장애학생 인권보호를 위한 교육정책의 성과와 발전방안: 특수학급 교사의 인식을 중심으로

본 연구는 특수학급 교사의 인식을 통해 2011년에 수립된 「장애학생 인권보호 지원 방안」을 중심으로 학교 현장에서 시행되고 있는 장애학생 인권보호 교육정책의 성과를 살펴보고 발전방안을 제시하는 것을 목적으로 한다. 이를 위해 전국 초·중·고등학교 특수교사를 대상으로 장애학생 인권보호 교육정책의 세부과제별 인식도, 중요도, 실행도, 효과성에 대한 인식 수준을 조사하였고, 개별 면담조사를 통해 장애학생 인권보호 교육정책의 발전방안을 분석하여 제시하였다. 연구결과 특수학급 교사들은 학교 현장에서 장애학생 인권보호 교육정책이 장애학생의 인권을 보호하는 데 긍정적인 효과가 있었으며, 교육정책으로 인해 장애·비장애학생 대상의 성교육 및 인권교육이 활성화되고 수업에 활용할 수 있는 교육자료 및 프로그램 개발이 강화된 것으로 나타났다. 또한 교육부, 시·도교육청 차원에서 장애학생 인권보호를 위한 법령 및 제도 개선, 연수 확대, 상설모니터단 역할 강화 등 정책적 시사점을 도출할 수 있었다. 장애학생 인권보호 교육정책의 발전 방안으로는 첫째, 장애인권교육의 교육과정 반영이다. 교육과정 내 시수확보를 통해 장애인권교육이 안정적으로 이루어져야 한다. 둘째 가정, 학교, 지역사회 연계를 통한 장애학생 및 학부모 지원 강화이다. 장애학생 인권보호를 위한 지역사회 연계 강화 정책을 제도화하고, 관련 프로그램의 개발 및 실행이 필요하다. 셋째, 특수교육 지원센터 상설모니터단의 전문성 향상을 통한 학교 지원 강화이다. 상설모니터단 관련 예산확대 및 전담인력 배치로 장애학생 인권보호 예방활동 및 인권침해 사안 발생 시 신속한 학교지원이 필요하다. 넷째, 장애인권 교육자료 개발 및 보급 확대이다. 장애유형과 특성을 반영한 교수학습자료를 개발, 보급하고, 교사 연수 확대가 필요하다. The purpose of this study is to analyze the performance and development plan of education policy for students with disabilities human rights protection through the recognition of the special class teachers. To this end, we investigated the recognition of the special class teachers`s awareness, importance, implementation, effectiveness by detailed tasks of education policy for students with disabilities human rights protection, proposed the development plans by analyzing through individual interviews. The results of this study are the policy for students with disabilities human rights protection was positive to protect the human rights of students with disabilities, sexual and human rights education was activated, educational materials and programs that can be utilized in the classroom were strengthened. We were able to derive the policy implications including improved laws and institutions for students with disabilities human rights protection, expanding training, enhanced the role of the human rights violation monitoring teams. Development plans of students with disabilities human rights protection are human rights education for students with disabilities should be reflected in the education curriculum, support for students with disabilities and parents should be strengthened by links of the family, school, community, support for school by strengthening expertise of the human rights violation monitoring team should be strengthened, development and supply of educational materials should be expanded.
