노동시장 분화에 대한 정치학적 일 고찰: 노동시장 외부자는 어떠한 정치적 존재인가?

1997년 아시아 금융위기와 그 직후에 개정된 1998년 노동법에 의해 한국의 노동시장은 상대적으로 경직된 내부자 노동시장(대기업과 공기업 정규직)과 극도로 유연화된 외부자 노동시장(기간제, 파견제등의 간접근로 형태와 실업자)으로 양분되어 왔다. 그러나 노동시장의 분화와 이에 따른 정치-사회적 영향과 전망을 다루고 있는 학문적 연구는 극히 드물다. 이 글은 노동시장의 분화에 따른 정치학적 분석이라는 새로운 탐색적 연구를 제안하고 있다. 이를테면 (1) 비정규직과실업자, 취약근로계층을 포함한 노동시장 외부자들의 정책선호는 어떠한지, (2) 이들의 정책선호는 투표행위를 통해 비정규직과는 다른 그 어떤 고유한 정당 일체감(partisanship)으로 나타나는지, 그리고 (3) 이러한 연구들을 통해 정치학의 담론 영역에서 노동시장의 분화와 내부자-외부자의 정치행태에 대한 이론적 위치를 규명하는 것 등이다. 그리고 이 논문은 위에 제시한 탐색적 연구들을 진행하기에 앞서 반드시 선행되어야할 이론적.방법론적 분석틀을 고찰하는데에 그 목적이 있다. The 1997 Asian financial crisis and 1998 amendment of labour law reinforced the forming and deepening of labour market dualisation in South Korea, in which the labour market insiders (regular workers in large and public enterprises) enjoy relatively rigid labour flexibility and stable job security, whereas the labour market outsiders (non-regular workers in contract of temproal, fixed-term, and agency at margin) suffer from extreme level of the labour flexibility and job instability. However, the political implications that deal with the consequences of labour market dualisation on the political change have been widely igonored. This paper proposes a new exploratory study of political analysis in accordance with the labour market dualisaion; (1) how the policy preferences of labour marekt outsiders including non-regular workers and uneployed emerge; (2) whether their policy preferences can appear as any unique and homonegous poltical partisanship or policy coalition with political parties; and (3) ultimately to identifying the theoretical position of labour market outsiders and their politcal behaviour in the area of political discourse. And the purpose of this paper is to explore the theoretical and methodological framework for further studies on the politics of labour market dualisation.

이 글은 국가의 공적업무나 개별 정책집행의 착오나 실패에 대한 책임은 누구에게 있는가의 문제, 즉 정치적 책임의 이론화를 위한 시론이다. 따라서 근대 국가론에서 나타나는 시민과 국가의 규범적 관계를 우선 살펴보고 국가가 가지는 책임 (accountability)과 임무 (obligation)가 어떻게 발생하는지 고찰하였다. 근대 민주주의 국가에서 관료(제)의 역할과 책임이 베버 (Weber)의 국가론을 통해 강조되는데, 관료(제)가 갖는 행정적 책임 (administrative accountability)과 정치적 책임 (political accountability)에 대한 개념화와 유형화를 시도하였다. 그리고 정치적 책임은 대의제의 행태와 통치체계 등 공식적 제도의 배열에 따라 상이하게 규정되거나 분석될 수 있는데, 이때 역사적으로 형성되고 배태된 규범과 가치, 선호와 이데올로기 등과 같은 비공식적 제도들이 향후 비교정치학적 맥락에서 정치적 책임을 연구하는데 유용한 분석틀임을 강조하였다. The purpose of this article is to the theorization of political accountability that occurs in errors or failure of state performance or public policy enactment. Therefore, this study investigated the normative relationship between citizen and and state in modern state theories, at first, and then how the accountability and obligation can appear. According to the Weberian bureaucrats state theory that highlightended the roles and responsibilities of the bureaucrats in modern democratic states, this study attempts to conceptualise and presents ananlogy for the administrative accountability and political accountability. It is noteworthy that the political accountability can be analysed and identified differently depending on the arrangement or provision of formal institutions, such as the political system of representative and responsible government behavior. And more importantly, informal institutions such as norms, values and preferences formed by path-dependency machanism, should be emphasised as a useful famework to conduct further studies on the political accountability in the comparative political research field.

This paper examines the history of democracy embodied in ballot paper and presents the normative principles of ballot design, aiming to estimate how the design of the Korea’s ballot is consistent with these principles. The design of ballot paper has been developed in a way of ensuring and extending the right to vote, by securing the values of democratic elections. Based on the assurance objectives of fairness among competitive alternatives, effective exercise of sovereignty, and legitimacy of result declaration, the ballot paper is devised to implement the standard principles of indifference, accessibility and efficiency. However, the current process of designing ballots in Korea is accompanied by some problems that are incompatible with the normative principles of ballot design such as the indifference and universal design. For this, the authors suggest further experimental interdisciplinary studies on the design of ballot paper.

한국 투표용지 디자인에 관한 실험 연구 - 공직선거법 규정에 대한 문제제기 -

Rather the ballot paper design could influence voting behavior, there is less study upon the designing ballot paper and the importance of information design. This study examines the possibility of error occurring in the ballot paper design under the rules of Public Official Election Act. To do this, we conducted a heuristic evaluation method to review regulations, and an empirical experiment with closed groups. From this, we found that (1) diverse cases of ballot paper can be produced, and (2) various fonts, sizes, and materials can be used. Accordingly, it is inevitable to deliver regulations on (1) the usage of chromaticity and image, (2) the applying universal designed-typography, and (3) the margin for the spacing between ballot boxes. This study, at the end, suggests institutional measures for securing the validity and legitimacy on the decision-making process to remove latent ambiguity in ballot paper designing.
