The Purpose of this study is to analyze a psychological warfare system of german federal armed forces during cold war, focusing on the organization and strategy, which has not been discussed in domestic academical community. This article deals with psychological warfare of west germany until 1990 when the PSK/PSV operations are declared to be stopped officially. The main point of this article is to assess a continuation and change of PSK strategy before/after 1972, where was agreed to stop mutual aggressive psychological warfare in the west-east german border area. This study will illustrate the attitude how the west german army perceived the psychological warfare in the process of solving the ‘german problem’ and clarify the approaches how the west germany dealt with the PSK, which ultimately gives some implications for the Korean Peninsula. Lastly, this study argues that west germany pursued a dual track strategy against east germany, on the one hand ‘wandel durch annaehrung’ and on the other hand ‘Realpolitik’.

독일 조직법은 인체 조직과 세포 등을 다루는데 있어 이식법, 의약품법, 수혈법 등을 개정함으로써 이들의 기증, 채취, 가공, 보존, 검사, 보관, 유통 등을 위한 다양한 법적 절차를 마련해 두고 있다. 이는 독일에서 그만큼 인간을 대상으로 하는 인체 조직과 세포 등의 기증에 관한 법적 절차를 명확히 하여 최대한도로 이들의 질을 확보하고 안전장치를 갖추어 발생할 수 있는 문제들을 사전에 방지하고자 함이다. 인간을 대상으로 인체 조직을 기증받고 이를 채취, 이식, 보관, 분배하는 등의 행위는 무엇보다도 기증자의 숭고한 기증정신을 중심에 두고 투명하게 이루어져야 한다. 이러한 측면에서 본 논문은 인체 조직과 세포의 기증 및 관리에 관한 체계적인 법적 근거를 담고 있는 독일 조직법의 입법 배경 및 논의 과정, 주요 내용 그리고 관련 기관들에 대해 살펴보고 있다. 〈The Act on quality and safety of human tissues and cells〉 in Germany has many provisions which deal with the donation and practical use of human tissues and cells. It shows that German legislators make an effort to control strictly the donation, procurement, preservation, storage and distribution etc. of human tissues and cells under clear legal grounds, so that they ensure the quality and safety of human tissues and cells. According to the donation spirit of donors, human tissues and cells should be clearly donated, procured and distributed, it is not for the users of the donated human tissues and cells. This article deals with the legislative background, discussion and main contents of 〈The Act on quality and safety for human tissues and cells〉 and related institutions in Germany. This article is meaningful as a preceding research for the further discussion to enhance the legal system of donation, procurement, preservation, storage and distribution etc. of human tissues and cells in South Korea.
