중국의 근대 국가경찰제도에 관한 연구 : 조직구조 및 인사제도를 중심으로
1992년에 중국과 한국 수교가 이루어지고 양국 간에 인적 물적 교류가 급속도로 활발하게 이루어지고 있다. 양국 경제·민간교류는 17년간 급속하게 성장을 이루면서 공생관계를 굳혀 왔다. 중국과 한국간의 인적·물적 교류가 증대되는 양국 간에 각종 범죄도 정비례하여 날로 증가하고 있는 추세이다. 한· 중 양국 간에 발생하는 범죄는 이미 어느 한 국가의 힘만으로는 해결할 수 없으며, 양국 경찰의 상호간에 교류와 협력이 있어야만 해결할 수 있다. 중국경찰은 사회주의 경찰로서 무엇보다는 정치적·사상적 색채가 강하다. 여기서 정치적·사상적 성격이란 마르크스가 주장하는 계급성과 당파성을 의미한다. 중국경찰은 중국 사회주의 체제의 안정에 가장 큰 비중을 두고 있다. 그 다음으로 치안질서 유지와 인민의 신변안전 등의 임무를 수행한다. 중국 경찰은 국가안정과 사회적 안정을 위해 많은 역할을 해왔다. 본 연구는 중국경찰제도 및 기본상황을 이해하기 위해 문헌조사와 실증고찰을 바탕으로 작성하고 주요 개념을 제시한다. 그리고 중화인민공화국 건국 후부터 지금까지 각 시기 경찰제도의 발전과정과 수행임무의 변화를 논술한다. 본 연구는 중국 국가경찰 조직구성 원칙과 조직구성 체계, 그리고 공안기관과 기타 국가기관의 관계를 분석하고 국가경찰의 관리체제 경찰직함(경함)제도, 임용제도, 퇴직제도 등 인사제도를 분석한다. 그리고 중국경찰제도의 문제점과 개선방안도 제시한다. 중국경찰은 사회주의 경찰로서 사회주의체제 수호하는데 많은 비중을 두고 있으며 다음으로 경찰의 고유 기능이 치안유지에 힘쓰고 있다. 중국경찰은 중국 공산당과 정부에서 강조되고 중국특색사회주의 체제의 수호자이며, 또한 인민의 생명과 재산을 보호하는 치안유지라는 두 가지 임무를 동시에 수행해야 하는 이중적 책임을 안고 있다. 중국은 법치행정을 강조하고 있다. 경찰에 있어서도 각종 규정과 절차에 따른 집행을 요구하고 있으며, 중국 법학계에서는 경찰의 범죄혐의자에 대한 미란다원칙의 적용에 대한 논의가 활발하게 진행되고 있다. 중국경찰의 임무도 과거 반혁명분자 위주의 검거가 핵심이었다면 현재는 시장경제로의 전환과 경제의 급속화로 인해서 파생된 사회치안으로 전환되고 있다. After 1992 the establishment of diplomatic relations between China and South Korea, the culture and material exchanges between two countries have become very active. Economic and non-governmental exchanges in the seventeen years after the establishment of diplomatic relations between China and South Korea developed in a high speed. At the same time, the coexistence of the two countries has greatly increased. Because of a rapid increase in culture and material exchanges between two countries, a variety of criminal acts increase rapidly. The criminal acts between South Korea and China is not an issue that any country can solve alone. The police of two countries need solve the issues through mutual exchange and co-operation. China has adopted socialist police system, so the political and ideological overtones are very strong. The political and ideological overtones in here are the class character and partisanship which is Marxism pointed out. Chinese police pay more attention to protect the safety of the socialist system, and then maintain the security of society and protect people's personal safety. This paper elaborates on the Chinese police system and the basic situation, puts forward the concept through the study of documents, illustrates the course of the development of the police system from the founding of People’s Republic of China to the present and the working priorities transformation. This paper analyzes the principles of Chinese police organization constitution and the relationship between state organs. It analyzes the national police management system, police rank system, appointment system, retirement system. Finally, it provides the trouble spots in Chinese police system and process improvement. The Chinese police have focused on protecting the socialist system with Chinese characteristics and people's lives and property. At the same time it is responsible for the implementation of these two assignments. China stresses the administration according to law. At the same the police executes assignment according to diversified regulations. In jurisprudential circle of China, various laws, which are suitable for criminal suspects are arguing actively. Chinese police focus on counter-revolutionaries in the past. But now the Chinese police focus on the market economy and maintain the social order caused by the rapid economic development.
