특허의 가치는 몇 가지 환경 요인에 의해 달라진다. 시장의 진화가 특허의 가치를 저하시킬 수 있으며, 경쟁사간 특허의 분산 소유로 인해 특허의 가치가 저하될 수도 있다. 또한 자유로이 사용할 수 있거나 더 저렴한 대안 기술이 나타나 특허의 가치를 사라지게 할 수도 있으며, 특허 제도가 가진 결함이나 부실하게 작성된 특허 문서, 또한 사법 제도의 부실함으로 인해 특허의 가치가 작아질 수도 있다. 이러한 환경의 영향을 고려하여야만 환경의 변화에 대응하여 그 가치를 유지할 수 있는 특허(또는 특허 포트폴리오)를 식별하거나 창출할 수 있다.

미국의 우회덤핑방지제도와 회피방지제도에 대한 우리나라의 대응방안

Circumvention refers to the situation in which exporters try to circumvent import restrictions by setting up factories in third countries and assembling and producing parts locally. Circumvention dumping eliminates the impacts of existing anti-dumping measures, and major countries are introducing anti-circumvention dumping laws to address this problem. If the act of the exporting country is recognized as a circumvention dumping activity, anti-dumping duties are applied retroactively to the imported goods or components. Evasion is an act of importation that results in the reduction or non-application of cash deposits, securities, or anti-dumping or countervailing duties, in a manner that is substantive or false, substantive or omission. In this article, we reviewed the contents and examples of the anti-circumvention measures by the US Department of Commerce (DOC), the International Trade Commission (ITC), and the Anti-Evasion measures by the CBP. The CBP examples show how much inference can be made about which parts of the CBP's investigations, and in what ways. The enactment of the EAPA created an environment in which the role of the CBP was directly guaranteed, and it was possible to apply adverse inferences to those who did not respond to requests for information, resulting in stronger CBP's authority. Therefore, it is advisable for Korea to examine the introduction of domestic laws, such as the bypass anti-dumping system, in order to cope with unfair trade practices that undermine and neutralize the effects of anti-dumping measures.

1910년 한일 합병으로 일본 상권은 계속 한국 시장에 대한 독점적 지위를 누리면서 구미의 상품을 한국에 팔고 한국 상품을 구미에 팜으로 인해서 중간이득을 취할 수 있었다. 일본으로서 한국은 식량과 원료의 공급원으로서 그리고 제품의 판매시장으로서 전통적 식민지 무역 형태를 갖추었으며 한국 농업은 일본의 식량 공급과 공원 원료의 공급원으로서 역할을 하게 되었고 한국 광업은 일본공업 원료의 공급처로서의 기능을 하였다. 일본산업의 지속적 성장과 군수산업의 민수화 전환이 완성됨으로서 금융 공황이 발생하고 나아가 세계 대 공황으로까지 이어지자 일본은 대외적으로 대륙침략을 통해서 시장 확대를 꾀하게 되었는데 그 전초기지로서 한국 특히 북한 지방을 이용하게 됨에 따라 일본 자본이 한반도에 유입되어 제철소, 댐이 건설되었으며 이것들은 하나같이 일본의 공업 반제품의 공급과 대륙시장을 겨냥한 것이었다. 철도 항만 등은 대일 수송과 일본 상품의 한국 시장에의 판매에 기여하였으며 우리나라 사회 간접 자본의 형성에 기여했다는 일본의 주장은 맞지 않으며 그들의 군사적 상업적 이익을 위해서 건설해 놓았음을 알 수 있다. 식민경제의 유산으로 남경북중(南輕北重)이란 한국의 특이한 공업구조가 발생하였는바 남북분단으로부터 해방 후 한국 산업이 거의 마비 상태에 이르게 하는 원인이 되었다. 해방이후, 분단된 상태에서 인플레이션과 그에 대응해서 미국의 무상 원조에 의한 구제에 의존 할 수밖에 없는 상황과 함께 미국 경제의 침체로 우리나라는 공업화를 위해 자본조달 기술 함양 등을 위 해 일본을 비롯한 차관에 의존할 수밖에 없었으며 이로 인해 대일무역 수지 적자의 누적과 차관 잔고 의 누증을 가져오게 되었고, 일본 정부의 청구권(배상)운영이 일본 기업이 계속적 대한 진출이 가능하 도록 했다는 점에서 식민지 경영을 청산하면서 변칙적으로 일본의 산업 지배를 낳게 한 측면에서 대 일무역 역조와 대일 자본 도입이라는 현상이 지속하게 된 원인은 일제 식민지 경제의 유산이었다. 일제하의 한국의 산업은 일본공업제품의 식민지 판매를 위한 채널로서 농업 생산물의 저렴한 공급을 가능 하게하는 식민지 수탈기능을 하였고 식민지하에서의 식민공업은 식민모국에 종속적으로 연관시키는 기능을 하였으며 무역 또한 성장의 엔진역할이란 고유기능을 못하고 기형화된 의존경제를 형성해 놓았다. 아울러 대미의존 심화도 일본 식민지에서 해방하였으므로 미 군정청이 있었고 미군정청의 지배로 미국의 한국에 대한 영향력이 커지고 대미 의존도가 심화되는 결과를 낳았다. Japan wiped off the foundation to form Korea's setting capital by massive entering into the agriculture, mining as well as commerce. Korea economic included in as a part of Japan had went through a chaos with the liberation from Japan, left absolute poverty. Poor consumer product industry broken cut off from the North Korea industry which was established by Japan was not able to supply everyday product. Also, the massive demands of products were being increased by refugee from Korean War and people returning to their hometown. As the result, the inflation was broken and the vicious cycle of poverty was continued in spit of purring the huge amount of foreign materials. Since the colony period of Japan, we have been pressed by Japan's power in technology and capital. To overcome this situation, it is valuable to study the past and to analysis that environment. So this study analysis the korea economic during the Japanese colony and how that had affect korea trade after release from Japan.

The aim of this thesis is to study Emerson's view of poet. The poet is an Arch-Transcendentalist. He is a central man of Emerson's Transcendental fabric. Unlike the spirit of Christianity which is based on man's original sin and God's redeeming power, Emerson's Transcendentalism is based on man's divine nature as a particle of God. In Emerson's world God's spirit run through man and nature. In "The poet" Emerson ckefubes the ideal type of poet. He is not a mere thinker, nor a mere singer. Instead, he should be a genius and Man Thinking. The poet makes his reader feel the divine nature through him and nature. This feling and insight make man awaken from the material basis. The poet has Imagination and creates ideal vision with it. He exists not only for himself but for all man because he is a representative man. We can also conclude that Emerson himself tried to be such a poet-a spiritual leader, or prophet of his own time. Emerson implied the role of a poet as prophet. Emerson thought the poet should escape from his personality and achieve Universality in art. This does not mean that value of rhetoric alone would be the whole concerns expected to be mastered by Emerson's poet. Imagination, sincerity and moral depth-these primary concerns should go with them.
