이 글의 목적은 프랑스 기억법들의 내용, 2005년에 발생한 기억법들에 관한 갈등과 이의 해소, 이러한 논란이 중등학교 역사 교육과정에 끼친 영향력을 분석하는 것이다. 프랑스에서 반인륜 범죄의 역사 부정을 처벌하는 법(1990년), 아르메니아인 제노사이드를 인정하는 법(2001년), 노예제를 반인륜 범죄로 규정하고 역사 교육과정에 노예제를 포함하게 한 법(2001년)이 제정되었다. 2005년에는 북아프리카의 과거 식민지에서 귀환한 이들의 국가적 기여를 인정하는 법이 제정되었다. 그런데 이 법은 식민화의 긍정적 측면을 교육하도록 해 역사학계와 시민사회의 반발을 야기했다. 이 갈등은 위헌 판결을 받은 해당 법 조항이 삭제되면서 해소되었다. 2005년 기억법 논란과 같은 해 발생한 이민 2세대의 소요 사태는 식민화와 탈식민화, 이주의 역사에 대한 이해가 필요하다는 점을 확인시켰다. 이에 2008년 중학교, 2010~2011년 고등학교 역사 교육과정이 개정되었다. 개정 교육과정은 이전과 달리 비유럽 문명, 노예제, 식민화와 탈식민화, 이주 역사를 포함했다. 이 같은 프랑스의 사례는 역사의 정치화에 대한 성찰적 이해의 필요성과 다문화 사회의 공존을 위한 역사교육의 중요성을 환기한다. The purpose of this article is to analyse the content of the French Memory Laws, the conflicts over these laws that arose in 2005, and the impact of these controversies on secondary school history education programmes. In France, a law(1990) punishing the denial of historical facts of crimes against humanity, a law(2001) recognising the Armenian genocide, and a law(2001) recognising slavery as a crime against humanity and requiring the inclusion of slavery in history education programmes were enacted. In 2005, a law was enacted to recognise the national contribution of returnees from North Africa's former colonies. However, the law has caused a backlash from historians and civil society because it's phrase requires schools to teach the positive aspects of colonization. This conflict was resolved when the phrase, which was ruled unconstitutional, was removed from the law. The 2005 controversy over the Memory Laws and the second-generation migrant riots that occurred that same year confirmed the need to understand the history of decolonization and migration. In response, the middle school history program was revised in 2008 and the high school history program in 2010~2011. The revised program included more non-European civilizations, slavery, colonization and decolonization, and migration history than ever before. The French case highlights the need for a reflective understanding of the politicization of history and the importance of history education for coexistence in a multicultural society.
