설화 < 친자식보다 나은 양아들 >에 나타난 가장(家長)의 소외 문제와 주체성 회복의 과정

본고는 < 친자식보다 나은 양아들 > 설화 속 서사의 주체인 영감을 중심으로 가장이 소외되는 원인을 밝히고 그 해결과정을 확인해보고자 하였다. < 친자식보다 나은 양아들 >에서 가장은 타자에게 소외된 가장의 면모를 보이는데 이는 타자에게 자신의 삶을 의존하고 스스로를 소외시켰기 때문임을 알 수 있었다. 이에 설화 속 영감은 타자에 대한 의존성을 버리고 스스로의 주체성을 되찾으면서 소외당한 가장의 처지를 벗어나게된다. 본고에서는 < 친자식보다 나은 양아들 > 통해 딸보다 아들, 불효와 효,노후를 위해 재산은 반드시 끝가지 지키고 있어야 한다는 논의를 하고자하는 것이 아니다. 오늘날에도 가족 구성원들에 의해 소외된 가장이 많다는 점에서 이들의 상처를 치유할 수 있는 실마리를 설화를 통해 확인코자 한 것이다. 이에 < 친자식보다 나은 양아들 > 설화는 오늘날 소외된가장에게 자기 스스로를 돌아보는 시간이 필요함을 말하고 있으며, 스스로의 주체성을 찾고 스스로를 이해하고 사랑할 때 비로소 소외감에 의한상처가 회복 될 수 있을 것이라는 실마리를 제공하고 있다는 점에서 그의의가 있다 할 것이다. This article aims to find out what makes the head of family, the main character of the story < Adoptive son better than biological one > isolated and how to address the issue. The head of family in < Adoptive son better than biological one > reveals that he is rather isolated from others, which results from his tendency to rely on others and to choose to isolate himself. The old man in the folktale eventually escapes from his tendency of reliance and find his identify, thereby breaking free his pathetic circumstance of isolation. This article does not intend to discuss son preference, dutiful or undutiful, or to argue that one should keep his or her wealth for later years through < Adoptive son better than biological one >. Today, we see a lot of heads of family isolated from the rest of the members and try to find ways to properly address the issue and sooth their wound through the tale. As such, the tale < Adoptive son better than biological one > suggests isolated heads of family today have time to look back on himself and carries its significance in that it says understanding and loving oneself while finding his identify is the right way toward recovering from the would caused by a sense of alienation.

일본 기업지배구조 코드의 개정과 ESG

우리나라와 일본에서 서로 앞다투어 ESG 모범규준과 기업지배구조 코드(이하 ’CG 코드’라 한다)를 개정하며 ESG의 주된 내용을 담고 있다. 우리나라의 개정 ESG 모범규준은 2022년부터 KCGS의 ESG 평가 절차에 반영될 예정이다. 따라서 개정된 ESG 모범규준의 내용을 각 기업이 준수하기 위해서는 우선적으로 반영 가능하거나 필요한 내용을 선별하여 해당 사항을 내부 규정하는 등 대비할 필요가 있다. 일본의 CG 코드는 오늘날 세계적인 유행어가 되고 있는 이해관계자 자본주의의 요소를 선취한 것이다. 2021년 6월 11일에 발표된 CG 코드 재개정판은 ESG를 비롯한 지속가능성에 관한 내용을 대폭 보충하고 있다. 2021년판 CG 코드에서 크게 변경된 점은 (i) 이사회의 기능발휘, (ii) 기업 핵심인재의 다양성(diversity) 확보, (iii) 지속가능성(sustainability)(ESG 요소를 포함한 중장기적인 지속가능성)을 둘러싼 과제에 대한 대응의 3가지이다. 개정된 CG 코드의 실무상 대책으로 논의된 사항 중에서 우리나라 기업이 참고할 수 있는 몇 가지 점을 간력히 제시하면 다음과 같다. 우선, 이사회에 의한 지속가능 과제에 대한 대응이 필요하다. 구체적으로는 「기후 변동 등의 지구 환경 문제」, 「인권의 존중」, 「종업원의 건강」, 「노동 환경에의 배려」, 「공정·적절한 처우」, 「거래처와의 공정·적정한 거래」, 「자연재해 등에의 위기 관리」 등에 대한 대응이 필요해 보인다. 둘째, 지배구조체제의 정비가 이루어져야 할 것이다. 구체적으로는 이사회에서 실효적인 다양성을 확보할 필요가 있다. 여성임원을 적극적으로 확보할 필요도 있고, 스킬 매트릭스를 활용하여 이사 후보자들에 대한 정보를 주주에게 알릴 필요가 있다. ESG 경영을 위한 이사회에 의한 감독과 집행에 관한 체제도 정비할 필요가 있다. 셋째, ESG 경영을 실천하기 위하여 행위준칙·경영계획 등에 반영, 대처방침의 책정도 이루어져야 할 것이다. 특히, 인권보호를 중시하는 행위준칙 등의 마련은 2022년 1월 시행을 앞둔 중대재해처벌법에 대비하기 위해서도 당면과제라고 할 것이다. 공급망(supply-chain)의 관리를 위하여 인권 실사(Due Diligence)에 관한 절차규정을 마련하는 것도 필요하다. 넷째, 기업의 ESG 경영을 일반 투자자 등에게 알리기 위한 ESG 공시체제에 대한 정비도 필요해 보인다. 기업이 시장에서 정당한 평가를 받아 자금을 획득하기 위해서는 투자자에 대한 적절한 정보제공이 중요하기 때문이다. In Korea, ESG model standards were revised, and corporate governance codes (hereinafter referred to as ‘CG codes’) were revised in Japan. Both contain the main contents of ESG in the revision. Korea’s revised ESG model standards will be reflected in KCGS’s ESG evaluation process from 2022. Therefore, it is necessary for each company to prepare to comply with the revised ESG model standards. First of all, it is necessary to select the contents that can be reflected or necessary, and to internalize the relevant matters. Japan’s CG code preoccupies the elements of stakeholder capitalism, which is becoming a global buzzword today. The revised version of the CG code, released on June 11, 2021, greatly supplements ESG and other sustainability. There are three major changes in the 2021 CG code: (i) the function of the board of directors, (ii) securing diversity of corporate core talents, and (iii) responding to tasks surrounding sustainability (mid- to long-term sustainability including ESG elements). Among the matters discussed as practical measures for the revised CG code, some points that Korean companies can refer to are as follows. First of all, it is necessary to respond to sustainability tasks by the board of directors. Specifically, it seems necessary to respond to global environmental problems such as climate change, respect for human rights, health of employees, consideration for the working environment, fair and appropriate treatment, fair and appropriate transactions with customers, crisis management, etc. Second, the governance system should be reorganized. Specifically, it is necessary to secure effective diversity at the board of directors. It is necessary to actively secure female executives, and it is necessary to inform shareholders of information on the directors using the skill matrix. It is also necessary to reorganize the system for supervision and execution by the board of directors for ESG management. Third, in order to practice ESG management, it is necessary to reflect it in the rules of conduct and management plans and to establish countermeasure policies. In particular, the preparation of rules of conduct that value human rights protection is also a challenge to prepare for the Severe Disaster Punishment Act, which is set to take effect in January 2022. It is also necessary to establish procedural provisions for the due diligence on human rights to manage supply chains. Fourth, it seems necessary to reorganize the ESG disclosure system to inform general investors of the company’s ESG management. This is because it is important for companies to provide appropriate information to investors in order to obtain funds with fair evaluation in the market.

The objective of this study is to design the press forming process to prevent the tearing of the polymer laminated steel. The occurrence of PET tearing cannot predict using conventional forming limit diagram (FLD). Therefore, tearing limit diagram (TLD) of the polymer laminated steel was proposed to determine safe region without the tearing. Based on the concept of FLD, the tearing limit curve was established with the critical major and minor strains at which tearing occurred in various deformation modes. Based on the TLD, FE-analysis of a press forming process was conducted to find the forming condition without tearing. The validity of the press forming process was verified by forming experiment. The comparison between the FE-analysis and experimental results indicated that the TLD is efficient and suitable for the design of the press forming process of polymer laminated steel.

스팸메일에 관한 合理的인 規制方案

As the Internet becomes more congested with commercial advertisers, Internet users require additional protection. Spam-mail's widespread proliferation as a form of advertising, however, has caused problems within the Internet community. And the problems with Spam-mail(unsolicited and unwanted electronic mail) will not vanish with time. The costs that spam imposes on internet users and ISPs increase daily.<br/> This article has aimed "to protect users, Internet service providers and internet development itself from Spam-mail." In summary, I supposed 4th device for regulation about spam-mail. First, it requires that spam be labeled as such and include opt-out instructions. Second, it's necessary to be responsible to ISP for filtering Spam-mail. Third, it's needed revision of law to be liable for illegal capture or "harvest" addresses by using software packages. Finally, we prepared to cope with new stylish Spam-mail like as mobile-phone message.

현존재 분석과 실존 치료

M. 보스의 현존재 분석과 실존 치료, 특히 V. E. 프랑클의 로고테라피는 인간의 심리적 현상을 현상학적으로 파악하고 있다. 현상학적으로 파악한다는 것은 인간의 심리적 현상을 어떠한 선입견도 없이 파악한다는 것을 뜻하며, 후설의 선험적 현상학과 하이데거의 해석학적 현상학의 입장과 태도를 따른다는 것을 뜻한다. 이와 같은 보스와 프랑클의 기본적 입장과 태도는 S. 프로이트의 정신 분석을 수용하면서도 그의 자연과학적 입장과 태도를 따르지는 않으려는 것이다. 후설의 선험적 현상학은 데카르트 철학으로부터 칸트 철학을 거쳐 독일 관념론으로 이어지는 선험적 철학의 입장과 태도를 따르기는 하나, 인간의 근원을 선험적 주관성으로 파악하는 점에서 그 이전의 선험적 철학과 구별된다. 하이데거의 해석학적 현상학은 인간의 근원을 현존재로 파악하는 점에서 후설의 선험적 현상학과 구별된다. 선험적 현상학과 해석학적 현상학의 공통점은 선험적 차원을 인간의 일상적 삶이 비롯하는 근원으로 파악한다는 것이며, 선험적 현상학의 선험적 차원은 의식의 차원이고 해석학적 현상학의 선험적 차원은 존재의 차원이라는 점에서 두 현상학은 구별된다. 보스의 현존재 분석은 인간의 근원을 현존재로 파악하여 인간의 심리적 상황을 이해하고 해석하며, 상담자와 내담자 사이의 현상학적 해석학적 대화를 통해 심리적 상황이 드러내고 있는 존재의미를 내담자가 스스로 깨닫도록 함으로써 내담자를 치료한다. 프랑클의 로고테라피는 인간의 근원을 실존으로 파악하여 인간의 심리적 상황을 이해하고 해석하며, 지성요인적(noogenic) 신경증을 인간의 지적(noological) 차원에서 파악하여, 내담자가 삶에서 스스로 의미를 찾아 실존적 공허로부터 벗어나게 함으로써 내담자를 치료한다. 현존재 분석과 로고테라피의 공통점은 인간의 심리적 상황을 현상학에 의거하여 선험적 차원으로부터 인간에 걸맞게 이해하고 해석하려는 입장과 태도이지만, 현존재와 실존이 구별됨으로써 현존재 분석의 선험적 차원은 존재의 차원이고 로고테라피의 선험적 차원은 지적 차원이라는 점에서 두 심리치료는 구별된다. Die Daseinsanalyse von M. Boss und Existenztherapie, vor allem Logotherapie von V. E. Frankl verstehen paenomenologisch psychische Phaenomena. `paenomenologisch verstehen` bedeutet `ohne Vorurteil verstehen` und `durch Husserls transzendentale Phaenomenologie bzw. Heideggers hermeneutische Phaenomenologie verstehen`. Diese Gesichtspunkt und Stellung von Boss und Frankl folgen die Psychoanalyse von S. Freud auf dem Fusse, aber nicht sein naturwissenschaftliche Verfahren. Husserls transzendentale Phaenomenologie ist eine transzendentale Philosophie, die von Descartes` Philosophie durch Kants Philosophie an deutschem Idealismus verknueft ist. Aber sie unterscheidet sich von jener transzendentalen Philosophie, indem sie transzendentale Subjektivitaet als den Ursprung des Menschen auffasst. Heideggers hermeneutische Phaenomenologie unterscheidet sich von Husserls transzendentaler Phaenomenologie, indem sie Dasein als den Ursprung des Menschen auffasst. Die transzendentale Phaenomenologie und die hermeneutische Phaenomenologie fassen die transzendentale Dimension als den Ursprung auf, aus dem alltaegliches Leben des Menschen stammt. Die transzendentale Dimension der transzendentalen Phaenomenologie ist die des Bewusstseins, und die transzendentale Dimension der hermeneutischen Phaenomenologie ist die des Seins. Boss` Daseinsanalyse fasst Dasein als menschlichen Ursprung auf, und daraus versteht sie psychische Situation des Menschen. Sie therapiert den Patient, indem er selbst den Sinn des Seins durch hermeneutisch-phaenomenologischen Dialog zwischen Patient und Therapeut versteht. Frankls Logotherapie fasst Existenz als menschlichen Ursprung auf, und daraus versteht sie psychische Situation des Menschen in noologischer Dimension. Sie therapiert den Patient, indem er selbst den Sinn des Lebens auffasst, und sich von existentiellem Vakuum befreiet. Daseinsanalyse und Logotherapie haben den Gemeinpunkt, psychische Situation des Menschen mit Phaenomenologie aus der transzendentale Dimension zu verstehen und auslegen. Aber die transzendentale Dimension der Daseinsanalyse ist die Dimension des Seins, und die transzendentale Dimension der Logotherapie ist die noologische Dimension.
