        기능적 전기 자극에 대한 고찰

        Functional Electrical Stimulation (FES) is used for muscle reeducation, reduction of spasticity, delay of atrophy, and muscle strengthening. FES stronger stimulation than other forms of electrical stimulation. The efficacy of FES in improving function has been substantiated in the literature. Treatment programs employing FES - activation of muscular tissue through the intact peripheral nervous system - can be broken into five major categories, according to the goal of treatment. These broad areas would include the use of FES to: (1) a direct excitation onto the alpha motoneuron, through peripheral stimulation of the Ia myotatic sensory system and ascending afferent information, which will be integrated at conscious and subconscious level of the CNS. (2) The quality of a stimulated muscle contraction is determined by combination of many parameters, including stimulus amplitude, pulse duration, stimulus frequency, and duty cycle. (3) A unit that has a pulse duration between 200 and $400{\mu}sec$ will be more than adequate for FES applications. (4) The neuromuscular plasticity is critically important to return of function using muscle re-education and facilitation applications. (5) Prior to using FES as an electrical orthosis, the patient should build up endurance in the muscles to be stimu1ated during the gait cycle.

        Hwang, Soon-won has been regarded as a writer who is seeking for mainly technical accomplishment rather than ideology and thoughts, and describing mostly the character's inside view. The purpose of this thesis is to understanding wholy such stylistic of Hwang, Soon-won' Works thought analyzing style. First, in individual words especially traditional at words and net created words are appeared frequently. Second, in figure of speech, I considered the aspect of trops and its aesthetic effect. Third, in point of view and narrater, these novels show the character's internal life which the characters meditate deeply to look for their selves. Forth, in cohesion and context, I considered the aspect of the free indirect speech.

        A new design procedure for micro cellular coverage prediction is presented here on this psper, which contains a new propagation analysis algorithm based on processing of vector data representing roads and building which mainly affect the propagation phenomena in micro-cell environments. The propagation analysis algorithm presented here has been developed to aim at the practical application for micro-cellular system such as PCS or CT-2. As all the vectors used here are of closed poly lines, i.e., polygons, a simplified ray path search technique can be developed not only to determine if the calculation points are on the road polygons and but also to calculate the amount of blockage by buildings. The result show a capability of predicting path loss with an RMS error of 5%u33C8 or lower.

        현실-가상세계 컨버전스 시대의 삶의 양식

        이 연구는 일상에서의 갖가지 국면에 가상세계가 어떻게 절합되고 있는지, 그러한 절합이 어떠한 행위와 인식의 경험양식을 배태해내고 있는지 고찰하는 것을 목적으로 한다. 이를 위해 먼저 우리가 살아가고 있는 실재세계 (the real world), 그와 결부되어 있는 현실세계와 가상세계에 대한 이론적 지평을 설명한다. 현실성과 가상성이 어떻게 현실-가상세계의 실재성을 구축하는지를 밝힐 것이다. 거기에서 우리는 대중매체 시대의 유동성의 사사화가 가상세계의 등장으로 말미암아 어떻게 변화하고 있는지를 살펴본다. 연구방법으로는 대학생을 대상으로 근거이론적 방법론에 입각한 경험적 기술과 포커스그룹 인터뷰를 실시했다. 그 결과, 이 연구는 인간관계의 개인화와 새로운 관계설정, 실시간 의제와 참여, 구성주의 지식사회의 증대, 일과 오락/여가의 혼재, 사이와 흐름(interval & flow)의 발견, 감각 속도의 재구성 등을 추출할 수 있었다. 이러한 주요 국면은 각기 독립적으로 존재하는 것이 아니라 현실-가상세계 테크놀로지를 통해 각각의 국면이 공진화(co-evolution)하면서 이루어내고 있는 컨버전스 문화들이다. This study aims to exam how virtual world is articulated with various aspect of everyday, and what mode of life, behavior and perception, are embedded at that articulations. First of all, this paper explains the theoretical horizon of the real world, we are living in, and the actual world and virtual world connected with that. It will remark how reality in actual-virtual world is constructed with actuality and virtuality. It will consider how mobile privatization in mass media has transferred to, due to emergence of the virtual world. As a methodology, this paper has taken experience description and focus-group interview rooted in grounded theory. After consideration, this paper has extracted personalization and new configuration in human relationship, real-time agenda and participation, accretion of constructivism in knowledge society, hybrid of work and entertainment/leisure, discovery of interval & flow, reconstruction of speed sense etc. This significant aspects of actual-virtual world do not exit independently, are co-evolution by actual-virtual technology, eventually a shape of convergence culture accomplished such a co-evolution.

        초ㆍ중등학교의 위법 학칙 분석과 규제 및 개선에 관한 연구

        학교에서는 학생의 복장이나 신발 등을 학칙 또는 학칙 외의 규정에서 규제하거나 독서실 이용 자격을 성적우수자에게만 부여하여 다수의 학생들로부터 갈등이 발생되는 등 기본권 침해의 우려가 있다. 또한 학칙 제ㆍ개정 절차에 학생 학부모 교원의 의견수렴 없이 일방적으로 시행하고 있는 학교도 있고, 학칙에서 필수적으로 기재하여야 할 사항 외에 임의로 규정한 학칙이 대외적 구속력에 의문이 제기되고 있다. 본 연구에서는 학칙에서 일부 특정한 규정이 학생의 기본권을 침해하였는지 그 여부를 판단하기 위해서 기본권 침해 여부에 대한 평가를 하였다. 기본권 침해 여부에 대한 심사는 헌법재판소에서 적용하고 있는 과잉금지원칙과 자의금지의 원칙을 바탕으로 고찰하였으며, 학칙이나 학칙 외의 규정에서 학생의 신발과 복장의 색상이나 모양을 제한하는 것이 생활지도를 위하여 반드시 필요하고 최소한의 제한이라는 것을 입증할 수 없고, 교육목적과 비교하여 학생의 기본권 침해가 더 크다고 볼 수 있는데도 단지 학교에서 전체적이고 일률적으로 학생의 규율과 기강 확립이나 학생 관리의 편의성이라는 이유만으로 학칙 등에 규정하고 있다면 피해의 최소성과 법익의 균형성의 요건에 반한다고 하겠다. 이에 대한 규제 방안으로 학생의 권리를 보호하고, 교육공동체의 의견이 반영된 학칙 운영을 위해서는 교육관련 법령에 학칙을 구체적으로 규제할 수 있는 조항을 신설하여 학교 현장에 적용하는 것이 학칙 시행의 법적 안정성과 학생 권리 침해를 사전에 방지할 수 있는 방안이라 하겠다. In schools, students' clothes and shoes are regulated by school regulations, or only those with excellent grades are entitled to use the reading room, causing conflicts from students and infringing on rights. In addition, some schools are unilaterally implementing the procedure for revising the school regulations without accepting the opinions of the student's parents and teachers, and questions have been raised about the binding force of the school regulations arbitrarily stipulated in addition to the essential information in the school regulations. This study evaluated whether or not the fundamental rights of students were violated by the school regulations. The evaluation of the infringement of fundamental rights was analyzed based on excess prohibition principle and voluntary prohibition principle applied by the Constitutional Court. Restricting the color or shape of a student's shoes and attire in school regulations must be necessary and minimum for living guidance. If the school regulations stipulate the violation of students' fundamental rights just because they are convenient, it violates the requirement of minimum damage and equilibrium of legal interests. In order to regulate this, it was suggested that a precautionary measure was to prepare a law that protects students' rights and regulates school regulations that reflect the opinions of the educational community.

        논문(論文) : 국공립학교 교원의 직무유기죄 적용에 관한 법적 논의

        국공립학교 교원이 정당한 이유 없이 직무수행을 거부하거나 직무를 유기하면 교원도 공무원으로서 형법 제122조의 직무유기죄에 해당하는 경우가 발생할 수도 있다. 이와는 별도로 교원이 법령에 따른 직무상의 의무를 위반하거나 태만히 한 때에는 국가공무원법 제78조 또는 사립학교법 제61조에 따라 징계처분을 받게 된다. 일반적으로 형법상 직무유기죄의 직무는 공무원법상의 본래의 직무 또는 고유한 직무를 의미하며 직무의 내용은 법령의 근거가 있거나 특별한 지시 또는 명령이 있거나공무원이 맡은 바 직무를 수행하지 않으면 실효를 거둘 수 없는 구체적인 직무이어야 한다. 직무유기죄가 성립하기 위해서는 직무수행을 거부하거나 유기하여야 한다.직무 수행거부란 직무를 능동적으로 이행하여야 할 의무 있는 공무원이 정당한 이유없이 그 근무의무에 위배하여 이를 이행하지 않는 것이고, 유기란 정당한 이유 없이 직무를 방임상태에 두거나 직무행위를 포기하는 행위이다. 이에 따라 본고에서는 일반적 직무유기죄 성립과 관련하여 국공립학교 교원이 정당한 이유 없이 직무수행을 거부 또는 유기한 경우 교원에 대한 직무유기죄 적용여부에 관하여 논의하였다. National and public school teachers refuse to perform duties without any justifiable reason, Teachers is punishable by §122, of the Criminal Act of Korea Law. Meanwhile, the teacher when a breach of obligations or neglect is subject to disciplinary action. In general, Dereliction of duty is refers to the original job, or own job of the Government Employee law and to enable refuses a duty accomplishment and must abandon. The contents of duty has the ground of law or there is instruction or order which is special when the duty which the government employee keeps does not accomplish, must be a duty which is concrete is not the possibility of gaining a practical effect. The denial of job duties is required to be performed by active duty without justifiable reasons, the officials will not fulfill and Dereliction of duty is an act of giving up job action without justifiable reasons. Accordingly, this study generally satisfied with respect to Dereliction of duty national and public school teachers refuse to perform duties without any justifiable reason or if the teacher or neglect whether to apply for a job was discussed.

        지방교육의 자주성,전문성 구현과 교육감 선출제도

        인격권의 법적성질과 전개과정에 관한 소고

        In this paper, the concept of personal rights and legal nature are focused on the development process to be discussed. Personal Rights are vague and abstract, it was not easy also recognized as being clearly right. The concept of personal rights, the regulations on the basis of explicit positive law award from the Constitution. And history jurist did not care about Personal Rights. Therefore, the discussion about the concept of personal rights, the department of civil law in terms of the Constitution. In addition, to the legal nature of personal rights were separated investigated to absolute authority, exclusive belongingness rights, expansiveness rights. The development of personal rights of the continental system of countries such as Germany and France to discuss personal rights were investigated and the United States, Japan and Korea were analyzed.
