사회복지시설 생활인 인권에 대한 성과와 과제 = Results and Questions for the Human Rights of Inhabitants in Social Welfare Facilities

국문 초록 (Abstract)

사회복지생활시설 생활인에 대한 인권침해는 사회구성원들의 침묵의 카르텔 속에 매우 심각한 상황에 있으며, 지속적이며 반복적인 특성을 보이고 있다. 이러한 상황에서 시설생활인들은 스스로를 무기력하고 무가치한 존재로 인식하는 시설증후증 현상을 보이고 있을 뿐만 아니라 또한 강요받고 있다. 그 동안 국가인권위원회는 시설생활인의 인권보호에 성과가 있은 것도 사실이지만 전체적으로 볼 때 진정에 대한 인용율이 지나치게 낮아 평가에 회의적이며 그 설립목적에 의문을 야기할 우려마저 없지 않다. 특히 미신고 사회복지시설에는 국가인권위원회의 조사권이 미치지 않는다는 잘못된 법률해석에 의하여 미신고사회복지시설에서의 인권침해에 대한 진정을음 모두 각하하고 장기간 사회문제로 되고 있는 미신고사회복지시설 양성화정책에 대한 어떠한 입법적·정책적 개선권고도 없이 침묵으로 일관하고 있는 것은 심각하게 비판되어야 할 대목이다. 한편 아무리 '좋은 시설'이라도 자기결정과 선택에 있어 인권침해의 가능성이 상존한다. 그럼에도 불구하고 국가의 사회복지시설정책은 수용중심의 시설정책으로 일관하고 있다. 그러나 이는 헌법이 예정하는 사회복지정책과 일치되지 않는다. 헌법이 전제하는 인간상은 사회복지서비스를 필요로 하는 사람들도 가능한한 완전한 사회참여를 통하여 사회공동체에 통합되어 있으면서도 또한 독립적인 인격이 유지될 수 있는 방향으로 사회복지정책이 전개될 것을 요구한다. 따라서 사회복지정책은 자립 생활의 지원과 지역사회에서의 재활을 통해 사회통합올 촉진하는 방향으로 전개되어야 한다. 이를 위하여 국가의 사회복지시설정책은 탈시설화정책음 중심으로 하여 헌법상 보충성의 원직에 의하여 사회복지시설에 의한 사회복지서비스가 불가피하게 요구되는 경우에도 시설생활인의 인권을 중시하는 소규모의 지역사회 개방형 시설로 정책을 전환되어야 한다. 한편 사회복지시설의 탈시설화는 이것 자체가 목적이 아니라 지역공동체 속에서 완전한 참여와 자립생활의 영위를 촉진하기 위한 하나의 정책에 지나지 않는다는 점을 분명히 할 필요가 있다. 탈시설화화를 통한 사회공동체의 참여와 자립생활의 촉진을 위해서는 물리라적 장벽제거, 대중교통이용의 편의, 통합교육, 정보공유와 의사소통, 직업사회영역의 진출 등 사회적 지원이 전제요건으로 갖추어져 있어야 한다.

다국어 초록 (Multilingual Abstract)

An violation of the inhabitants' rights of social welfare facilities is in serious conditions being left in cartel of silence made by members of a community, showing continual and repeated property. In these situations, facilities' inhabitants show facility syndrome considering themselves as spiritless and invaluable being, in addition to be forced. Although the National Human Rights Commission has been obtaining fruit of protecting the human rights of facilities' inhabitants, generally the citation ratio for petition is so low that it's skeptical for evaluation, and it might pose a question for the purpose of establishment. Especially, due to the wrong interpretation of law that the inspection right of National Human Rights Commission does not reach the unreported social welfare facilities, all the petitions for civil rights violation committed in an unreported facilities are rejected, furthermore, no recommendation for legislative and political improvement against legalization of unreported social welfare facilities that have been a social problem for long, have been issued as keeping silence, which should be seriously criticized. Meanwhile, no matter how 'good facility' is, it is only a community of those excluded from society (outsiders), and there is still the possibility of civil rights violation in self determination and selection. Nevertheless, national policy for social welfare facilities still remains centering on accommodation, which results in increasing continually social welfare facilities and its inhabitants. However, it does not consist with the social welfare policy intended by the constitution. The human image premised by constitution is not an isolated individual, but a character that realizes oneself inside community. Accordingly, the human image premised by constitution demands that the social welfare policy should be developed toward the way in which those who need social welfare service are able to participate in community wholly, integrated in community, and maintain their independent characters. It is also requested by national duty of securing human rights. Consequently, the social welfare policy should be developed into the direction promoting social integration through supporting independent life and rehabilitation in local community. For this, national policy for social welfare facilities should be transferred, centering on de facility policy, from the middle and large sized, and
closed type facilities that makes great account of accommodation even in case of demanding inevitably service from the social welfare facility, in accordance with the principle of supplementation of law, to the small sized local open facility that considers human rights of facilities' inhabitants important. Meanwhile, it's clear that de facility of social welfare facilities is nothing but a policy for promoting complete participation and independent life in local community, not an objective. In order to promote participation in community and independent life through de facility, social support should be prepared as a prerequisite, including removal of physical obstacle, convenience of public transportation, integrated education, sharing information and communication, and advance into the field of job community.
