단독이용 불가능한 국･공유지 관리방안 - 고양시 소재 한국농어촌공사 보유 토지를 중심으로 -

본 연구는 한국농어촌공사에서 보유한 토지 중 기능 상실로 인하여 독자적으로는 이용하거나 단독이용 불가능한 국･공유재산에 대하여 관리와 처분 등 매각사례를 통해 문제점과 개선방안을 제시하고, 소유권 미확보 토지는 효율적 관리 방법을 제시하고자 한다. 연구 결과 첫째, 토지처분 시 수의계약에 대한 명확한 규정이 없다. 이를 위한 방법으로는 토지 처분에서 수의계약에 대한 정확한 명시와 정의의 기준이 필요로 하며, 적은면적일 경우 수의계약을 적극 이용하여 인근 토지 소유자에 대하여 우선 권한을 적용하여 처분하는 방식을 적용한다. 둘째, 일반 공개경쟁 매각에 있어 제한입찰 방식 또는 전자수의시담 방식을 적용하여야 한다. 해결방안으로는 모든 사람이 아닌 이해관계자에게 우선 입찰 권한을 부여, 나라장터 이용 시 공개경쟁 입찰이 아닌 제한입찰 방식 또는 경쟁입찰에 부치지 않고 특정인을 선정하여 계약을 체결하는 전자수의시담 방식을 적용하여 시행한다. 셋째, 단독이용 불가능한 토지 이용 가치에 대한 활용가치를 판단하여 체계적인 재산관리가 우선되도록 하여야 한다. 활용 토지에 대하여 계속적인 보유 및 처분을 결정 하여 보유결정에 의해서는 토지에 대한 사용권이 아닌 이용권을 주는 방법, 설치한 시설에 대하여 기부채납을 적용하는 방법을 적용하여 관리해야 한다. As a problem in the method of disposing of land assets. First, there is no definition or description of land disposal in veterinary contracts. There is a need to establish the criterion for accurate specification and definition of the private contract in relation to land disposal. It is necessary to give the preferential right to the neighboring landowner to dispose of the small-area national or public land by making active use of the private contract. Second, the public bidding procedure is used to dispose of national and public land in a general competitive open bidding method. The solution to it is to confer the authority of preferential bidding on the stakeholder, not all people, and to apply the electronic or private settlement method of entering into a contract by selecting a particular person while either using the restrictive bidding method, not the open bidding method, or not calling for the competitive bidding at the time of using Korea Online EProcurement System. Third, land incapable of separate use should be systematically managed by judging its use and utilization values. It is necessary to determine how to keep and dispose of the land continuously, and apply the method of applying the donation to the facility and the method of granting the use right instead of the right to use the land.
