고조선시대(古朝鮮時代)의 경찰기능(警察機能)에 관한 연구

국가가 있는 곳에 질서유지가 요청되는 것은 너무나 당연한 이치이기 때문에 고조선시대에서도 경찰의 존재는 필수 불가결의 요소임에는 틀림이 없다. 따라서 어떠한 형태로든지 경찰업무를 전담하고 처리하는 기관이 존재하였을 것이다. 그럼에도 불구하고 경찰조직의 혼과 뿌리라고 할 수 있는 고조선 시대의 경찰조직과 기능을 살펴보는 일은, 현존하는 문헌이 거의 없기 때문에 어떤 위험성까지 내포되어 있다고 볼 수도 있으나, 반면 한국경찰사적 입장에서 볼 때 고조선의 경찰제도와 경찰기능을 간과할 수 없는 것 또한 사실이다. 그 이유는 한국경찰의 시발점이 어디인지, 경찰권 행사는 누구였는지, 그리고 경찰활동의 범위를 추적해봄으로써 정통성과 자주성을 찾는데 직접적인 연관성을 갖고 있기 때문이다. 이런 맥락에서 본 연구는 첫째, 고조선 성격에 대한 검토로 경찰의 혼과 뿌리를 어디서부터 찾을 것인가 하는 그 기원점을 찾아보고 둘째, 고조선의 통치구조와 관련하여 경찰권의 행사를 누가했을까? 에 초점을 맞추어서 논의를 전개 하였다. 셋째, 경찰권행사의 법적근거가 되는 불문금약(不文禁約)인 八條禁法의 내용을 분석·평가하여 8조금법이 고조선시대의 어떤 사회상을 반영하는지를 고찰하면서 넷째, 앞에서 설명한 경찰역사의 정통성문제, 경찰권행사주체 그리고 법적근거인 8조금법 등을 토대로 고조선의 경찰기능을 다섯 가지 정도 제시하였다. 뿐만 아니라 고조선이라는 우리나라 최초의 국가성립과 멸망과정을 조망하면서 한나라의 역사는 홀로 존재하는 것이 아니라 주변 세계와의 작용의 결과라는 역사의 본질을 놓치지 말아야 한다는 점을 아울러 강조하였다. As the country naturally requests the maintenance of public order, It must be true that the existence of the police at the Gojoseon period was the indispensable element. Accordingly, no matter what the form is, the police service has been effective at any time and place. Nevertheless, It implicates the possibility of danger to examine the police organization and function of the Gojoseon dynasty regarded as the soul and root of the police organizations, because of few existing records about the era. But it is also true that the police system and function of the Gojoseon dynasty must not be ignored in the standpoint with Korean police history. The reason is related with the legitimacy and independency, and it is to pursue the scope of police activities with these researches such as when the Korean police started, who conducted the police authority. In this context, this study conducts following elements. Firstly, it reviews the character of the Gojoseon dynasty, and then seeks the beginning time of the soul and root of Korean police. Second, It focuses on who conducted the police authority with the governing structure of the Gojoseon dynasty and develops the discussion. Third, It analyzes and evaluates the contents of Pal-Jo-Gum-Bup(the eight prohibited rules at the Gojoseon dynasty era), considered as the legal basis of police authority and studies how the rules reflect the social aspect at the Gojoseon dynasty. Fourth, It suggests approximately five police functions at the Gojoseon dynasty period based on the above mentioned legitimacy of police history, the subject of police authority and ``Pal-Jo-Gum-Bup``. In addition, It prospects the establishment and collapse of Gojosen dynasty, the first korean government in the history. Consequently, It emphasizes not to miss the historical essentials that a country``s history can not exist by itself but the result of actions with surrounding countries.
