가려 한다. 즉 전환기 중국 정치의 가장 큰 문제점은 시장경제로의 전환이라는 거대한 변화에 제도적인 뒷받침이 결여되었기 때문이고, 따라서 제도건설만이 중국의 발전을 가져올 수 있는 전제조건이라 굳게 믿고, 노동관계에도 일정한 규칙성을 부여하려 한다. 이러한 측면에서 중국의 제도화는 국가건설을 위한 안정적 사회통합을 지향하고 있으며, 발전의 목표를 달성하기 위한 해법으로 인식되고 있다. 그러나 제도는 흔히 발전의 원인이라기 보다는 그 결과이다. 중국의 제도를 통한 국가 통제의 재편 의도는 이러한 측면에서 목적론적 가치관을 내포하고 있다.
중국에서 사회적 영역의 성장과 활동은 국가에 대응하여 나타나는 것이 아니라, 국가와 연접하여 나타난다. 특히 국가는 사회 조직 및 제 세력을 육성하고 국가와 사회의 관계 구조를 조절함으로써 국가 자체를 합법화하고 보호한다. 중국에서는 국가와 사회의 영역을 잇는 다양한 형태의 조직들이 존재하는데
